SUBJECT: City/State Storm Drain Agreement for North Meridian Road Project.

BACKGROUND: Construction of the North Meridian .Road :Project is moving steadily forward. This
project includes storm drainage facilities the City will maintain upon completion so a storm drain
agreement is needed. This agreement also includes details of cost sharing (expressed as a percentage) for
facilities installed by the state but designed to accommodate additional flow requested by the city. The
City share of these costs was calculated last year to be 30%, or $310,000.00, With the current aggressive
construction climate we expect actual bid prices in June 2005 to exceed this amount. However, the
Westside TIT budget includes approximately $350,000 designated for this work. If costs exceed the funds
available, additional funds can be allocated from the Storm Drain assessment fund where portions of work
included in this project were originally anticipated to be installed by the City. Inclusion of these facilities
in this project has allowed for substantial cost savings to the City. Actual construction of storm drainage
facilities is anticipated to occur in CY 2006.
Public Works has reviewed the agreement and recommends it for your approval.

A RESOLUTION AUTHORIZING THE MAYOR OF KALISPELL TO EXECUTE THE
STORM DRAINAGE AGREEMENT OF FEDERAL AID PROTECT NOS. STPU 6701(7)
AND STPU 6701(8) WITH THE STATE OF MONTANA, ACTING BY AND THROUGH
THE DEPARTMENT OF TRANSPORTATION.
WHEREAS, the State of Montana proposes to reconstruct a certain highway in and through the
City, the construction being known as Federal Aid Project Nos. STPU 6701(7)
and STPU 6701(9), North Meridian Road; and
WHEREAS, the construction will be over and upon North Meridian Road from its intersection
with Idaho Street (US 2) through to the intersection with US 93; and
WHEREAS, the project will include a storm drainage system to collect, convey and discharge
surface runoff from city streets and adjacent properties as well as from the
proposed urban street project; and
WHEREAS, the City and State recognize the need for a stone drain system and are willing to
share in the costs of the proposed storm drain system in a mutually acceptable
sharing of the total costs in accordance with the final plans; and
WHEREAS, the State of Montana desires to receive Federal funds for said construction; and
WHEREAS, the Federal Highway Administration of the U.S. Department of Transportation
will not participate in the construction until and unless the City agrees to certain
conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL AS FOLLOWS:
SECTION I. It is hereby resolved by the City Council of the City of Kalispell
that the Storm Drain Agreement of Federal Aid Project No. STPU
670 ] (7) and STPU 6701(8) with the State of Montana, acting by
and through the Department of Transportation, is adopted by this
Council; and the Mayor of Kalispell is hereby empowered and
authorized to execute said Agreement.

This Agreement is entered into by and between the Montana Department of Transportation,
"State", and the City of Kalispell, "City"
WHEREAS, the State proposes to construct an urban street project in two phases; Phase 1 is
identified as Federal Aid Urban System, STPU 6701(7), North Meridian Road -Kalispell
beginning at approximately the intersection of Idaho Street (U.S. Highway 2) and Meridian Road
and extending approximately 1.4 kilometers north to the intersection of Three Mile Drive, and
Phase 2 identified as Federal Aid Urban System., STPU 6701(8), North Meridian Road -Kalispell
beginning at the intersection of Three Mile Drive and Meridian Road and extending
approximately 0.6 kilometers to the intersection of U.S. Highway 93 and Meridian Road; and
WHEREAS, the project will include a storm drainage system to collect, convey and discharge
surface runoff from city streets and adjacent properties as well as from the proposed urban street
project (see attached Exhibit B); and
WHEREAS, the proposed urban street project is located within the City; and
WHEREAS, the City and State recognize the need for a storm drain system and are willing to
share in the costs of the proposed storm drain system in a mutually acceptable sharing of the total
costs in accordance with the final plans; and
WHEREAS, the North Meridian Storm Drain Collector, hereinafter called the Storm Drain
System, starts at approximately the intersection of North Meridian Road and Parkway Drive,
thence south along North Meridian Road for approximately 1,700 meters to the intersection of
Idaho Street (U.S. Highway 2), at which point it ties into the existing 1500mmx750mm CSPA
storm drain.
WHEREAS, the City and the State want the construction done; and
WHEREAS, the City and State agree that it is better to construct the Storm Drain System project
as part of the North Meridian Road — Kalispell roadway reconstruction project; and
WHEREAS, the engineer estimate of the Storm Drain System described herein for participation
based on design, plans and engineering cost estimates as of January 2005, including 8% for
mobilization, 5% for contingencies, 15% for construction engineering, and 8% for traffic control,
totals a 70% State; 30% City funding split for Phase 1 and a 100% State; 0%v City funding split
for Phase 2; and

WHEREAS, the state share of the Storm Drain System which is to be allocated to the proposed
urban street project will be financed by federal aid Urban and state matching funds, and
WHEREAS, it is agreed that all costs associated with the Storm Drain System in excess of those
federal aid Urban and State Matching Funds allocated will be financed by the City, and
WHEREAS, the State wants to receive federal funds for the construction of the proposed federal
aid Urban system project, and
WHEREAS, the Federal Highway Administration of the U.S. Department of Transportation will
not participate in the construction of the highway, streets and storm drain system unless the City
and the State agree to equitable financial participation, and
WHEREAS, it is the policy of the state for federal aid funds to be used to finance only an
equitable share of a storm drain system serving no more than the federal aid project, and
WHEREAS, this document must be executed and filed with the State before the work
contemplated can be awarded to contract, and
NOW, THEREFORE, in consideration of the covenants herein contained, the parties agree that:
The State will let a construction contract using federal and city funds and will provide all
services necessary for complete construction of the project including but not limited to
surveying, engineering, mobilization, traffic control, material supply, inspection of work
and progress, and other work necessary to complete the construction project in
accordance with plans and specification.
2. The State will provide the City a set of as -built plans upon completion of the Storm Drain
System.
3. The award of the construction contract will be based upon the lowest responsive bid
submitted by a responsible bidder for the entire project, including the Storm Drain
System., as set forth in the final plans.
4. The State shall pay the total actual Storm Drain System construction costs with federal
aid Urban funds associated with flows from the project site only (see attached Exhibit A;
Material Quantities). The engineer estimate of the Storm Drain System associated with
flows from the project site only based on design, plans and cost estimates as of January
2005, including 8% for mobilization, 5% for contingencies, 15% for construction
engineering, and 8% for traffic control, totals a 70% State; 30% City funding split for
Phase l and a 100% State; 0% City funding split for Phase 2; and
5. The City shall pay all remaining costs of the Storm Drain System in excess of those
federal aid funds stated above.

b. The State shall notify the City of the dollar amount of its share of the Storm Drain
System costs based upon the allocation set forth herein, the final plan quantities and the
unit prices of the lowest responsible bidder and 15% added for construction engineering.
7. The State shall invoice the City monthly for the City share of actual construction costs,
including construction engineering of the storm drain portion of the construction contract,
based on actual bid prices as the work is completed by the contractor. Should a monthly
bill for work completed by the contractor be less than $500.00, with additional work
remaining, the amount will be added to and included with the next monthly billing.
8. The City will operate and maintain the Storm Drain System including the collectors,
laterals, inlets and outfall facilities in accordance with the "Memorandum of Agreement
and Understanding", for the state storm drain facilities located on state -maintained routes.
9. The City will ensure that any future trunkline connections will not increase peak storm
drain flows. This can be achieved by requiring off -project discharge to be temporarily
detained.
10. This agreement shall become effective upon execution by the State and City.
