Patrick, City Manager SUBJECT Final Plat for River Glen Subdivision MEETING DATE: February 7, 2005 BACKGROUND: This is a request for final plat approval of River Glen Subdivision that plats 13 single family residential lots on approximately 3.4 acres. This property was annexed to the city in October of 2003 and given a zoning designation of R-3, Urban Single Family Residential. The property is located on the east side of South Woodland Drive north of Kelly Road. The Kalispell City Council approved this subdivision subject to conditions on October b, 2003. All of the conditions have been met or otherwise adequately addressed. There is some remaining landscape and sidewalk work that has not been completed and a Subdivision Improvement Agreement has been submitted with this plat. The S1A covers the cost of the improvements plus 25 percent as required in the Kalispell Subdivision Regulations. A letter of credit has been submitted to cover the cost of the improvements which are anticipated to be completed by September of 2005. A cash in lieu of parkland dedication check has also be submitted in the amount of $3,909 as required. RECOMMENDATION: A motion to approve the final plat for the River Glen Subdivision and to accept the subdivision improvements agreement would be in order. NOW THEREFORE, in consideration of the approval of the final plat of said Subdivision by the City, the Developer hereby agrees as follows: 1. The Developer shall deposit as collateral with the City a Letter of Credit, or other acceptable collateral as detennined by the Kalispell City Council, in the amount of $23,687.50. Said Letter of Credit or other collateral shall have an expiration date of at least sixty (60) days following the date set for completion of the improvements, certifying the following: a. That the creditor guarantees funds in the sum of $23,687.00 the estimated cost of completing the required improvements in RIVER GLEN (Name of Subdivision) b. That if the Developer fails to complete the specified improvements within the required period, the creditor will pay to the City immediately, and without further action, such funds as are necessary to finance the completion for those improvements up to the limited of credit stated in the letter; 2. That said required improvements shall be fully completed by SEPTEMBER 15, 2005 3. That upon completion of the required improvements, the Developer shall cause to be filed with the City a statement certifying that: a. All required improvements are complete; b. That the improvements are in compliance with the minimum standards specified by the City for their construction and that the Developer warrants said improvements against any and all defects for a period of one (1) year from the date of acceptance of the completion of those improvements by the City; c. That the Developer knows of no defects in those improvements; d. That these improvements are free and clear of any encumbrances or liens; e. That a schedule of actual construction costs has been filed with the City; and, f. All applicable fees and surcharges have been paid. 4. The Developer shall cause to be filed with the City copies of the final plans, profiles, grades and specifications of said improvements, with the certification of the registered professional engineer responsible for their preparation that all required improvements have been installed in conformance with said specifications. 2 IT IS ALSO AGREED BY AND BETWEEN THE PARTIES HERETO AS FOLLOWS, TO -WIT: That the Developer shall provide for inspection of all required improvements by a registered professional engineer before the Developer shall be released from the Subdivision Improvement Agreement. That if the City Determines that any improvements are not constructed in compliance with the specifications, it shall furnish the Developer with a list of specific deficiencies and may withhold collateral sufficient to insure sure compliance. If the City determines that the Developer will not construct any or all of the improvements in accordance with the specifications, or within the required time limits, it may withdraw the collateral and employ such funds as may be necessary to construct improvement or improvements in accordance with the specifications. The unused portions of the collateral shall be returned to the Developer or the crediting institution, as is appropriate. Drawer 1997 Kalispell, MT 59901 Re: Final Plat for River Glen Subdivision Dear Jim: Our office has received an application from Stokes and Associates for final plat approval of River Glen Subdivision that plats 13 single family residential lots on approximately 3.4 acres. This property was annexed to the city in October of 2003 and given a zoning designation of R-3, Urban Single Family Residential. The property is located on the east side of South Woodland Drive north of Kelly Road. The Kalispell City Council approved this subdivision subject to conditions on October 6, 2003 subject to conditions. All of the conditions have been adequately addressed or otherwise adequately addressed. There is some remaining landscape and sidewalk work that has not been completed and a Subdivision Improvements Agreement has been submitted with this plat. The SIA covers the cost