SUBJECT Central Bible Church - Conditional Use Permit

BACKGROUND: This is a request by Central Bible Church for a conditional use
permit to allow the construction of an approximately 720 square foot storage area in
conjunction with an existing church in the R-4, Two Family Residential, zoning
district The storage building would be approximately 12 feet by 60 feet and attached
to the south side of the existing church gymnasium building. The building would be
single story in height (approximately 17 feet) and have a finished floor at the same
level as the gymnasium it would abut. The church intends to use the storage building
to store tables, chairs, a portable stage, sound equipment and other accessory items
associated with gym use. These items are now stored around the edges of the gym,
are restricting gym use and pose a safety hazard for gym users.
The Kalispell City Planning Board met on April 12, 2005 and held a public hearing to
consider the request. During the public hearing Jim Nordtome, representing the
church spoke in favor of the addition and noted the addition would be of the same
color and materials as the existing church building. He also noted they really need
the storage space so they can remove some of the tables and chairs from the gym.
There was no one else who spoke at the public hearing.
The board discussed the project briefly noting that the new addition will match the
existing construction and that there would be little or no impacts to the neighborhood
as a result of this expansion. A motion was made and passed on a unanimous vote to
recommend to the Kalispell City Council that the conditional use permit be approved
subject to conditions as listed in Exhibit A attached to the letter of transmittal.
RECOMMENDATION: A motion to approve the conditional use permit subject to
conditions would be in order.
FISCAL EFFECTS: Minor positive impacts once fully developed.
ALTERNATIVES: As suggested by the city council.

The applicant has applied to the City of Kalispell for a conditional use permit to allow the

The Kalispell City Planning Board and Zoning Commission., after due and proper notice, on
April 12, 2005, held a public hearing on the application, took public comment and recommended that
the application be approved subject to five conditions.
After reviewing the application, the record, the TCPO report, and after duly considering the
matter, the City Council of the City of Kalispell, pursuant to the Kalispell Zoning Ordinance, hereby
adopts Tri-City Planning Office Conditional Use Report #KCU-05-4 as the Council's findings of
fact, and issues and grants to the above -described real property a conditional use permit to construct
a storage building in a Two Family Residential, R-4, zoning district subject to the following
conditions:
1. The proposal will be developed in substantial conformance with the approved site plan and
other application. materials. That the conditions associated with this permit shall be met prior to
the use of the buildings.
2. The applicant comply with all building and fire codes prior to occupancy of the building.
The applicants shall utilize construction materials, siding and a color scheme for the addition
that matches the associated gymnasium.
4. The applicant shall be required to eliminate the common lot line between lots 8 and 9 so as to
eliminate any concern with development straddling an existing lot line.
5. The conditional use permit is valid for a period of 18 months from the date of authorization
after which time if the commencement of activities has not occurred the permit shall be void.
A continuous, good faith effort to design the building, obtain financing and other activities shall
be considered a commencement.

Narda Wilson of the Tri-City Planning Office, presented staff report ##KCU-05-4
evaluating the proposal and recommended approval of the storage building subject to
conditions in the staff report. She explained that although the addition is modest in
relation to the rest of the church which essentially occupies the entire half block, the
storage building requires a conditional use permit since the existing church does not
have one on file. This is because the church was not required to obtain a conditional
use permit at the time it was constructed approximately 40 years ago.
At the public hearing, Jim Nordtome, representing the church spoke in favor of the
addition and noted the addition would be of the same color and materials as the
existing church building. He also noted they really need the storage space so they can
remove some of the tables and chairs from the gym. There was no one else who spoke
at the public hearing.
The board discussed the project briefly noting that the new addition will match the

The Kalispell City Planning Board is recommending to the Kalispell City Council that

B. Size and Location: This parcel contains approximately one acre of land and
occupies the entire east half of the city block bounded by 9th Street on the
north, First Avenue East on the east, Tenth Street on the south and a
developed alley along the west. The property address is 902 First Avenue East
and can be described as Lots 1 through 12, Block 125 of Kalispell Original in
Sections 17 and 18, Township 28 North, Range 21 West, P.M.M, Flathead
County, Montana.
C. Summary of Request: This is a request for a conditional use permit to allow
the construction of a storage building measuring approximately 12 feet by 60
feet to be attached to the south side of the existing church gymnasium
building. The building would be wood frame construction, contain
approximately 720 square feet of enclosed space and have a 4 to 12 pitch shed
roof. The building would be single story in height (approximately 17 feet) and
have a finished floor the same level as the gymnasium it would abut. The
church would like to construct the 720 square foot addition along the south
side of the gymnasium wall. The storage building would be intended to be
accessed by two interior doors through the gymnasium.. No outside doors or
windows would be provided. The church intends to use the storage building to
store tables, chairs, a portable stage, sound equipment and other accessory
items associated with -ym use. These items are now stored around the edges
of the gyre, are restricting gym use and pose a safety hazard as well for gym
users.

