The suburban residential dst ct is intended to serve as an area where meted density would be encouraged such. as M the oo- year- floodplain or on steep slopes or in areas where estate type development is anticipated. D. Proposed Zoning: City R - , Two -Family Residential, has been proposed for the property. The R-4 zoning district allows duplexes and smgle-`amy dwellings as e=tted uses. EVALUATION 13ASED ON STATUTORY CRffERIA The statutory basis for reviewing a charge in zonm' g is set forth by - 2.2 , M.C.A. Findings of fact for the zone change request are discussed relative to the itemized criteria described by -2--203, M.C.A. . Does the re jested zone cowl with the Master Plan? The property is designated by the Kalispell Groff Policy 2020 as "Urban Residential" which is defined as anticipating four to 12 d creme. s per acre. Because of the plans for the provision of public grater and surer to the site, the proposed R-4 zoning designation is in compliance with the growth policy designation. Because of the configuration of this property, and meted size no additional lots could be created but rather made a. part of an edsti lot. The R- 4 zoning has a minimum lot size requirement of 6,000 square feet with each lot aRowing a. duplex or a base density of one dwelling per 3,0square feet. However, as previously mentioned the configuration of this propel does not lead itself to allow the mw=* u r density provided for under the zoning. I 2, is the requested zone desi ed to lessen cow estion m the streets? A meted increase in the traffic in the area wi.i result from. the inclusion of this property into the city or the zoning of this property to R-4 and wfll not impact the functioning of the streets in the area. 3. Will the requested zone secure safety from fire, panic, and other dangers? Adequate access and pu he facilities are available to the site in the case of a emergency. There are no features related to the property which would com ronuse the safety of the public. New construction will be required to be in compliance with the building safety codes of the City which relate to fire and building safety. All municipal services me .uding police and fire protection, water and sewer service is available to the property and, wil1 be used at the time another lot is created in the future. . Will the requested zone promote the health and general welfare? The requested zoning classification will promote the health and general welfare y restricting land uses to those which would be compatible with the adjoining properties and provides a. place for new .ou.s g in the community. . WiR the re nested zone -provide for -adequate li fit and al - Setback, height, and coverage standards for development occurring on this site are established In the Ka. s ell Zonrg Ordinance to insure adequate light and air is provided.. . Will the requested zone 12revent the overcrowding of land? s previously noted this area has been anticipated for residential development and since public water and serer are available to the area the urban lard use designation is appropriate. The anticipated density generally falls within the proposed R-4 zorn'ng designation. AU public services and facilities will be available to serge this property. An overcrowding of lard would occur if infrastructure were M.ad.e uate to accommodate the development in the area. This is unlikely to occur. 7. WM the rectuested zone avoid undue concentration of-Reo-DIep. Miru'mum lot standards and use standards as well as subdivision development standards will avoid the undue concentration of people at the time the property is further developed.. . Will the requested zone facilitate the adegitate,j2rovision of trams ort do water, sewera e schools a ks and other 12u blic ro uirements A. public services and facilities are currently available or can be provided to the proper. Development should e encouraged m areas where these services are available. . Does the re nested zone # e consideration to the articular s ita flit r of the for particular uses The proposed R-4 zonm'g distract is consistent with the surrounding zonin and land uses in the area and gives due consideration of the suitability of this property for the permitted uses M the district, 0, Does the re jested zone `ire reasonable consideration to the character of the district? The general character of the area to the east and south is urban sized lots for residential development. ent. The same type odevelopment ears. e anti ' ated to occur on this property and will be consistent with the character of the district. . Will tl e 1 ro ose . zone conserve the value of buildings. Value of the buildings in the area wifl be conserved because the R-4 zonm*g promote compatible and like uses on this property as are found on other properties in the area. 2, WiLl the re nested zone errooura e the most a ro riate use of the land - thro out the m poi a Urban scale residential development should e encouraged in areas were services and facihties are available such as is being proposed on this parcel. The proposed zonm' g is consistent with the master plain and surrounding zoning in the area. RECOMMENDATION: Staff recommends that the Kalis e . City Planning Boar. and Zonm'g Corr mission adopt Staff Report #KA-05-17 as findings of fact and recommend to the Kalispell City Council that the initial zoning for this property upon annexation be R- , `fro-Famflr Residential. tial. The location is at the end of South woodland Drive, and is for a 2 family residential. y property is located next to Mr~. Fords, just to the north. The only concern l have is the access to his 2 proposed lots. There is a section of property between my lot and the next current house to the southeast between the roadway and Mr_ Fords propel that is to my knowledge a "common area] owned by the homeowners of Meadow Park 2 subdivision, to which l belong. My concern is his access to his property and homer he proposes to do so. l don't believe one propel owner can take a common area and convert it to his own use, but I'm not sure how our annexation to the city changed that, if any. My other question is, if he is allowed zoning, should he have to join our homeowners association because of his proximity. My concern is that he puts in a duplex, or builds for rental, which i think is not allowed in the association, I would like to came to the meeting, but i'm currently caring for my son} who is being treated for leukemia in Seattle.
