BACKGROUND: This is the second reading an ordinance In response to a request

conditionally permitted use.
The Kalispell City Council approved the first reading of the ordinance at their regular
meeting October 3, 2005.
RECAUKENDATIO : A motion to approve the second reading of an ordinance
approving the amendment would be in order.
FISCAL EFFECTS: Potential positive impacts.
ALTERNATIVES: As suggested by the city council.

ORDINANCE No, 1554
AN ORDINANCE AMENDING THE KALISPELL ZONING ORDINANCE (ORDINANCE
No, 1460), Y .AMENDING THE -2 GENERAL BUSINESS, AND THE -3,
COMMUNITY SINESS DISTRICTS, TO ALLOW LIGHT ASSEMBLY AS A
CONDITIONALLY PERMITTED USE AND DECLARING AN EFFECTIVE DATE,
WHEREAS, Big Sky Properties, on behalf of ADG, has submitted a written request to amend the
Kalispell Zoning Ordinance, by allowing; Light Assembly in the B--3, Community
Business District, and
WHEREAS, the request was forwarded to the Kalispell City Planning Board and Zoning
Commission by the Kalispell Planning epartr e .t Ater having been evaluated under
2 .1 .o30, Kalispell Zoning Ordinance, and
WHEREAS, the Kalispell City Planning .Board and Zoning Commission recommended that the
text of the Kalispell Zoning ordinance be amended by allowing Light Assembly as a
o dit. orally permitted use in both the B-2, General Business and the B- 3,
Community Business Districts, and
WHEREAS, the City Council bas reviewed the KPD .deport and the transmittal from. the Kalispell
City Planning Board and Zoning Commission and hereby adopts the findings s made i
Report #KZTA-05-6 as the Findings of Fact applicable to this Ordinance.
NOW, THEREFORE., E, BE IT ORDAINED BY THE CITY COUNCIL of THE CITY of
KALISPELL AS FOLLOWS:
SECTION I. The City of Kalispell Zoning; Ordinance., ordinance No. 1460. is hereby
amended by allowing Fight .Assembly as a conditionally permitted use in the
B-21 General Business and the B-3. Community Business Districts.
SECTION 11. All parts and portions of ordinance No. 1460 not amended hereby remain
unchanged.
SECTION 111, This ordinance shall take effect thirty (30) days after its final passage.
PASSED AND APPROVED BY THE CITY COUNCIL AND SIGNED BY THE MAYOR OF THE
