BACKGROUND: This is the second reading of an ordinance on a request by Randolph
and Linda ' or ;ersox for an initial zoning designation of R- , Two Family Residential,
on approximately 0.5 of an acre. The property is located on the merest side of Seventh
Avenue West, north of Sunnysid.e Drive. A two lot subdivision will be filed subsequent
to the approval of the annexation and request. 'there is an existing hose and garage
that will remain on the lot while the newly created lot will be developed with either a
single family residence or duplex.
The Kalispell City Council approved the first reading of the ordinance at their regular
tneetm'g of November 7, 2005.
RECOMMENDATION: DATION: motion to approve the second reading of the ordinance ance for
initial zoning would be in order.

N ORDINANCE TO AMEND SECTION 27.02.010, OFFICIAL ZONING MAP, CITY OF
KALI SSE L ZONING ORDINANCE, (ORDINANCE NO, 1460), BY ,BONING CERTAIN REAL
PROPERTY DESCRIBED AS LOT 6 OF WESTERN ACRES LOCATED IN SECTION 18,
TOWNSHIP NORTH, RANGE 21 WEST", .M,MR FLATHEAD OUNTY. MON ANA
(PREVIOUSLY ZONED COUNTY R-5 TWO-FAMILY RESIDENTIAL) CITY R-4 (TWO
FAMILY RESIDENTIAL), IN ACCORDANCE WITH THE KALIS. ELL GROWTH POLICY ICY 2 ,
AND TO PROVIDE AN EFFECTIVE DATE.
WHEREAS, Randolph and Linda Torgerson, the owners of the property described above, petitioned the
City of Kalispell that the zoning classification attached to the above described tract of land be
zoned - , Two -Family Residential, on approximately o.57 acres of land, and
WHEREAS, the property is located on the west side of Seventh Avenue West, north of Snnyside Drive,
and
WHEREAS, the orgerson.'s petition was the subject of a report compiled by the Kalispell Planning
Department, Staff Report #CI A-o -1 , deed. October 3, 2005, in which the Kalispell Planning
Departmentevaluated the petition and recommended that the property as described above be
zoned R4, Tv -Family Residential, as requested by the petition, and
W IERF,,AS, after considering all the evidence submitted on the proposal to zone the property as described
R- , Tiro -Family Residential., the City Council finds such initial zoning to be consistent with
the Kalispell Growth Policy 2020 and adopts, based upon the criterion set forth in Section
- , M.C.A,, and State Etc. v. Board of County Commissioners, Etc. 590 P d 602, the
findings of fact of KPD as set forth in Staff Report No. K -- -1. .
NOW THEREFORE, BE IT ORDAINED Y THE CITY COUNCIL of THE CITY of KALISPELL AS
FOLLOWS:
SECTION I. Section 27.02.01 , of the official Zoning Map of the Kalispell Zoning
Ordinance, (ordinance No. 10) is hereby amended by designating the
property described above as R- ,Two -Family Residential, on approximately
0.57 acres of land.
SECTION U. The balance of Section 27.02.010, official Zoning Map, City of Kalispell
Zoning ordinance not amended hereby shall remain in full force and effect.
SECTION 111. This ordinance shall be effective thirty 3 days from and after the date of
its final passage and approval by the Mayor.
