BACKGROUND: This is a request by the City of Kalispell to amend the recently
adopted lighting regulations. These changes are being proposed by the staff as a,
result of worldng with the regulations over the past couple of months. ths. The proposed
amendments ents are rather nor in mature but are intended to address some problem
areas.
The KallspeR Planning Board held a public hean'ng on the ratter at their regular
meeting of October 11, Zoo . Because of interest expressed by certai* members of the
public, the planning board held a subsequent work session on the ratter on October
252 Zoo . At the planning board meeting and work session the board discussed the
changes as well as other issues relating to the lighting standards.
In response to public comment and public participation at the public hearing and at
the work session, the board thoughtfully considered the current policy regarding the
replacement t of non-confo .31r ; lighting. ,after significant discussion and nor
additional amendments, ents, the board felt the current and proposed changes to the po sy
regarding non -conforming Hghting is an appropriate and reasonable policy in
addressing the issue.
t their rear meeting of November 8, 2005, the pla;erg board acted on the
amendments to the lighting standards that rested in some changes and fa�.r�.e tine
in addition to hose recommended by the staff. The substantive charges are as
follows
• Amends..ng the fuH cutoff lens from 70 degrees above the horizontal plane to 80
degrees above the horizontal plane. This is because of problems obtaining a 70
degree cutoff fixture.
Amending the maximum height of a light pole from 30 feet In height to 25 feet in
height. This is to compensate for the greater light distribution gained from an 80
degree cut-off leas.

Amending the requirement for non -conforming commercial lighting to mow
replacement of the lens to a full cutoff leas and not the light pole. This is pnmarfly
because of the expense involved in replacing light poles and reconfiguration of the
light distribution pattern.
Some other changes involve clan' ication regarding how the light pole height and the
level of light are measured. An exemption to the height limit for sports and recreation
fields is also being proposed.

The Kalispell City Planning Board met on October 11, 2005 and field a public hearing
to consider a. request by the City of Kalispell to amend the recently adopted l g tag
regulations. These changes are being proposed by the staff as a result of working with
the regulations over the past couple of months. The proposed amendments are rather
nor in nature but are Mtended to address some problem areas.
Narda Wilson of the Kalispell Planning Department, presented staff report KZTA -o5-7
evaluating the proposal and explainm'g the proposed changes to the ordinance.
Because of Merest expressed by certain members of the public, the plying board
held a. subsequent work session on the matter on October 25, 2005. At the planning
board meeting and work session the board discussed the changes as well as other
issues relating to the fighting standards.
The board considered concerns expressed by the public regard .g the replacement of
non -conforming l g ting. Ultimately the beard believed that the current policy with
the proposed changes regarding replacement and compliance was the right course of
action.

AN ORDINANCE AMENDING THE KALISPELL ZONING ORDINANCE (ORDINANCE NO,

DECLARING AN EFFECTIVE ]ATE, AND AUTHORIZING THE CITY ATTORNEY TO
CODIFY THE SAME*
WHEREAS, on August 1, 2005, the City Council of the City of Kalispell -passed -Ordinance 1546,
amending the Kalispell Zoning Ordinance (Ordinance 1 o) to incorporate rate standards for
outdoor lighting that would apply to both commercial and residential development, and
WHEREAS, the City of Kalispell has submitted a written request to amend Section 27.22.104,
Outdoor Bighting Standards, of the Kalispell Zoning ordinance, by creating a -new
chapter 2 .22A., removing them from the Supplemental Regulations, and making mi-nor
changes, and
WHEREAS, the request was forwarded to the Kalispell City Planning Board and Zoning Commission
y the Kalispell Planning Department after having been evaluated under `. o.02 ,
Kalispell Zoning Ordinance, and
WHEREAS, the Kalispell City Planning Board and Zoning Commission recommended that the text o
the Kalispell Zoning Ordinance be amended by adding new Chapter 2 .22A., outdoor
Fighting Standards, and making minor changes, and
WHEREAS, the City Council has reviewed the KPD Report and the transmittal from. the Kalispell City
Planning Board and Zoning Commission and hereby adopts the findings made in Report
#KZTA-05-7 as the Findings of Fact applicable to this ordinance.
NOW,, THEREFORE, BE IT R AINE Y THE CITY COUNCIL OF THE CITY OF KALISPELL
AS FOLLOWS:
SECTION I. The City of Kalispell Zoning ordinance, Ordinance No. 1460 Js hereby
amended as follows on Exhibit "A"', attached hereto and thereby made a
part hereof.
SECTI All parts and portions of Ordinance No. 1460 not amended hereby
remain unchanged.
SECTION II , This Ordinance shall tale effect thirty. 3 days after its final passage.
SECTION IV. The City Attorney is hereby authorized and directed to recodi y this
Ordinance.
PASSED AND APPROVED BY THE CITY COUNCIL AND SIGNED BY THE MAYOR of THE
CITY OF KALISPELL THIS DAY OF 92005.

OUTDOOR LIGHTING STANDARDS
.PuRPOSE AND INTENT: Light pollution obscures the right sky, a resource * ortant
to residents and visitors. Light trespass M* ter eyes with the quality of life and public
safety of the community. Standards for outdoor lighting are i tend.ed. to control
artificial light from non -vehicular sources that produce glare light trespass, nmsance
light and or degrade the night sky. These standards are intended to reduce and
eliminate nuisance glare and light trespass from. poorly placed, inappropriate,
Tsa i gned or improperly shielded light sources. It is the further intent of these
standards to conserve energy and resources as weR as to curtail and reverse -the
degradation of the night sky through the regulation of the type and use of outdoor
g.�g while m tauung right -tie safety, xti ty and security.
"" IcABIL"Y: All residential and commercial lighting whether on public or private
property installed in the city its of Kalispell shall comply with the requirements and
specifications established with these regulations. Lighting -of n lic ri t of ra s and
roads shall be installed in accordance with applicable the Local state or federal
standards.
STANDARDS:

1. All lights shall be shielded and directed in such a way as to direct aR light
toward the intended area and away from hi reflective surfaces*
2. Lighting shall e designed, directed and shielded in such. a manner that direct
light does not be
the perimeter of the site as kited by these regulations.
3. Ail outdoor lighting, including the fvvture, pole, and other supporting elements,
shall be designed to complement the overall architectural appearance of the site
and prevent excessive glare.
The height and level of lighting should be appropriate for the development.
