Planning Board Minutes - May 10, 2005KALISPELL CITY PLANNING BOARD & ZONING COMMISSION MINUTES OF REGULAR MEETING MAY 10, 2005 CALL TO ORDER AND ROLL The regular meeting of the Kalispell City Planning Board and CALL Zoning Commission was called to order at 7:00 p.m. Board members present were: George Taylor, Timothy Norton, Rick Hull and Bryan Schutt. Kari Gabriel and John Hinchey were absent. Jean Johnson's replacement will be named at the next City Council meeting. Narda Wilson represented the Tri- ` City Planning Office. There were approximately 3 people in the audience. APPROVAL OF MINUTES Norton moved and Taylor seconded to approve the minutes of the Kalispell City Planning Board and Zoning Commission regular meeting of April 12, 2005 and the special meeting of April 19, 2005. i The notion passed unanimously on a roll call vote. HEAR THE PUBLIC No one wished to speak. MOSBY INITIAL ZONING A request by David E. and Beverly K. Mosby for an initial UPON ANNEXATION = zoning designation of R-3, Urban Single Family Residential, REQUEST on approximately 0.45 of an acre upon annexation to the [ City of Kalispell. STAFF REPORT Narda Wilson, with the Tri-City Planning Office, gave a KA-05-6 i presentation of Staff Report KA-05-6, a request by David E. and Beverly K. Mosby for an initial zoning designation of R-3, Urban Single Family Residential, on approximately 0.45 of an acre upon annexation to the City of Kalispell. Wilson stated this is an annexation of property located on the south side of 14th Street East and 6th Avenue East, E showed a map of the Certificate of Survey, and explained that the northern portion of the site is already in the City. She said this is 1/2 of an acre, with a small house on the northeastern portion of the site. She said the applicants want to create a flag lot in the area that is proposed for annexation, and connect it to city sewer; the majority of the lot is already zoned City R-3, so the request is consistent with the surrounding zoning. She stated the applicant is not j 1 able to be present this evening. Wilson finished by stating that staff is recommending the Planning Board adopt the findings of fact and recommend to j the City Council that the initial zoning of this property be R- 3 i 3 3, Urban Single Family Residential. PUBLIC HEARING The public hearing was opened to those who wished to speak on the issue. APPLICANT/AGENCIES PUBLIC COMMENT No one wished to speak and the public hearing was closed. MOTION Norton moved and Taylor seconded to adopt Staff Report KA- 05-6 as findings of fact and, based on these findings, recommend to the Kalispell City Council that the initial zoning on approximately 0.45 of an acre be R-3, Urban. Single Family Residential, upon annexation to the City of Kalispell. BOARD DISCUSSION There was no discussion. ROLL CALL The motion passed unanimously on a roll call vote. SILVERS CONDITIONAL A request by Andy Silvers for a conditional use permit to USE PERMIT REQUEST allow the conversion of four single family lots to four two unit townhouse lots, or eight sublots, in the Cottonwood Park Subdivision. COTTONWOOD PARK A request to amend the Preliminary Plat of Cottonwood Park AMENDED PRELIMINARY Subdivision to allow the conversion of four single family lots PLAT REQUEST to four townhouse lots, creating a 39 lot residential j subdivision on approximately 10 acres. E i STAFF REPORTS KCU-05-5 Narda Wilson, with the Tri-City Planning Office, gave a AND KPP-05-6 presentation of Staff Reports KCU-05-5, a request by Andy Silvers for a conditional use permit to allow the conversion of four single family lots to four two unit townhouse lots, or [ eight sublots, in the Cottonwood Park Subdivision, and KPP- 05-6, a request to amend the Preliminary Plat of Cottonwood Park Subdivision to create a 39 lot residential subdivision. Wilson said this subdivision came before the Planning Board and City Council very recently; this is a modification being made because of an oversight on the preliminary plat She said there are two requests being proposed, one for an amended preliminary plat, and one for a CUP. She said the property is located at the northwest corner of Three Mile Drive and Stillwater Road and is 10 acres in size. Wilson [ stated it was annexed as R-3, Urban Single Family Residential, which allows the creation of townhouse units, subject to a CUP and certain