BACKGROUND: Heritage Investors, L.L.C. is requesting a conditional use permit to
expand an xi-stingbed retirement home in an H- 1, Health Care, zoning district.
The expansion would add 28 beds and an accessory apartment. Retirement homes
are listed as a conditionally permitted use in the # I zoning district. The facility
would be residential in nature and open accordingly. Y
The Kalispell Planning Board held a public, hearing on August 9, 2005 regarding the
proposal. The staff recommended approval subject to 8 conditions in the staff report..
t the public hearing, the applicant spoke in favor of the request stating that they
were excited about the expansion which was necessitated by a continued need for the
services they provide. There was no one else who spoke at the public hearing.
After the public hearing the board discussed the project and a motion was made and
passed on a unanimous vote to recommend to the Kalispell City Council that the
conditional use permit be approved subject to conditions found in Exhibit A attached
to the transmittal letter.
RECOMMENDATION: A motion to approve the conditional use permit would be in
order.

The applicant has applied to the City of Kalispell for a conditional use permit to expand an
existing retirement hone, adding 2 8 beds and an accessory apartment, in the H-1, Health Care zone.
The Kalispell City planning Board and Zoning Commission, after due and proper notice, on
August 9, 2005, held a public hearing on the application, took public comment and recommended
that the application he approved subject to eight conditions.
After reviewing the application, the record, the Kalispell Planning Department report, and
after duly considering the matter, the City Council of the City of Kalispell, pursuant to the Kalispell
Zoning Ordinance, hereby adopts Kalispell Planning Department Conditional Use Report #KCU- 5-
as the Council's findings of fact, and issues and grants to the above -described real property a
conditional use permit to expand an existing retirement hone in the H-1, Health Care zoning district
subject to the following conditions:
1: The proposal will be developed 1n substantial conformance with the approved site plan and
other application materials. That the conditions associated with this penult shall he met prior to
use of the buildings,
2. The applicant comply with all building and Fire codes prior to occupancy of the building.
3. The sidewalk along the north side of the driveway on Commons Loop shall he connected with
the public sidewalk in the right-of-way. The sidewalk shall meet AAA standards, including
slopes.
. That a five foot sidewalk be constructed in the public right-of-way along the applicants' site
fronting Heritage Way. Said walk shall comply with the Kalispell Standards for resign and
Constriction and connect the existing sidewalks on Commons Loop and Windward Way.
. The applicant shall construct curb and gutter for the site's frontage along Heritage Way. Said
work shall comply with the Kalispell Standards for resign and Construction. 'ifthe Kalispell
Public Works Department deems that it is not in the nest interest of the City to install these at
this time, they shall state so in writing and the applicant shall waive the right to protest an SID
to construct those items.

The Kalispell City Planning Board met on August 9, 2005, and held a public hearing to
consider a. request by Heritage Investors L.L.C. to expand are existing 114 bed
retirement home in an H- 1, Health Care, zoning district. The expansion would acid 2
beds are.d an accessory apartment. The Property is located at 171 Heritage Way.
Retirement homes are listed as a. conditionally ly permitted use in the H- I zoning
district. The facility would be residential in nature and operated accordingly,
Tom Jentz from the Planning Department presented staff report #KCU-05-8 evaluating
the proposal and stating that this appeared to be a logical expansion of an existing
facility. The staff recommended approval subject to 8 conditions in the staff report.

Size and Location: This parcel contains approximately 4.7 acres and is
located on the northeast corner of Heritage Way and Commons Loop, just east
of US Highway 3. The property address is 171 Heritage Way and can be
described as Lot 1 Heritage 'lace in Section 6, Township 28 North, Range 21

EVALUATION OF THE REQUEST
.e application is reviewed in accordance with the conditional use review criter* a in
the Kalispell Zoning Ordinance.
1 Site Suitability:
a.. Adeguate Useable Space. The site appears to provide adequate space to
accommodate the proposed use with regard to the number of residents,
parking, a recreation area and access. The site has adequate space t
provide for landscaping and adequate circulation wit .in the site. - l
zoning allows for up to 5% of the lot to be occupied by the permitted
structures. The existing and proposed buildm'gs do not exceed this

