May 9, 2006, held a public hearing on the application, tools public comment and recommended that
the application he approved subject to five conditions.
After reviewing the application, the record, the KPD report, and after duly considering the
natter, the City Council of the City of Kalispell, pursuant to the Kalispell Zoning ordinance, hereby
adopts Kalispell Planning Department Conditional Use Report #KCU-06-4 as the Council'findings
of fact, and issues and grants to the above -described real property a conditional use permit to allow
the construction of a youth center on the church complex site, located in an Urban Single Family

1. That the proposal will he developed in substantial conformance with the approved site plan and
the Kalispell Zoning ordinance.
. Prior to issuance of a building permit the property owner shall obtain a wntten zoning lot
determination by the zoning administrator in order to utilize the existing parking spaces in the
parking lot adjacent to the youth center. Alternatively, the owner may do a boundary line
adjustment or eliminate the interior lot lines to incorporate the youth center lot into the lot
immediately north where the parking is located. in order to provide for the required 19 parking

B. Location and Size.,- The property proposed for the youth center is located
along Third Avenue WN approximately 250 feet south of the intersection of
Third Avenue WN and West California. Street. The property address is 452
Third Avenue WN. The site is approximately 16,200 square feet and can be

The proposed youth. center WIll provide a. recreational plaice for church youths
to socialize and hang-out in a supervised setting. The facility will also be used

activities on the weekends. The church does not anticipate constant use of the
center rather periods of heavy and light use throughout the week.

EVALUATION OF THE REQUEST
The application is reviewed in accordance with the conditional use review cry teria in
the Kalispell Zoning Ordinance.
. Site suit
a. A e a.ate UseableSpace: The proposed youth center is a. roxu'nateiy
4,800 square Feet in size. Trinity Lutheran Church owns the site of the
proposed youth center as well as most of the other properties in the
area with the exception of the residential properties to the south and to
the cast. There is adequate usable space on the site to accommodate
the proposed youth. center. The attached site plan provides a. creak
down on the lot coverage for the church property. Including the

church., school, gym, day care center and proposed youth, center, the
lot coverage totals 58,510 square feet or roughly 19.4% of the entire
site. The R-3 zoning allows maximum lot coverage of 0% .
b. AdequateAccess: access to the proposed youth center is provided by
Third ,ve. WN on the east and an existing parking area to the north.
There is also a. paved alley to the west of the proposed youth center
and a. paved driveway south of the proposed youth center.
c, nvi -onmental Constraints: There are no obvious environmental
constraints associated with this property. The site can be described as
level with a zero percent slope overall.. There is no surface water in the
immediate area. No impacts to the groundwater can be anticipated
because this property is served by community grater and sever
systems.
2. AppropriateDe
:
a.. Parking....Scheme: 'There are currently 160 parking spaces provided on
the church property to accommodate the church during services and
the school and day care center. '`mere is currently a. paved parking lot
located north of the proposed youth center between the youth center
and the day care center. This paring lot contains 33 parking spaces.
The Kalispell Zoning Ordinance requires I space per 250 square feet o
gross floor area for community and recrea.tion centers. This amounts
to 19 off-street parking spaces for the proposed 4,800 square foot
youth center. The current number of parking spaces is more than
adequate to accommodate the existing uses on the property and for the
additional 1.9 parking spaces needed for the youth center.
The proposed site for the youth center is located on a separate lot than
the existing parking lot. section 27. 03. o l o(5) d of the Kalis e , Zomm�
Ordinance alto ys for multiple contiguous lots held in common
ownership to obtain a Witten zoning lot determination by the zoning
a d m-inistrat or. In this case, the determination would extend to the
parking lot on the adjacent lot to be used for the youth center. The
church also has the option of doing a boundary line adjustment or
eliminating the interior lot lines to incorporate the youth center lot into
the lot immediately north where the parking is .locate.. As a
recommended condition of approval the church will need to address
the parking situation for the youth center pnor to issuance of a
building perr It.
b. Traffic Circulation: There is an existing parking lot located north of the
proposed youth center to provide for off street parking. . `hir . Ave. WN
is located east of the site and a paved driveway and alley are located to
the south and merest of the site respectively. Due to the proximity of the
parking .ot, the City street, alley and driveway serving the lot, traffic
circulation is adequate.

. (open Space: There are some play and lawn areas that currently exist
within the site which function as an informal open space area. No
other open space would be required.

located between the proposed youth . center building and Third Ave. WN.
In order to maintain the residential character of the 3-Mmediate area
the planning departments recommending that the trees located
between the existing residence ce on the site and the sidewalk remain.
The elevations of the proposed youth center indicate the center will
incorporate matenals which will reflect the existing church campus
and armo i e with the adjacent residential properties. Prior to
issuing a building pest, the Kalispell Architectural Review Committee
ill review the proposed elevations and building plans to ensure the
youth. center incorporates into the exiting neighborhood. By
incorporating a design and materials which reflect the neighborhood
character of the area and maintaining the existing trees locates on the
ea.stem o nda-ry of the property no additional fencing, screenmg or
landscaping is warranted.

