BACKGROUND: The Seventh Day Adventist Church is requesting a. conditional use
permit to allow an apprwdmately 1,109 square foot expansion to the existing 2,233
square foot building. The history of this building is unclear, but It has operated many
years as a community service center, As such, it is a non -conforming use, and thus
requires a CUP for expansion.. The zomm� regulations do provide for expansion of non-

The Kalispell Planning Board held a public hearing on August 9, 2005 regarding the
proposal.. The staff recommended .died approval subject jeet to 5 conditions in the staff report.
At the public hearing, the applicants spoke in favor of the rcque st. Two letters o
opposition from tree adjoining property owners were presented and an adjoining
property owner spoke in opposition stating traffic was a problem, past management
was wanting, and the site was unkempt at times. There was no one else who spoke at
the public hearing.
After the public hearing the board discussed the project and a motion was made and
passed on a unanimous vote to recommend to the Kalispell City Council that the
conditional use permit be approved subject to conditions found In Exhibit A attached
to the transmittal letter,
RECOMMENDATION: A motion to approve the conditional use permit wo .d. be in
order.
FISCAL EFFECTS: Minor positive impacts once fully developed.
ALTERNATIVES: As suggested by the city council.

Tom Jentz from the Planning Department presented staff report #KCU-05-7 evaluating
the proposal and stating the zoning regulations do provide for expansions sions of non-
conforming uses with a. total cumulative expansion not to exceed. 0% of the original use
or building. This building is used as a community service center for the distribution o
donated items. The current zoning on the property is -3, Urban Single -Family
Residential. Staff recommended approval of the conditional use permit subject to the
5 conditions outlined in the staff report.
At the public hearing, the applicants spoke in favor of the request stating that this
facility provided a. significant public benefit and the purpose of the expansion was to

Street. The entire parcel contains approximately ,too square feet. According to
the application, the area devoted to the emsting buildingare.d addition is

the KahspeH Zoning Ordinance, parkinfor "community and recreational
centers" is based upon the gross floor area space per 250 s� or I space per
four patrons. The parldng requirement would be 14 spaces. The .a shows
20 spaces, which is more than adequate. According to the zoning ordinance,
this expansion wo ld generate the need for the parking lot to comply with a
applicable paving, l and scapm' and curbing requirements because the
project would require a. building permit.

b. Traffic Circulation: Peak ties for traffic entering and leaving the facility are
Tuesdays, the only day the facihty is opera.. Traffic enters the site from the
main access to the east off of 9th Avenue EN. Vehicles trips are counted as
vehicles eater- and exit the site. No data o tip generation is available from
the Institute of Transportation Engineers' Trip Generation Manual, 1991
Edition.
C. Open.. Space: No speck open space requirements are apphcable to thds use
other- than those associated with the requIred setbacks, which have been
adequately observed on the site plan. Because of the slze of the parcel, there
is not a significant amount of space on the site that is undeveloped.

of adjacent properties and the street. Perhaps are area west of the addition

story in height.

a.. Schools: This building is within the boundaries of School District 5. No
impact on the school district can be anticipated as a result of the proposed
expansion.
. Parks and recreation: No apparent impacts to the Kahspell Parks and
Recreation e artme .t appear to be associated with the proposed
expansion.
C. Police: This faciEty is currently served by the Kalispell Police Department.

d. Fire Protection: Fire protection is currently provided by the Kalispefl Fire
Department. Given the size of the site, fire access is not a problem.

water services provided by the City can be anticipated as a. result of this
expansion.

We would like to go on record as being a amst the expansion of the current WeLfare
Center. We are very concemed with the additional traffic that the expansion will create
and that the Center would double in size. We would like to state that this Center is M the
middle of an older residential area.
Ninth Avenue E. N. is a w*et street . really until ` .says when. the ,facility is open
due to insufficient pang, the people coming to the center park dl over Ninth Ave. E. N.
chiding in front of our mail boxes. It was our understanding, that the lot was to be
paved, but has not been thus all of this traffic creates excessive dirt and dust to our area.
Because the Center 's not m-c�mtained on a daily basis people just dump junk, old
appliances, and boxes of stuff which sit out there and get wet or dirty from the wind and
are an eye sore to our neighborhood. The Center posted a sign regarding in when people
could drop off, but very fear pay attention to this.
There is also unwanted activity going on in and around the property. This is a wee
r esi*dential neighborhood and we would like to see it stay that way. People are sleeping
-under the trees and around the buiddinac.
We are also concemed about the property values of the homes in the area due to this
expansion and the quality of life that we one had M this ee residential ential eighorhod d .

pr a t t our telephone conversation with Ms. Wilson o U , ,we would like to reiterate
that we vehemently object to the proposed expansion of the current Welfare Center. The
proposed plan would almost double the size of the existing facility.
Currently this area is a residential area that does not have adequate infrastructure to
accommodate the existi 'bus ness (Charity) not to mention a much larger facility. Some of our
concerns are as follows:
The existincy road and parking tot is not conducive to being a good l or. Tuesdays when
the facility is open - due to insufficient parking the surrounding area is a circus and a Eger to
not only the residents but to the people who visit thecenter- The Center in on a very narrow horse
shoe road that barely accom-modates two way traffic rnuch less people parking on the side of the
road - which is the cent practice of individuals visiting the Center.
The Parking area it self is a gravel lot that stirs up excessive dirt and dust due to the heavy use or
the Center on Tuesdays and is clearly to small to accommodate the number of individuals that
visit the Center.
Due to the fact that the Center is not maintained on a daily basis - You have people dumping
r m t re, appliances and other junk all over -the front of the propem . This is clearly a
