evaluating the proposal and recommended approval..
The Board discussed the proposal and the potential related impacts. A motion . was
made and. passed on a 4-1 vote to recommend to the Kalispell City Council that the
Kalispell Zoning Ordinance be amended as proposed. The dissenting vote supported
the concept of allowing the cash -in -lieu as an al.temati e, but disagreed with the
expansion f the district.
On July I I , the Board considered a. modification of the proposal.. The modification

essentially expanded the boundaries of the parking district to include the mall
property for purposes of the cash -in -lieu altemative, but maintained the parking ratio
currently applicable for any properties located north of Center Street. The .Beard
approved the modification on a -1 vote.
The modification clarified the parking ratio that would be used, and affirmed .rmed the
current ratios of, one space/400 square feet on new construction in the original
parking district and one space/200 square feet for retail use for these areas north of
Center Street (the Kalispell Center Mall).

WHEREAS, the City of Kalispell Planning Department submitted a Witten request to amend
Sections 2' .2 .040 l and 2 .2 .040 l l of the Kalispell Zoning ordinance by
amending' ' "Off Street Parking Within Special Maintenance District No. 2" by
expanding the district to inelud.e that area currently occupied by the Kalispell
Center Mall bounded by Center Street, Fifth Avenue West, the BN RR Wracks and
North Main Street and by authorizing a. cash -in -lieu rn t to be madein the
alternative to providing on -site parking spaces; and
"WHEREAS, the request was forwarded to the Kalispell City Planning Board after it was fully
evaluated and determined to be compliant under the statutory requirements of
MCA -2-20; and.
WHERIF,AS, after fally considering the evidence and testimony presented at a. properly noticed
public hearing on June 13, 2006 and after fully considering the Kalispell Planning
Department Staff Report KZTA-0 -, the Kalispell City Planning Board
recommended to City Council, on a 4-1 vote, that the Kalispell Zoning ordinance
e amended as proposed; and
WHEREAS, the City Council has reviewed the Kalispell Planning Department Staff`' Report
KZTA - -3 and the transmittal from the Kalispell City Planning Board and
hereby adopts the findings of the report as its Findings of Fact applicable to this
Ordinance.
E IT ORDAINED BY THE CITY COUNCIL of THE CITY of KALISPELL,, MONTANA,
AS FOLLOWS:
SECTION The City of Kalispell Zoning Ord anee, ordinance No. 11and 1202, is
hereby amended as follows:
Special Maintenance Parking District No. 2, as described in Figure 2 of
Appendix B shall he amended to include that area bounded by Center
Street, Fifth Avenue West, the BN RR Tracks and North Main Street a
well as all other areas previously included within the District.
SECTION N 1 Section 2 .2 r o .1 , Ordinance No. 1374, of the Kalispell Zoning
Ordinance is hereby amended as follows:
Within Special Parking Maintenance District No. 2: Property located
within Special Parking Maintenance District No. 2 South of Center Street
shall provide one parking space for every four hundred o square feet
of gross floor area, and North of Center Street shall rvide one parking
space for eveLy two hundred square Feet of grossfloor area but in no
case shall more parking be required than is otherwise provided for under
this article. A cash-in-lieu.pant r e paid as an altemative to
providing..required parking spaces .-site. The money..shall be paid into
fund established by the City Council and in an amount as be set
.the City Council from time to time by resolution.
SECTION III This Ordinance shall be effective thirty (30) days from and after the date
of its final passage and approval.

made and passed on a 4-1 vote to recommend to the Kalispell City Council that the
Kalispell Zoning Ordinance be amended as proposed. The dissenting gate supported
the concept of allowing the cash -in -lieu as an alternative, but disagreed with the
expansion of the district.
On July 1.1, the Board considered a modification of the proposal. The modification
essentially expanded the boundaries of the parking district to include the mall
property for purposes f the east -in-lieu alternative, but maintained the parking ratio
currently applicable for any properties located north of Center St eet, The Board
approved the modification on a 4-1 vote.

Noon said that he agrees with Hull on the amendments to
the bike path and disagrees with Jentz regarding the location
of the bike path. Norton, thinks that the recommended
location would be dangerous and the placement of the bike
path on flae sewer easement wi-U make the path safer, more
visible and therefore will be used more.
Jentz said that when you have a City bike path you. have the
City ping it in and r ainta�r� it. When you have a.
homeowners" bike path your are giving it to the homeowners.