of the improvements as plus 25 percent as required in the Kalispell Subdivision Regulations. A letter of credit has been submitted with the final plat to cover the cost of the improvements with the improvements anticipated to be completed by September of 2005. A cash in lien of parkland dedication check has also be submitted in the amount of $3,909 as required. The following is a list of the conditions of preliminary plat approval for this subdivision and a discussion of how they have been met or otherwise addressed. COMPLIANCE WITH CONDITIONS OF APPROVAL Condition No 1. Development of the subdivision shall be platted in substantial compliance with the approved preliminary plat which governs the location of lots and roadways within the subdivision except as modified by the conditions listed herein. (Kalispell Sub. Regs. Appendix C - Final Plat I(A) Contents of final Plat) This condition has been met. The final plat is in compliance with the preliminary plat that was submitted. Condition No 2. A variance to Kalispell Sub. Regs. Section 3.09 Table 1 - Maximum cul-d-sac length of 600 feet be denied based on the findings articulated in the staff findings for Variance Request 1 above. The roadway has been located as required. Condition No 3. A variance to Kalispell Sub. Regs. Section 3.11 Al requiring sidewalks on both sides of the street is partially approved based on the findings articulated into the staff report above. Sidewalks shall be placed within the subdivision abutting all proposed lots within this subdivision. (Based on condition 2 above, approximately 325 feet of sidewalk along the interior road along the south property line would be exempted.) This condition has been adequately addressed. The sidewalks have been included in the subdivision improvements agreement. Condition No 4. A variance to City design standards (DS-05) requiring a boulevard to be placed between the curb line and the sidewalk be granted for those lots abutting the cul-de-sac based on the findings articulated in the staff report above. 4 This condition has been met. The boulevard has been established as approved. Condition No S. The travel surface on South Woodland shall be widened to 28 feet as it abuts River Glen Subdivision to match the asphalt width of South Woodland to the immediate north as it abuts Woodland Court Subdivision. (Kalispell Subdivision Regs. Section 3.09 Table 1). This condition has been met. The required improvements have been made and there is an engineer's certification from Stokes and Associates dated January 24, 2005 certifying these improvements. Condition No 6. That the roadways serving the subdivision shall be constructed in accordance with the adopted Design and Construction Standards for the City of Kalispell for local streets. (Kalispell Sub. Regs. Section 3.01). This condition has been met. A certified letter from Stokes and Associates has been submitted with the final plat certifying the improvements. Condition No 7. That a letter be obtained from the Kalispell Public Works Department approving the plans and specifications for water, sewer and drainage facilities for the subdivision. (Kalispell Sub. Regs. Section 3.12 — 3.15) This condition has been met. A letter from the Kalispell Public Works Department approving the plans and specifications for the infrastructure has been submitted with the final plat. Condition No S. A letter from an engineer licensed in the State of Montana certifying that the improvements have been installed according to the required specifications shall be submitted at the time of final plat approval along with a letter Final Plat for River Glen Subdivision February 1, 2005 Page 3 from the Kalispell Public Works Department stating that the required improvements have been inspected and comply with the City standards. (Kalispell Sub Regs. Sections 3.09, 3.11 — 1.15) This condition has been met. A letter from Stokes and Associated dated January 24, 2005 has been submitted with the final plat certifying the improvements along with a letter from the Kalispell Public Works Department. Condition No 9. A storin water drainage plan which has been designed by an engineer licensed in the State of Montana shall be prepared which complies with the City's Design and Construction Standards and shall be reviewed and approved by the Kalispell Public Works Department. (Kalispell Sub. Regs. Section 3.12 A). This condition, has been met. The stormwater drainage plan was part of the plans and specifications approved by the Kalispell Public Works Department and the letter from DEQ submitted with the final plan includes a stormwater management plan. Condition No 10. Lot 1 shalI access onto the interior subdivision road.. Direct access onto South Woodland Drive is prohibited. (Kalispell Sub. Regs. Section 3.06 C). � This condition has been met. All lots are access from the interior road. Condition No 11. The road within the subdivision shall be named and signed in accordance with the policies of the Kalispell Public Works Department and the Uniform Traffic Control Devices Manual and be subject to review and approval of the Kalispell Fire Department. (Kalispell Sub Regs. Sections 3.09 K(7) & M). 