Patrick, City Manager TO 406,758,7708 Fax 406.759.7771 charball@kalispell.com Resolution 5009 — Resolution of Intent to Increase Building Fees Pursuant to 1997 UBC Fee Schedule and Call for Public Hearing Monday, May 2, 2005 — Regular City Council Meeting BACKGROUND: The City Council is considering the question of amending the City's building fees to the 1997 UBC Fee Schedule as Whitefish and Columbia Falls have done. At the last work session, the Building and Public Works departments discussed their work force and material needs to meet the growing demands on them by new construction in the city. The specific purpose of this resolution is to solicit public comment on the proposed increase. RECOMMENDATION: That Council pass Resolution 5009 and call for a public hearing on the issue of amending the building fees to 1997 UBC Fee Schedule. FISCAL EFFECTS: None at this time. Patrick, City Manager Y1�11l�Fll��#�Ytll� A RESOLUTION OF INTENT TO ADOPT THE 1997 UNIFORM BUILDING CODE FEE SCHEDULE AND CALLING FOR A PUBLIC HEARING. WHEREAS, the City is reorganizing its planning, zoning and building departments to more efficiently and effectively respond to the increasing workload the City faces from the unprecedented growth it is currently experiencing and that it expects in the future; and WHEREAS, in order to meet the demands placed on there by the growing construction levels, it has been recommended by these City departments that the City fund the full time positions of an additional building inspector, a code enforcement officer and a construction engineer; and WHEREAS, the City utilizes the 1988 Uniform Building Code fee schedule and values residential construction at $61.50 per square foot of living space. The revenue raised by this fee schedule is inadequate to fund the current needs of above -named departments; and WHEREAS, the adoption of the 1997 Uniform Building Code fee schedule and maintaining the current valuation will provide adequate revenue to meet the demands placed on the City by construction growth. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION I. A public hearing is hereby called and shall be held on Monday, May 16, 2005 at 7.00 p.m. in the Council chambers on the proposed adoption of the 1997 Uniform Building Code Fee Schedule. SECTION II. Notice of the public hearing shall be published in the Daily Inter Lake on May 4, 2005 and May 11, 2005. Kennedy Mayor ATTEST: Theresa White City Clerk NOTICE OF PUBLIC HEARING ON THE PROPOSED ADOPTION OF THE 1997 UNIFORM BUILDING CODE FEE SCHEDULE NOTICE IS HEREBY GIVEN that the City Council (the "Council") of the City of Kalispell, Montana (the "City") will hold a public hearing on the proposed adoption of the 1997 Uniform Building Code Fee Schedule on May 16, 2005, at 7:00 p.m., at the Council Chambers in the Kalispell City Hall, Kalispell, Montana. It is proposed that the City will adopt the 1997 Uniform Building Code Fee Schedule and amend Ordinances 1291, 1292, 1301 and 1419. NOTICE is further given that the proposed fee schedule adoption will increase the permit fees and plan review fees of residential, commercial and multifamily units by approximately 55% from current rates. There is no proposal to raise the valuations currently used. NOTICE is further given that the City Clerk will receive expressions in writing of approval or disapproval at City Hall, 312 Ist Avenue East; or by mail at PO Box 1997, Kalispell, MT 59903; or by email at cityclerk@,kalispell.com. The City Council, at the time of the Public hearing on the 16th day of May, 2005, shall consider all written communication and pubic comment pursuant to this Notice. Following the Public Hearing, the Council may duly and regularly adopt a Resolution adopting the 1997 Uniform Building Code Fee Schedule.