Sorensen stated that this amendment dment deals with parking
regulations in the downtown area. There are general parking
ratios that go with divid. al use dough the City such as
single fail ' residences have 2 -street parldng spaces,
offices have I parldng space for every 400 square feet o
gross floor area, and restaurants are I space for every too
square feet of gross floor area. In the downtown core area
uses can core and go with an e'm'sting square footage
without having to provide additional parking. New
developments or additions onto existing buildings have to
provide additional parking. He said in practice that is very
difficult, if not impossible to came up with because
everything in downtown is already developed.
Most of the towns i Montana that they looked at have a
cash - -lieu payment if someone should fall short of pares
spaces. The cash -in -lieu payments would go into a. fund that
would be used to develop common public parking in the
downtown area. They also looked at the Groff Policy which
specifically recognizes the special parking considerations for
downtown and encourages innovative parking management
and provision of public lots and structures. After further
review and discussions, the city council directed staff to
bring Forth this amendment, which states that a cash -in -lieu
payment may be paid as are alternative to providing required
pang spaces on site. The money shall be paid into a road
established by the city council and in an amount to be set by
city council by resolution.
Sorensen said that the second part of this amendment deals
with expanding the downtown parking area to include iLhe
Kalispell Center Mall site, With what is here right now once
they ild the bark off of Highway 93 theme parkm'g would
e maxed out at the site and they would not be able to
expand the maU or put in any other buildings there.
Staff recommends that the Kalispell City Planning Board
adopt the findings in staff report KZ ` .- 06 -3 and recommend
to the KaEspell City Council that required parking within the
Special Parking Maintenance District No. 2 may be inet by a
cash, -ire. -lieu payment and that the Special Parking
Maintenance District No. 2 boundary be expanded died to include

HuU asked what the parking situation was downtown.
f anchey responded dec it is bleak. Hineh.ey said they have had
bus e ses leaving downtown for the express pose o
fording more available arking at a different location. This
s caused downtown to be status quo. They feel that
removing this parking requirement will allow businesses to
expand, however it wfll create a short-term air problem
that will have to e addressed in a different way.
Huff noticed that downtown was t .min Mto office space
and those people are having trouble with the 2 hour parking
limit. Hinchey said there is no solution and a lot of those
businesses are leaving downtown* They are 'trying to manage
the parking for the clients of these businesses and taming to
discourage people from parking all day.
Hull asked what this money will be used for. Hark ey said it
would be put into a fund held by the Parking Commission for
future parking �. u-i krments. Sorensen said that council

Balcom suggested that if there is a trend that businesses are
lean because of the lack of parkingthe money could go
into efforts to lure businesses back on to Mam' street.
HM* c .e r said one reason this came up is First Avenue
casino/ Resta.urarit on 1st Avenue West and 2nd Street West
wanted to expand and because they were expa-n i they
had to have 2 additional pang spaces. This perpetuated
the discussion to encourage expansion l downtown but they
are hampered by the current parking requirements.
Sorensen said there are at least 4 projects out there that are
impacted by the current pang requirements.
Norton said he totally understands that there is no parking
downtown and that if the city is going to get any type o
groom or redevelopment downtown some s going to
have to be. done. Norton said cash. -in -lieu is a to ical way to
handle the problem.
Norton was concemed that Kalispell center MaR is being
considered for inclusion in the pang district. He feels the
mall and their parking is a totally different 'issue than the
downtown parking issues. The maR has land . rt . of the
railroad tracks are.d they should do something in with the land
that they own to provide parking for their future expansion.
The mall could be handled as a separate issue. He added
that he wffl vote no if the mall is �r� cl .e 1.
Jentz said he is responsible for suggesting including the mall
in the pang district, the mall did not ask to be a part o
the district. The concept was to include the maU and now
here is a larger group of business owners M'volved In the
solution.
Hincbey said that It seems to him that if they have a problem
downtown with parldng they need all the players they can get
on heir side and that is why he is In .favor or keeping the
maU in the distHct.
Albert said that he agrees with Hinchey that they need t
keep the mall in the district.

BACKGROUND INFORMATION
In a portion of the downtown area, required off-street parking requirements ents are
addressed as part of a. district referred to as the Special. Parking Maintenance District
No. 2. The district has specific boundaries, and is bordered on the north by Center
Street, on the south. by SthStreet, on the west by 3r Avenue West, and on the east by
3rd Avenue East. In the district, businesses generally must provide one parking space
for every 400 square feet of gross floor area, but no more than is otherwise required
for the specific use. Most uusmesses have less than the requirement, are.d are
gra dfathere . in that regard as long as they do not ro-pose new construction or
expansion of existing . ci s. In those sit .a.tiorus, additional pang spaces are
required, but as a practicai matter are verb' difficult to provide. The e City Council
considered the matter at a work session on May 22, and directed staff to bring forth
this amendment.

