I have discussed the matters with the Public Works Department and offer the following for your review. Article 2, Section 2.2 (g) and Article 3, Section 3.1, Dev 1onmP.nt Agreement discuss the installation of traffic signalization accessing your site at the northerly entrance to the Rosauers' property. The Agreement schedules the installation to be commensurate with reconstruction of U.S. Highway #93, which Montana DOT had scheduled for 1999. According to information made available to this office, the U.S. Highway #93 reconstruction has been delayed until 2000. In our conversation you indicated that a delay in the construction may not cause a problem because Rosauers may not commence construction until the Fall of 1999. Regardless of the schedule, the Agretz.mer?t obligates the City to install temporary lights prior to Rosauers' occupancy. We also discussed the private road between Lots 1 and 2 and under the Reciprocal Easement and Maintenance Agreement, the "non - initiating party" is responsible to pay 1/ the cost of designing and constructing the road. Hagood, President August 5, 1998 Page 2 marketing plan to sell Lot 1, so I believe it fair to assume that Rosauers will be building the road and billing the City for the improvement. I further believe that you will be accomplishing the task in coordination with the Rosauers development. The Sanitary Sewer, serving Lots 1, 2, and 3, may be constructed by the City at its option, if the City designs and builds prior to Rosauers (§ 3.2 [e], Agreement). In discussing the matter with Jim Hansz, we see some advantages to allowing Rosauers to proceed with the sewer, followed by a late comer's agreement to be executed once costs are determined. I have attached hereto a copy of a letter from the Assistant City Engineer to the Director of Public Works for your information on the City's estimate of costs. The City had in its budget allocated funds for at least the temporary traffic signal and, I believe can make funds available for the road improvements this budget year. If you have further inquiries or desire more information please contact me. I would encourage your staff or consulting engineers to contact the City Public Works Department to discuss the technical aspects of the project. Attached is a preliminary design for the referenced. The sanitary sewer was sized at 10" which will allow for a minimum grade of 0.28%. This will take the end of the line to within 70ft.. of the southerly boundary of Lot 1, at which point, the flow line is at a depth of 4ft., which is the minimum allowed by our standards. The attached drawing shows a 100 ft. by 100 ft. storm water retention facility that would serve Lot 2. A retention facility for all three lots would be approximately 500 ft. long and would be constructed as a shallow swale between the taxiway and the sanitary sewer. Following is a preliminary cost estimate for the sanitary'sewer and the storm water retention systems for Lot 2 and all three lots: I. Sanitary Sewer: A. Sewer Main; 1,200 LF @ $30/LF- $36,000 B.
