Kukulski, City Manager Susan Moyer, Community Development Director Request For A Frontage Road Paralleling US Highway 93 South Chris, after reading the MOU prepared by Schwarz Engineering, Inc. and visiting with Glen Neier on his discussion with Jerry Haygood, I have grave reservations about entering into such an agreement. I would like to make the following points for your consideration: • The creation of a private road and utility easement on Lot 3 of Daley Field Subdivision could severely impact the marketability of this city -owned property since we have no idea what sort of development will occur on this site. Identification of placement of utilities, easements, public right-of-way, etc. needs be completed by your combined department staff prior to even considering the preparation of an RFP for this site. • The Fire Chief has expressed concern over giving up the existing easements for future fire fighting access until a development plan is accomplished. Fencing issues remain unresolved which could further hamper access. • If the future development of Lot 3 generated high traffic across Rosauer's parking lot, it is only too probable that Rosauer's would decline to let this traffic onto their land. As stated to Glen by Mr. Haygood, no box retailer wants high traffic on his parking lot. Liability is quite an issue here. • It is my understanding that the location of a traffic light at Kelly Road is under the control of MDOT as well as access onto the proposed frontage road. • The City will incur approximately 60% of the cost of construction, survey and administration, and road maintenance under this MOU with no identifiable source of funding. cc: Glen Neier, City Attorney