B. Area Effected by the Proposed Changes: The proposed changes would affect
that portion of the downtown area identified as Special Parldng Maintenance
District Now 2 as amended.
C. Proposed Amendment: This is a. proposal to amend Sections 27.2 . - l .
and Appendix B, Figure 2 of the Kalispell Zoning Ordinance. The amendment
would e an addition to the current language, and would state "A cash--gin-lieu
payment may be paid as an aitematie to providing required parking spaces
o site. The coney shall e paid into a fund established y the City Cou ncil
and in an a -mount to be set by the City Council by resolution." Additionally.,
the amendment would expand the boundaries of the district to include the
Kalispell Center Mall property.
Staff Discussion: The general rule mi ler the zoning ordinance regarding pa kin is
that a minimum number of parking spaces must be supplied in conjunction with new
construct -ion or a change of use Within an e.-iasting building. In the core downtown
area., the use of a building can change without adding additional parking, but new

construction (including new additions) must provide one parking space for every 400
square feet of new floor area. Due to a lack of land, the practical effect is a significant
rotation on the ability to construct or enlarge buildings downtown. Wye amending
the downtown parking provisions of the ordinance wi help open the door for new
development, building/fire code issues, particularly relating to water supply, wiE also
reed to be addressed.
There are generally tree methods employed in the region for handling
downtown parking: exempt downtown businesses from mu* * um parking
requirements; 2) payment -in -lieu for parking spaces not provided -site; and (3)
arom al assessments. xts. Below is a sum.ary of practices for selected communities in

Generally, these alterative methods have involved a special. Improvement
District. The SID may be used to im'date the process of developing parking
downtown, mown, The payment -in -lieu -line program in Butte and Bozeman, for example, grew
out of SID districts established in the 1970s and 1980s. Cash received as an -in-lies.
payment has served to supplement the funds raised through the SID assessments.
Others,, such as Gr ant FaRs, have an assessment program in addition to the payment -
in -lieu in order to fund their parking garage.
If a cash -in -lieu program is pursued, the dollar amounts should be tied to the
cost of developing a parking space in the downtown area.. The specific dollar amount
would be set by the Council m a separate resolution after it considers the cost of land
and construction costs. The amount wiH likely be in the range of $5000 - S 10,000
per space;
The second part of the proposed amendment involves the proposed expansion
of the parking district boundary to include the Kalispell Center Mail propel. The
expansion of the boundary is, intended to accommodate potential future expansions
and construction on the site, and to recognize that the properly is functionally a. part
of the downtown core area.

policy plan by helping foster a prosperous and vibrant downtown through new
development opport r ties. The groom policy specifically recognizes . .. that
there are special parking considerations dowrntovm which differ from other
areas. . . Jand that we s .oW i encourage innovative parking management,
effective regulation of ors -street parking, shared paxking provisions, parking
standards that encourage reuse of upper floors, and provision of public parking
lots and structures." Kalispefl Growth Policy 2020, page 16.

The regular meeting of the Kalispell City Planning Board and Zoning Commission is
scheduled for Tuesday, June 13, 2006 beginning M M the Kahs ell City
Council Chambers, Kalispell City Half., 312 First Avenue East, Kahs ell. The planning
board wfll hold a public hearing and take public comments on the following agenda
l eins. The Board will make a. recon=e . atlorr to the Kalispell City Council who will

1. A request by men and Virgu'u'a R.e e, Wiffiar.. and Cindy Rie e and Polly Webster
for annexation, initial on and subdivision of approximately 12.8 acres located
at 386 and 394 Three Mile Dr ve, Kalispell_ The properties are currently zoned
C o .nty R- (one acre ' n nurn. lot size). The owners have petitioned to sex to
the City of Kalispell and have requested. the City -2 (9,600 square foot minimum
lot size) as well as proposing a 23 lot residential subdivision. The lots within the
subdIvislo . would rage from 15,000 square feet to 27,600 square feet. The
properties included in the annexation, initial zoning and subdivision can be
described. as Assessors Tracts 3ABB, 3AC, 3 D, 3.B, and 3ACA located within
Section 12, Township 28 Now, Range 22 Nest.
2. A request by Wayne Turner to amend m 1re Estates Phase 5 and add 7 lots to the
approved preliminary plat. Phase 5 includes 12:3 acres with preliminary plat
approval for 64 lots. Due to a change in access to Phase 5 and a redesign of the

expanding the boundaries of the Groff Policy northward using the Stillwater
River as the westem boundary, Church and Birch Drives as the or -them
boundary and generafly following , s. Highway 2, south to Rose Crossing. The
Groff Policy amendment is intended to ' e broad policy direction to growth in
this area should property owners wish to a neN to the city. The policy anticipates
the extension of urban sendces including sower and water into this area over time
and is designed to eve guidance to this associated groom.