The plait of Heritage Plaice shows a 30 foot "road and utility eas mentp�
along the rest side of the property. Commons Loop appears to be built
west of this easement. Should the applicant wish to utilize this area for
construction, they mist amend the plat to modify or eliminate this
easement.
. Adequate Access: Access to the site is proposed by way of existing
driveways to the south of the site off of Heritage Way. The existing
driveway also provides access to Commons Loop to the west. Access is
adequate.
C. Environmental Constraints: The site is gently sloping, and no flood lain,

surface water or wetlands are on the site. The grade in this portion of
the site is slight and does not appear to pose significant challenges to

construction. Prior to breaking ground, a drainage plan will need to be
developed and approved by the Kalispell. Public Works Department to
handle any potential runoff from the site. No other significant
environmental constraints are apparent on the property.
2. Appropriateness of design:
a.. Parking -and site circulation: Kalispell Zoning Ordinance 2 .35.050 22
requires one space per staff member at maxima shift) plus one space
per five beds/residents. The applicant is not proposing to provide any
additional parking with this proposal.
Currently, there are seventy-nine pang spaces located in the two
lots. However, at least two are occupied with temporary storage
buildings and bring the effective number of spaces to 77. With a total o
2 beds at completion (114 current beds plus 28 proposed) twenty-nine
spaces will be required for residents. Anticipated maximum shift after
construction is 2; requiring 52 spaces. Total required parking would be
eighty -ore . Four additional spaces are required.
Traffic circulation within the site is generally adequate with three
driveway approaches and service and refuse handled in the rear. The
KahspeH Fire Department is satisfied with access to the site.
. ......... +. pace: No specific open space requirements exist in the zoning
regulations for a development of this type. The zoning requirements for
setbacks and lot coverage have been met. There is adequate space on
the site to accommodate landscaping and the required parking areas.
The em'sting facihty has two courtyards that allow residents are.d their
guests to gather outside. With the completion of this addition, a third
courtyard will e built. Staff recommends that plenty of hard surface
area be provided in this courtyard as it allows residents with mobility
impairments greater flexibility. Creative use of retaininwalls would
allow for hands-on enjoyment of the open space by the residents as well.

mature landscaping including trees, shrubs and lawn. The plan shows
additional landscaping. No additional landscaping appears to be
warranted.

a. Schools: This site is within School District 5. No impact is associated
with the proposed expansion.
. Parks and Recreation: There are parks and cornmon areas within close
proximity to the site but none within walking distance for residents.

Heritage Way is a ci-ty street with no curb, gutter or sidewalk's on either
side. The Off -Street Parking standards in the Kalispell Zoning
Ordinance require that "`mere there is no existing curb, gutter or
sidewahk, the applicant shad install such curb, fitter and sidewalk and,
except for driveways, shank install a. landscaped boulevard along the
entire length of the ' property line if required by the Site Development
Review Committee." staff is recommending that sidewalks be installers
at this time. If the Public works e artine .t deems curb and gutter are
not required at this time, the applicant should wai ve the right to protest
a Special Improvement District S1 to construct those amenities.
. Neighborhood c Impacts: Impacts of the proposal are .not anticipated to be
significant to the immediate neighborhood. Traffic generation for such a facility
would not likely be higher than other medical or commercial uses nearby. No
significant impacts are anticipated from, noise, vibration, or dust. Any
additional outdoor lighting should be shielded and directed downward. No
impacts from smoke, fumes, gas, odors, or inappropriate hours of operation are
anticipated e turd the norm of an urban mbxed use neighborhood. A notice of
public hearing was mailed to property owners Within 150 feet of the site
approximately 15 days prior to the hearing. g. As of this vesting, staff has
received no comments from neighbors on the proposal.

. Consideration of historical use patterns and recent changes: The proposal
is compatible with the immediate area, where a m-Lx of uses is anticipated and
encouraged. The zoning is H-1, Health Care, and the growth policy anticipates
this kind of development In the area. The proximity of this site to health. and
coca e -c al services makes this an acceptable location for this type o
development,
6. Effects on property values: No significant negative impacts on property
values are anticipated. As previously mentioned, the proposal is compatible
with the neighborhood, and the development and land use impacts would be
typical of that anticipated ated for the area.
RECOMMENDATION
Staff recommends that the planning board adopt the staff report KCU-05-- s
findings of fact and recommend to the Kalispell City Council that the conditional use
permit be approved subject to the following conditions:

No additional exterior signage will be added for the proposed
addition. An interior courtyard and gazebo is proposed for the
building presidents. The side yards between the proposed addition,
and property line will be landscaped as shown on the attached site
plan dawn..
3h. .weight, bulk and location of structures.
The height of the proposed addition will match the height o
the existing building (see the building elevations on the attached
d,ai. However, as the site grades recede in the northwest
corner of the site, awalk-out basement level will be exposed at the
extreme northwest corner of the proposed addition.
3. Location ofproposed open space uses.
The proposed addition has been designed to create an internal
courtyard/open space for residents' use so that the courtyard/open
space is self-contained by the proposed addition, eliminating the
need for any fencing.