criteria; this request meets the criteria, because the sublots for the townhouse lots do not exceed the underlying zoning of one dwelling per 7000 Kalispell City Planning Board Minutes of the meeting of May 10, 2005 Page 2 of 5 square feet in the R-3 zone. She said the amended preliminary plat converts four single family lots along Stillwater Road to townhouse lots, which complies with the I density allowance under the R-3; the R-3 zone would allow up to 47 lots, and this will be a total of 39 lots by adding these four townhouse lots. Wilson said that this is consistent i with what is in the area; Empire Estates to the east and i Bowser Creek to the south both have townhouses, and Blue Heron recently amended their plat to add some townhouses. She said this is a good mix and a direct response to market conditions. Wilson explained that some modifications were made to the location of Lots 1 and 6 to allow a 40x40 building pad to be moved out of the flood plain, and that Conditions 5 and 7 needed to be deleted because they were addressed when the plat was modified. She said the conditions are the same for the CUP and the preliminary plat. Wilson finished by stating that staff recommends the adoption of Staff Report KCU-05-5 as findings of fact and recommend to the City Council that the conditional use permit be granted, subject to the listed conditions, and also recommends adoption of KPP-05-6 and approval of the amended preliminary plat. I QUESTIONS BY THE Taylor asked what the thinking was in the sizing of the lots; BOARD four of the lots are narrower than the rest of them. Wilson deferred to the applicant. PUBLIC HEARING The public hearing was opened to those who wished to speak on the issue. APPLICANTS/AGENCIES Jim Burton, Jackola Engineering, stated they changed the lots on the west side and eliminated Lot 7, so there are 39 lots now. He said there is a 60 feet minimum lot width in the [ zone, but the useable area is the same with all of the townhouse lots because of the 20 foot reserve for the 3 bikepath - it was added to the easternmost lots. Schutt asked why they did not bring this forward a month ago when the project was approved. Burton said there was a miscommunication and the original ! 3 plat stated that they were reserved for townhouses. PUBLIC COMMENT No one wished to speak and the public hearing was closed. BOARD DISCUSSION Hull stated that this looks good because the townhouses are along the road. Schutt said that economics are driving the townhouses and asked what the City gets back from them. Wilson asked what makes single family living better than townhouse living, and the City is getting a community and a diversity of housing options on the market. Schutt stated the City should be getting something out of it besides density. Wilson said that density is good because it decreases the costs of services; lower density lots do not pay their way, and i higher density lots bring equity and tax revenue. She said, f however, that would not be a reason, to approve or disapprove a subdivision and that planning must meet all the needs within the community and provide a diversity of housing options. Schutt asked if we should consider removing townhouses from the CUP process and just let the developer make the changes. Wilson said we still need to keep the same process, because sometimes there are neighbors involved who expect their subdivisions to look the same as when they bought their houses and they need to be able to have input into the process. MOTION Norton moved and Taylor seconded to adopt Staff Report KPP-05-6 as findings of fact and, based on these findings, recommend to the Kalispell City Council that the preliminary plat for Cottonwood Park Subdivision be amended subject to the listed conditions. OLD BUSINESS Wilson said that there are a number of applications that have come in for the June 14 mectin . NEW BUSINESS It was decided to hold a work session on May 24 to discuss the Growth Polic ,Two Rivers and various other to ics. Hull asked for a few items to be added to future work sessions -- an overall plan for Meridian Road, directing growth to the south of town, and moving garages to the rear of hawses and using alleys. ADJOURNMENT The meeting was adjourned at approximately 8.10 p.m. The next meeting of the Kalispell City Planning Board and Zoning Commission will be held on Tuesday, June 14, 2005.