complex with the traditional church on the north side of the site, an attached
educational wing in the middle connecting to a full gymnasium on the south
side of the property. The remaining three lots (southerly 75 feet) contains the
Hope House, a traditional Single Family House serving as a group home. The
property is zoned R-4 Two Family Residential which lists churches and
accessory uses to a church as a conditionally permitted use. Kalispell Zoning
Ordinance (27.34.080) provides general criteria for the issuance of a CUP of
this nature.
E. Surrounding Zoning and Land Uses Zoning: This area contains a mixture of
zoning classifications as it serves as a transitional area from uses along US 93
South (South Main.) to the west (R-5) and the County Courthouse (P-1) to the
north and stable residential development (R-4) to the east across First.
North: Flathead County Courthouse and Courthouse Park, P-1 Zoning
East: Single farrzily residential, R-4 Zoning
South: Single family residential, R-4 Zoning
West: US Highway 93, Professional Offices, R-5 Zoning
F. Relation to the Growth Policy: The Kalispell. Growth Policy 2020 recognizes
this area as an area suitable for retail offices, services, mixed use and
residential. This classification extends from South Main to First Avenue East
and covers the entire church site. Churches are typically recognized as
compatible uses in commercial, mixed use and residential neighborhoods.
Central Bible Church is a stable, significant historical use in the neighborhood
and serves as a buffer from the more intensive uses to the west along South
Main and the stable residential neighborhood to the east.

The application is reviewed in accordance with the conditional use review criteria in
the Kalispell Zoning Ordinance.
1. Site Suitability:
a. Adequate Useable Space: The proposed addition is minor in nature. It
will maintain a 20 foot separation between it and the adjacent residence
to the south (owned by the Church). The addition will be set back 35
feet from the front yard (First Ave. East). There is adequate room to
locate this addition.
b. Adequate Access: The addition will not require extra parking nor will it
affect current parking or access can the site. It will serve as indoor
storage for church owned gym equipment.
C. Environmental Constraints: The site is flat, fully developed to urban
standards, is not in a floodplain and is not impacted by surface water or
wetlands. No other significant environmental constraints are apparent
on the property.
2. Appropriateness of design:
a. Park n and site circulation: Because the proposed addition is only for
storage and because of its limited size, additional parking requirements
are not triggered with this proposal. There will be no exterior entrances
thus the existing pedestrian and vehicular circulation will not be
affected.
b. Open Space: No specific open space requirements exist in the zoning
regulations for a development of this type. The site is developed within
the 45% lot coverage standard of the zone. The church provides
recreational space on site through the existing gymnasium. Useable
open space is not unduly impacted.
C. Fencing/Screening/Landscaping: The property is presently landscaped
with mature landscaping along the building and perimeter of property.
The addition will be an enclosed building which will be attached to the
south side of the existing gymnasium. The church owns the residence
to the immediate south. The addition will be set back 35 feet .from First
Avenue East. The addition will be approximately 17 feet high at the
highest point of the shed roof against the south g manasiurn wall. The
roof will have a 4 to 12 pitch and be tucked underneath the gymnasium
roof which extends approximately 20 feet high. No other fencing or
screening appear needed or warranted.
d. Suns: No additional signage is proposed with this application.

3. Availability of Public Services/Facilities:
a. Schools: This site is within School District #5. No impact is associated
with the addition of a storage room.
b. Parks and Recreation: There are no anticipated impacts to parks. The
proposal involves a storage building, which will serve as an accessory
use to the gymnasium. Construction of the storage building will improve
the use of the gymnasium by providing storage for equipment cluttering
the gym. This in turn will improve recreational activities for the church.
C. Police: Police protection will be provided by the Kalispell Police
Department. No unusual impacts or needs are anticipated from the
proposed addition.
d. Fire Protection: Fire protection will be provided by the Kalispell Fire
Department. No unusual impacts are anticipated from the proposed
use. The Fire Marshal will have an opportunity to review the building
plans prior to construction to ascertain if any additional building or fire
code issues need to be addressed with the proposed construction due to
the nature of materials stored.
e. Water and sewer: Water and sewer are available to the existing church.
This project will have no impacts.
Solid Waste: Solid waste pick-up will be provided by the City. Existing
enclosures will be utilized in accordance with City requirements. This
project will have no impacts to current services.
g. Streets: No additional traffic or impact to traffic will be generated by this
use as it is strictly storage space for an existing gymnasium.
4. Neighborhood Impacts: The only known impact will be visual. The greatest
impact will be to the residence immediately to the south. Approximately 20
feet of free space will separate the exiting house from the proposed storage
building. However, the church owns this house. Views will be slightly altered
from the street; however, the building will be set back 35 feet. The church
should attempt to match design and construction materials to allow the storage
addition to blend in with the existing gymnasium. Lawn presently abuts the
entire gym and will continue to abut the addition. No other impacts have been
identified or are anticipated including additional outdoor lighting impacts,
smoke, fumes, gas, odors, or inappropriate hours of operation. A notice of
public hearing was mailed to property owners within 150 feet of the site
approximately 15 days prior to the hearing. As of this writing, staff has
received no comments from neighbors on the proposal.
S. Consideration of historical use patterns and recent changes: The church
constitutes a significant historical structure within the neighborhood. Addition
of the storage building will be minor in character to the building. If the

applicants utilize the same siding and colors, the addition will actually serve to

6. Effects on property values: No significant negative impacts on property
values are anticipated. As previously mentioned, the proposal is compatible
with the neighborhood, and the development and land use impacts would be
typical of that anticipated for the area.
RECOMMENDATION
Staff recommends that the planning board adopt the staff report #KCU-05-4 as
findings of fact and recommend to the Kalispell City Council that the conditional use
permit be approved subject to the following conditions:
1. The proposal will be developed in substantial conformance with the approved
site plan and other application materials. That the conditions associated with
