SUBJECT: Motion to Appoint Columbia Falls City Prosecutor
Dean Chisholm as Special City Prosecutor
MEETING DATE: March 7, 2005
BACKGROUND: This is a request by the Office of the City Attorney
to appoint Columbia Falls City Prosecutor Dean Chisholm, as Special
City Prosecutor for Kalispell. This special appointment may be made
by Motion and approval of the Council.
From time -to -time, conflicts arise with prosecution of matters
by the Office of the City Attorney. A recent case was presented
for consideration that creates a conflict between our office's role
as prosecutor for criminal offenses occurring in the City and our
role as legal advisor to city departments on civil matters. The
current appointment is for a single case. Mr. Chisholm. is an
excellent and experienced attorney who is willing to assist our
office in this matter. Our office may likewise be called upon to
assist with conflicts in other jurisdictions.
RECOMMENDATION: The City Attorney's Office appreciates the
cooperation shown by Mr. Chisholm. The Office of the City Attorney
strongly recommends approval of this request and Motion.
FISCAL EFFECTS: No adverse fiscal effects are anticipated.
