BACKGROUND: This is the second reading of an ordinance on a. request by Montana
Venture Partners for an initial zoning designation of -1, Light Industrial o
approximately 55 acres. The property lies at the northeast corner or Demersville Road
and Rocky Cliff Drive. The property was annexed by the Kalispell City Council at their
regular meeting of June 6, 2005.
The Kalispell City Council approved the first reading of the ordinance at their regular
meeting of November 7, 2005.
RECOMMENDATION: DATION: motion to approve the second reading of the ordinance for
initial zoning would be in order.
FISCAL EFFECTS: Positive impacts once fully developed.

N ORDINANCE TO AMEND SECTION 27.02.010, OFFICIAL ZONING MA , CITY OF
KALISPELL ZONING ORDINANCE,(ORDINANCE NO, 1460), BY ZONING CERTAIN REAL
PROPERTY DESCRIBED ,AS PARCEL A OF CERTIFICATE OF SURVEY 16337 LOCATED IN
SECTION 33, TOWNSHIP 28 NORTH, RANGE 21 WEST, ,M.M. FLATHEAD COUNTY,
M N' AN(PREVIOUSLY ZONED COUNTY 14, LIGHT INDUSTRIALTO CITY 1.1 (LIGHT
INDUS RLAL, IN ACCORDANCE WffH THE KA ISPELL GROWFH POLICY 2020, AND TO
PROVIDE AN EFFECTIVE DATE.
WHEREAS, Montana Venture Partners, the owners of the property described above, petitioned the City of
Kalispell that the zoning classification attached to the above described tract of laud be zoned
I -1, Bight Industrial, on approximately 55 acres of land, and
WHEREAS, the property is located can the northeast corner of Rocky Cliff Drive and Demersile Road,
and
WHEREAS, Montana Venture .partners' petition was the subject of a report compiled by the Tri-City
Planning Office, Staff Deport #KA- -11, dated June 14, 2005, in which the ' ri-City
Planning Office evaluated the petition and recommended that the property as described above
be zoned 14, Bight Industrial as requested by the petition, and
WHEREAS, after considering all the evidence submitted on the proposal to zone the property as described
I-, Bight Industrial, the City Council finds such initial zoning to be consistent with the
Kalispell Growth Policy 2020 and adopts, based upon the criterion set forth in. Section 7 - -
6 . , M.C.A., and State, Etc. v. Board of County Commissioners Etc. 590 P2d 602,1 the
findings of fact of TCPO as set forth in Staff Report No. KA-0 -1 I.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KA ISPELL A
FOLLOWS:
SECTION 1. Section 27.02.010, of the Official Zoning Map of the Kalispell .honing
Ordinance, (Ordinance No. is hereby amended by designating the
property described above as I-, Bight .Industrial, on approximately 5 5 acres
f land.
SECTION 11. The balance of Section 27.02.010, Official Zoning Map, City of Kalispell
Zoning Ordinance not amended bcreby shall remain in full force and effect.
SECTION 111, This Ordinance shall be effective thirty 3 days from and after the date of
its final passage and approval by the Mayor.
