Reading - Flathead Valley Community College Anitial Zoning of 1-1, Pubhc, Hwy 93 and Grandview Drive MEETING DATE: November 21, 2005 BACKGROUND: This is the second reading of an ordinance on a request by the Flathead Valley Community College for annexation and are initial zoning designation of -1, Public, on approximately acres. The property is located on the east side of Hwy 3 and on the north side of Grandview Drive. The college plans to ems.. the expansion of the campus this spn'ng and would like to connect to City utilities. The Kalispell City Council approvcd the first reading of the ordinance at their regular mceting of November 7, 2005. RECOMMENDATION: A motion o to approve the second reading of the ordinance for initial zoning would be in order. FISCAL EFFECTS: None. TERNAT ES: As suggested by the City Council. Manager ORDINANCE N. 11 AN ORDINANCE To AMEND SECTION 27.02,010, OFFICIAL ,BONING MAP, CITY OF KALISI'ELL ZONING ORDINANCE,(ORDINANCE NO. 1 ,BONING CERTAIN REAL PROPERTY DESCRIBED AS A. PORTION OF CERTIFICATE F SURVEY 14935 LOCATED IN SECTION 31, TOWNSHIP 29 NORTH, RANGE 21 WEST, P.M.M., FLATHEAD COUNTY, M NTAI A (PREVIOUSLY ZONED COUNTY SAG-1. , SUBURBAN RESIDE TO CITY -1 (PUBLIC), IN ACCORDANCE WITH THE KALISPELL GROWTH POLICY 2020, AND T PROVIDE AN EFFECTIVE DATE. WHEREAS, Flathead Valley Community College, the owner of the property described above, petitioned the City of Kalispell that the zoning; classification attached to the above described tract of land be zoned p-11, Public, on approximately 65 acres of land, and WHEREAS, the property is located on the east side of Highway 93 and north of Grandview Drive, and WHEREAS, Flathead Valley Community Colle e's petition was the subject of a report compiled by the Kalispell Planning Department, Staff Report A- -14, dated October 4, 2005, in which the Kalispell Planning Department evaluated the petition and recommended that the property as described above be zoned T-1, Public, as requested by the petition, and WHEREAS, after considering all the evidence submitted on the proposal to zone the property as described P-15 public, the City Council finds such initial zoning to be consistent with the Kalispell Growth Policy Zoo and adopts, based upon the criterion set forth in Section - - 0 , M.C.A., and State Etc. v. Section 27.02.0101, of the official Zoning Map of the Kalispell Zoning Ordinance, (ordinance No. 140) is hereby amended by designating the property described above as P-1, Public, on approximately 65 acres of land. SECTION 11. The balance of Section 7.02.010, official Zoning Map, City of Kalispell Zoning ordinance not amended hereby shall remain in full force and effect. SECTION 111. This ordinance shall be effective thirty 3 days from and after the date of its final passage and approval by the Mayor.
