MEETINGDATE: November 21, 2005
BACKGROUND: This is the second reading of an ordinance on a request by
Northwest Investments LP for an initial zoning designation of R- , Two Family
Residential, on approximately 0.23 of an acre. The property is located on the north
sine of Sunnyside Drive just west of the Ashley creed. Bridge. This is essentially a.
housekeeping item in that the property is an abandoned portion. of S nnysi e Drive
that the county deeded to the adjoining property owner. it will be incorporated into
an existing parcel.
The Kalispell City Council approved the first reading of the ordinance at heir regular
meeting of November 7, 2005.
RECOMMENDATION: A motion to approve the second reading of the ordinance for
initial zoning woold be in order.
FISCAL EFFECTS: Positive impacts once fully developed.
ALTERNATIVES: As suggested by the City Council.

KALISPELL ZONING ORDINANCE,(ORDINANCE NO. 1460), BY ZONING CERTAIN REAL
PROPERTY DESCRIBED AS A PART of LOT 4, WILLIS AM ON LOCATED IN SECTION 18,
TOWNSHIP NORTH, RANGE 21 WEST, P.M.M. FLATHEAD COUNTY, MONTANA.
(PREVIOUSLY ZONED COS R- , SUBURBAN RESIDENT) To CITY I - (TWO FAMITLY
RESIDENTIAL), N ACCORDANCE WITH THE KALISPELL GROWTH POLICY 2020, AND To
PROVIDE N EFFECTIVE DATE.
WHEREAS, Northwest Investments, LP, the owners of the property described above, petitioned the City of
Kalispell that the zoning classification attached to the above described tract of land be zoned
R- , Two -Family Residential, on approximately 0.2 acres of land, and
WHEREAS, the property is located on the north side of Snnyside Drive near the intersection of Denver
Avenue, and
WHEREAS, Northwest Investments' petition was the subject of a report compiled by the Kalispell
Planning Department, Staff Report KA-o - 5, dated October 3, 2005, in which the Kalispell
Planning Department evaluated the petition and recommended that the property as described
above be zoned RA Two -Family Residential, as requested by the petition, and
WHEREAS, after considering all the evidence submitted on the proposal to zone the property as described
R- , Two -Family Residential, the City Council finds such initial zoning to be consistent with
the Kalispell Growth policy 2020 and adopts, based upon the criterion set fore in Section W
3-6o , M.C.A.,, and State Etc. v. Board of Countv Commissioners etc} 590 p d 602., the
findings of fact of KPD as set forth in Staff Report No. KA-o ; . .
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL of THE CITY of KALISPELL A
FOLLOWS:
SECTION I. Section .02.010, of the official Zoning trap of the Kalispell Zoning
Ordinance, (ordinance No. o) is hereby amended by designating the
property described above as R-4,Two-Farnily Residential, on approximately
0.2 acres of land.
SECTION U. The balance of Section 27.02.010, official Zoning Map, City of Kalispell
Zoning ordinance rnot amended hereby shall remain in fail force and effect.
SECTION 111. This ordinance shall be effective thirty days from and after the gate of
its final passage and approval by the Thor.
