Marquardt Surveying on behalf of their clients ACG - Kalispell Investors, LLC for a one lot commercial subdivision located on the north side of Hwy 2 West and west of North Meridian Road. The property is zoned B-3, Community Business, and contains approximately 0.86 of an acre. This parcel is located in the Gateway West parking lot directly east of the main entrance off of Hwy 2 West. The Kalispell City Council approved this subdivision subject to conditions on November 3, 2003. All of the conditions have been met or are otherwise adequately addressed. No parkland dedication is required because this is a commercial subdivision. The attached transmittal letter lists conditions of preliminary plat approval for this subdivision and a discussion of how they have been met or otherwise addressed. RECOMMENDATION: A motion to approve the final plat would be in order. FISCAL EFFECTS: Minor positive impacts once developed. ALTERNATIVES: As suggested by the city council. COMPLIANCE WITH CONDITIONS OF APPROVAL Condition 1. That the development of the site will be in substantial conformance with the approved preliminary plat which shall govern the general location of the lots, easements and roadways. (Kalispell Sub. Regs. Appendix C - Final Plat I(A) Contents of Final Plat.) • This condition has been met. The lot being platted complies with the preliminary lots which were approved. Condition 2. The applicants shall apply to MDT for review and updating of the approach permit from the proposed subdivision onto US Hwy 2. (Per request of Steve Herzog, Maintenance Supervisor, MDT Kalispell Office). • This condition has been met. A letter from the MDOT approving the approach for this access has been submitted with the final plat. Providing Community Planning Assistance To: • City of Kalispell • City of Columbia Falls • City of Whitefish - Final Plat for Gateway West Unit No. 2 June 1, 2005 Page 2 Condition 3. A storm, water drainage plan which has been designed by an engineer licensed in the State of Montana shall be prepared which complies with the City's Design and Construction Standards and said plan shall be reviewed and approved by the Kalispell Public Works Department. (Kalispell Sub. Regs, Section 3.12 A). • This condition has been adequately addressed. A letter from the Kalispell Public Works Department addressing the storm water management for the site has been submitted with the final plat. Condition 4. That a letter be obtained from the Kalispell Public Works Department approving the plans and specifications for water, sewer and drainage facilities for the subdivision. (Kalispell Sub. Regs. Section 3.12 - 3.15). • This condition has been adequately addressed. A letter from the Kalispell Public Works Department addressing the public infrastructure component of this subdivision has been submitted with the final plat. Condition 5. The fire access and suppression system shall comply with the Uniform Fire Code and a letter from the Kalispell Fire Department approving the access, placement of fire hydrants and fire flows within the subdivision shall be submitted with the final plat. The fire access and suppression system shall be installed and approved by the Fire Department prior to final plat approval. (Uniform Fire Code). • This condition has been met. A letter from the Kalispell Fire Department conditionally approving the subdivision has been submitted with the final plat. Condition 6. All new utilities shall be installed underground. (Kalispell Sub. Regs. Section 3.17A). • This condition has been met. No new utilities were required as a result of this one lot subdivision. Condition. 7. The applicants shall apply for and receive a Letter of Map Revision prior to filing of final plat for the purpose of removing a suitable buildable area for each proposed lot from the 100-year floodplain as shown on the Kalispell Flood Insurance Rate Map. Failure to acquire a suitable building site outside of the 100- year floodplain shall constitute denial of the particular lot. (Section 3.5, Kalispell Subdivision Regulations, Kalispell Flood Plain Development Program). • This condition has been met. The developers have obtained a conditional letter of map revision (CLOMR) from the Federal Emergency Management Agency (FEMA) based on previous fill work done on the site. An area for the new building that is above the base flood elevation has been reviewed and approved by FEMA. Final Plat for Gateway West Unit No. 2 June 1, 2005 Page 3 Condition S. The applicants shall secure a floodplain development permit from the City of Kalispell to fill the existing detention pond and re -locate the pond elsewhere within the 100-year floodplain. (Kalispell Flood Plain Development Program). • This condition does not apply to the lot being created with this final plat. Conditioaira, 9. The applicant shall provide evidence of contacting the Flathead Conservation District and Fish, Wildlife and Parks concerning compliance with any applicable regulatory programs (i.e. - 124 Permit) relating to any work in or near West Spring Creek. • This condition does not apply to the lot being created since it is not near the Spring Creek drainage to the west. Condition 10. That preliminary approval shall be valid for a period of three years from the date of approval. (Kalispell Sub. Regs. Section 2.04 (E (7)). • This condition has been met. The final plat for the subdivision was approved prior to the expiration of the preliminary plat. COMPLIANCE WITH APPROVED PRELIMINARY PLAT The final plat is in substantial compliance with the preliminary plat which was reviewed and approved by the Kalispell City Council on November 3, 2003. COMPLIANCE WITH THE SUBDIVISION REGULATIONS: This subdivision plat has been found to be in compliance with the State and City Subdivision Regulations. COMPLIANCE WITH THE ZONING REGULATIONS This subdivision can be found to be in compliance with the Kalispell Zoning Ordinance and the B-3, Community Business, zoning designation for the property which governs the dimensional requirements of the lots within the subdivision as well as the uses. RECOMMENDATION: It can be found that the conditions of preliminary plat approval have been met or otherwise adequately addressed. The staff would recommend that the Kalispell City Council approve the final plat for Gateway West Subdivision Unit No. 2. Our department has completed a review of this project and has approved the subdivision contingent upon the following conditions: 1. Water mains designed to provide minimum fire flows shall be installed per City specifications at approved locations. Minimum fire flows shall be in accordance with Uniform Fire Code (1997) Appendix III -A. In reviewing the current water main infrastructure in this area, it appears that there is a 12" looped water main in the area that is in close proximity to Lots #1 and #2. Fire flow testing in the general area (Glenwood Drive) in June of 2003 indicates an estimated fire flow of 4835 gpm available at 20 psi. This fire flow should prove to be sufficient for development in this subdivision. 2. Fire hydrants shall be provided per City specifications at locations approved by this department, prior to combustible construction. Although there are fire hydrants currently installed in this area, they may not be in locations that provide adequate access. Fire hydrant installations for future projects would need to meet the minimum travel distance of 200'. Additional fire hydrants may be required, relative to the fire flow requirements. 3. Fire Department access shall be provided in accordance with Uniform Fire Code (1997) Article 9. It appears that adequate access opportunity is provided for this subdivision. It should be noted that final fire department access approval will be needed during the construction phase of future projects. The access requirements are standard UFC conditions; 20' width, 1XV height, and turnarounds provided for access roadways in excess of 150 'Assisting our community in reducing, preventing, and mitigating emergencies. As we discussed today, it appears that adequate infrastructure is in place to support the development of these parcels, with specific construction detail being address in the permit review process.
