Patrick, City Manager SUBJECT Nest View Estates Subdivision re minary Plat One Year Extension - Northeast Comer W Reserve Drive and Stillwater Road MEETING DATE: September 6, 200 BACKGROUND: This is a request by Sans Stirveying, Inc. on behalf of Owl Corporation for a one year extension on the preliminary .flat of West View Estates, The Preliminary plat for this subdivision was approved on May 5, 2003 by the Kalispell City Council subject to conditions for three rears, It does not appear ear this work will be completed by next spnffi , therefore, the developer would like to obtain an early one year extension. This approximately 60 acre parcel -cel has a. zoning designation of -3, Residential, on the 48 acres designated for single family development and RA-- I , low Density Residential Apartment, on the 10 acres that will be developed at some �r�t in the future. This subdivision would lave 127 single-family lots and one 10- ice parcel that would later be developed most likely With duplex, toter, .o se or multi -family dwellings. The subdivision would be developed in several phases with the first phase being developed near the east side of the site along with the access onto West Reserve Dave. The fmal Base would be near the northwest corner of the site and a. secondary access from the subdivision onto Stillwater load would be developed. The subdivision will be utilizing City sever and grater. The Kalispell Subdivision Regulations and Montana. Subdivision and l.a.tt r Act allow the council to grant a. one-year extension in addition to the original three year approval. The preliminary Plat is set to expire on May 5, 2006. The one year extension would grant us approval to May 5, 2007. The applicant has been diligently. working to meet the conditions of preliminary plat approval, however, with the Kalispell Bypass and the new location of the Glacier High School the approach approvals from the Fontana Department of Transportation have taken longer to acquire than was previously anticipated. Afier completing a Traffic Impact Study the SOT is dose to issuing a permit. With the access issues worked out with the NMOT the applicant is beginning the Engineering Designs for the remainder .er o the subdivision infrastructure. That the Findings of Fact contained in Tri-City Planning Office Report #KPP-03-5 are hereby adopted as the Findings of Fact of the City Council. SECTION 11. That the application of Owl Corporation for approval of the rel nin.ar y Plat of West View Estates Subdivision, Kalispell, Flathead County, Montana is hereby approved subject to the following conditions: . Development of the subdivision shall be platted in substantial compliance with the approved preliminary plat which gover s the ideation of lots and roadways wig the subdivision. . That the roadways serving the subdivision shall be constructed in accordance with the adopted Design and Construction Standards for the City of Kalispell for local streets. That a letter be obtained from the Kalispell Public Works Department approving the plans and specifications for water, sewer and drainage facilities for the subdivision. letter from an eng eer licensed in the State of Montana certifying that the improvements have been installed according to the required specifications said be submitted at t.e time of final plat approval along with a letter from the Kalispell Public Works Department stating that the required improvements have been inspected and comply with the City standards. 5. Development of the landscape boulevard with location of street trees shall be placed i accordance with a plan approved by the Kalispell Parks and Recreation director. . A storm water drainaize plan which has been designed by are engineer licensed in the State o Montana shall be prepared which complies with the City's Design and Construction Standards and shall be reviewed and approved by the Kalispell Public Works Department. '. That the developer obtain a letter from. the Montana Department of Tramportao approving the intersection of the new l ter al roadway and west Reserve Drive and certifying that any necessary unprovements have been made. s. obtain a permit from the Flathead County Road Department for the new road access onto Stillwater Road and any needed improvements be made prior to final plat approval having been reviewed and approved by the road department superintendent. . The road within the subdivision shall be named and signed in accordance with the policies o the Kalispell Public Works Department and the Uniform Traffic Control Devices Manual and be subject to review and approval of the Kalispell Fire Department. . The developer shall provide a letter from the U.S. Postal Service approving the plan for mail service. . Street lighting shall be located within the subdivision and shall be shielded so that it does not intrude umecessarily onto adjoining properties. 12. That the parkland dedication requirements snail be one -ninth or I I percent of the area in lots or .:.69 acres. The 2.20 acre as indicated on the plat will meet a portion of that requirement and the rernaining approximately one acre required can be met by M*vesting an equivalent cash value into the park. The cash -in -lieu of parkland values is based on a value of $ l ,o o per acre or other value demonstrated by the developer as the purchase pace per acre. 13. That a road access be provided from Taylor Road connecting Parcel A to the subdivision. . That a minims 20 Moot buffer strip shall be established between West Reserve Drive and the subdivision. . In addition to the Moot buffer strip, a 1 0-foot right-of-way reservation along West Reserve Drive be indicated on the final plat for the met re expansion of that road. 16. All utilities shall be installed underground. 17, That the fire access and suppression system comply with the Unifonn Fire Code and a letter from the Kalispell Fire Department approving the access and number and placement of ire hydrants within the subdivision as well as fire flows and access shall be submitted with the final Plat. The fire access and suppression system sail be installed and approved by the Fire e a=e t prior to final plat approval. 18. That a arum of two-thirds of the necessary infrastructure for this subdivision shall be completed prior to final plat submittal. 19. All areas disturbed during development of the subdivision shall be re -vegetated with a weed- mix immediately after development. 20. That preliminary approval shall be valid for a prod of wee years from the date of approval. SECTION III. Upon proper review and filing of the Final Plat of said subdivision M the office of the Flathead County Clerk and Recorder, said presses shall be a subdivision of the City of Kalispell.
