12, TOWNSHIP 28 NORTH, RANGE 22 WEST., P.M.M. FLATHEAD COUNTY, M N A.NA
(PREVIOUSLY N D COUNTY R-1, SUBURBAN RESIDENTIAL TO CITY -2 (SUBURBAN
RESIDENTIAL), IN ACCORDANCE WITH THE KALISPELL GROWTH POLICY 2020, AND TO
PROVIDE AN EFFECTIVE DATE.
WHEREAS, Lee and Linda Hershber, er, the owners of the property described above, petitioned the City of
Kalispell that the zoning classification attached to the above described tract of land be zoned
R- 2, Suburban Residential,, on approximately 8.69 acres of lard, and
WHEREAS, the property is located north of Highway 2 West, on the east side of Hathaway Lane, are
WHEREAS, AS, the I rshb r is petition was the subject of a report compiled by the Kalispell Planning
Department, Staff Deport KA-- , dated July 25, 2006, in which. the Kalispell Planning

Department evaluated the petition and recommended that the property as described above be
zoned 'R -2, Suburban Residential, as requested by the petition, and.
WHEREAS, the Kalispell Planning Board held a public bearing on August 8, 2006, and denied a
recommendation that the property as described above be zoned R- , Suburban Residential ntial due
to a vote of two In favor and two opposed, and
WHEREAS, after considering all the evidence ub itte on the proposal to zone the property as described
R- , Suburban .residential, the City Council finds such initial zoning to be consistent with the
Kalispell Growth Policy 2 020 and adopts, based upon the criterion set forth In Section - -

findings of fact of KPD as set Forth in Staff Deport No. KA-o - .
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY of I ALISP LL AS
FOLLOWS -