4 This condition has been met. The roads have been signed as required. Condition No 12. The developer shall provide a letter from the U.S. Postal Service approving the plan for mail service. (Kalispell Sub. Regs. Section 3.22). This condition has been. net. A letter from the post office approving the mail service plan has been submitted with the final plat. Condition No 13. That the parkland dedication requirements shall be xnet by paying cash in lieu of parkland dedication in the amount one -ninth or 11 percent of the area in lots. The value of the property is set at $15,450/ acre. Based on 2.3 acres in lots, the current design would be required to pay $3,909. Dedication fee will be based on the land in lots of the final plat. (Kalispell Sub. Regs. Section 3.19 (A). This condition has been met. The cash in lieu of parkland dedication check in the required amount has been submitted with the final plat. Final Plat for River Glen Subdivision February 1, 2005 Page 4 Condition No 14. Development of the landscape boulevard with location of street trees shall be placed in accordance with a plan approved by the Kalispell Parks and Recreation director. (Site Review). This condition has been adequately addressed. A plan for the boulevard tree placement has been developed and the trees and landscaping are included in the subdivision improvements agreement. Condition No 1S. Street lighting shall be located within the subdivision and shall be shielded so that it does not intrude unnecessarily onto adjoining properties. (Kalispell Sub. Regs. Section 3.09 L). This condition has been met. The street lighting has been installed as required. Condition No 16. All utilities shall be installed underground. (Kalispell Sub. Regs. Section. 3.17 A). 4 This condition has been met. Utilities have been installed underground. Condition No 17. That the fire access and suppression system comply with the Uniform Fire Code and a letter from the Kalispell Fire Department approving the access and number and placement of fire hydrants within the subdivision as well as fire flows and access shall be submitted with the final plat. The fire access and suppression system shall be installed and approved by the Fire Department prior to final plat approval and or the start of use of combustible materials. (Uniform fire Code) . This condition has been met. A letter from the Kalispell Fire Department approving the subdivision and hydrants has been submitted with the canal plat. Condition No 18. All areas disturbed during development of the subdivision shall be re -vegetated with a weed -free mix immediately after development. (Kalispell Sub. Regs. Section 3.13). This condition has been adequately addressed. Revegetation has been included in the subdivision improvements agreement. Condition No 19. That preliminary plat approval shall be valid for a period of three years from the date of approval. (Kalispell Sub_ Regs. Section 2.04) This condition has been met. The preliminary plat has been submitted prior to the expiration date. Condition No 20. Sewer and water mails shall be extended to the east of the proposed River Glen Subdivision so as to provide service to the westerly boundary of Lots 7 and 8 of Greenacres Subdivision. In addition, a minimum 10 foot utility easement shall be provided along the entire easterly side of the proposed River Glen Subdivision to allow these utilities to be extended in either direction in the future (planning board) This condition has been, met_ The required utility easement and utility extension have been completed as required. COMPLIANCE WITH APPROVED PRELIMINARY PLAT The final plat is in substantial compliance with the preliminary plat which was reviewed and approved by the Kalispell City Council on June 7, 2004. COMPLIANCE WITH THE SUBDIVISION REGULATIONS: This subdivision plat has been found to be in compliance with the State and City Subdivision Regulations. COMPLIANCE WITH THE ZONING REGULATIONS This subdivision can be found to be in compliance with the Kalispell Zoning Ordinance and the R-3, Urban Single Family Residential, zoning designation for the property which governs the dimensional requirements of the lots within the subdivision as well as the uses. RECOMMENDATION: It can be found that the conditions of preliminary plat approval have been met or otherwise adequately addressed. The staff would recommend that the Kalispell City Council approve the final plat for River Glen Subdivision. Please schedule this matter for the regular city council meeting of February 7, 2005. Approval is also given with the understanding that any deviation from the approved plans and specifications will be submitted to the Department for reappraisal and approval. Within 90 days after the project has been completed the project engineer shall certify to the Department that the project was inspected and found to be installed in accordance with the plans and specifications approved by the Department. This certification shall be accompanied by a set of "as -built" record drawings signed by the project engineer. It is further understood that construction will be completed within three years of this date. If more than three years elapse before completing construction, plans and specifications must be resubmitted and approved before construction begins.