a. Schools: This development is within the boundaries of School District

b. Parks and Recreation: The proposed youth center wiH provide
recreational activities for children attending the church and school. In
addition, the church has an existing play area and Feld immediately

c. Police: This property is within. the jurisdiction of the Kalispell Police
Department. Because of the nature ofthe proposed use, any additional
impacts to the department would be insignificant.
d. FireProtection: Fire protection is to be provided by the City of
Kalispe .'s FireDepart-meat. Upon reviewm'g the proposal the fire
department stated that due to the size of the building, occupancy type
and maximum number of occupants the proposed youth center could
.old, a fire sprinkler system may be required. Therefore, a condition
has been added to require the youth center to adhere to all building and
fire codes, which includes the possibflity of a fire sprinkler system
w*t .in the proposed youth center.
e. Water and. Benner: The water and serer system for this property is
provided by the City of Kalispell.. Impacts to the system will be Mlnimal
as a. result of this use.
f. Sod Waste; Solid waste will be collected by the City of Kalispell and
taken to the Flathead County Landfffl. There is sufficient capacity
within the landfill to accommodate this additional solid waste generated
from this use.
g. Streets: The youth center will not create additional adverse traffic as
many of the functions at the center will coincide with school or church
functions. The streets M the area will not be significantly impacted by
the center as there is adequate off-street parking.
Neighborhood Its:
No other impacts have been identified or are anticipated including additional
outdoor lighting impacts, smoke, fumes, gas, odors, or inappropriate hours of
operation. A notice of public .ean'ng was unaided to property owners within 150
feet of the site approximately 15 days prior to the hearing. To date, staff has
received no comments from neighbors on the proposal.
5 • Consideration of historical use pattems and recent changes: The Trinity
Lutheran Church and school complex have occupied the surrounding area for a
number of years. Existing residential dwellings are located to the east and
south of the proposed youth center site. The Church, in proposing the youth
center, has made an effort to incorporate the youth center into the existing
neighborhood through the design of the center.
Effects on property varies: No sigruficant negative impacts on property
values are anticipated. As previously mentioned, the proposal is compatible
with the neighborhood, and the development and land use impacts would be
typical of that anticipated for the area.
RECO MMNN
Staff recommends that the planning board adopt the stall' report #KCU-06-4 as
findings of fact and recommend to the l alis efl City Council that the conditional use
permit be approved subject to the following conditions:

The congregation of Trinity Lutheran Church are pleased to submit this letter as part o
the application for a Conditional Use Permit. The chorch has voted unanimously to
proceed with the sale and removal of the existing log residence and to proceed with to
final design and construction of a iVew 4,800 square -foot Youth Center located at 452
" Ave W-N, Kalispell, MT.
Enclosed are the required submittal mater'a s including the Application for Conditional
Use Permit., application fee o $350.00, list of adjoining property owners certified by
Flathead County GS; 17 copies of the o" x o" Site Plan, and 17 colored copies of the
proposed site play., floor plan and exterior perspective to provide all interested -
stakeholders and reviewers a good understanding of the design, intent of the addition, and
scope of work. We would be happy to provide any additional supplementary materials
upon request.
PROPOSED PROJECT:
There is definitely a need in this community for a safe, fun and supervised recreational
place for our youth to socialize,hang-out, and grow in a Christ -centered e . ironme .t.
The proposed Trinity Youth Center will be built on the Trinity Lutheran Church and
School campus located between 'd Ave WN Ave WN, West Cali omla and West

Washington St. The facility will also provide much needed multipurpose meeting and
storage space for various church and community groups and organizations when the
facility is not being utilized t the youth.
The church s currently seeking donations for this proposed youth center, If you have
time, talents, or financial gifts that you would like to contribute to this wonderfal
community project please contact the church office listed on application form.
DESIGN:
The design of the proposed youth center is one that tries to blend, integrate, and enhance
the existing church campus and surrounding residential ome . The building's height,
forte, proportions, and materials have been selected to reflect the existing chorch campus
and .armo i e with the adjacent private residences. The use of stone and siding and color
will also be used to match NNI-ith the entire Trinity Lutheran campus facilities.
ZONING & CODE:
The church cams c rre .tly resides in the R3, Urban single Family Residential, zoned
area. The standards allow for up to a 0% lot coverage of which the proposed new
facility brings the total proposed church campus lot coverage up to 0%. The proposed
2 -foot high single -story center will Utilize a steel frame and noncombustible
construction. All zoning and building codes will be observed for this ADA compliant
facility.
APPLICATION TOPICS:
As request on the application we are addressing the following site topics.
a, Traffic flow and Control: No changes to traffic flow and no need for traffic
control are anticipated with the proposed addition.
. Access and Circulation: Primary access to the proposed youth facility will be
from the s a ed int.emal off-street parking, the church and school facility, 3)rd Ave
V�N, and West Callfor.la Street.
c. off-street Parking &Loading: The Trinity Lutheran campus currently has 160
off-street parking stalls. A detailed parking calculation has been provided on the
enclosed Site Plan. No new parking is being planned at this time for this proposed
center,
d. Refuse & Service Areas: To be located west of the proposed youth center with
access from the alley.
e. Utilities: The log house that currently resides at this address utilizes city water
and sanitary services, natural gas, electricity, phone and cable. It is anticipated
that all of these utility services will .geed to be upsized, updated and used In
accordance with state and local codes.

i. open space Uses: Trinitv Lutheran Church has a wonderful park plate eld area
that it continues to preserve. With the addition of the proposed youth center, the
entire Trinity campus and property will have a 20% lot coverage, with up to 0%
being allowed.
Hours & operation: To meet the needs of our youth and other users we anticipate
that the proposed Youth center will hold miscellaneous functions, meetings, and
activities from approximately : o ate. to 8:00 pm during the weekdays, and
special activities on the weekends. This does not imply that their will be constant
activity at the center. We anticipate, as with most church and organization
faaetions, er ods of heavy and light use.
k. Noise, Light, Dust, odors, Fumes, and Vibrations: This proposed youth center
should not have any adverse effect on the sounding land uses or residences.
The Facility will be staffed at all tunes of operation. It is Trinity's mission to be
the best of .neighbors.

ezdsting residence to be used as a school for children ages three through sever.. The
property is zoned R-3, Urban. Single Family Residential, and the property is located at

The attached subdivision proposal was submitted by Long Engineeringon behalf of the Hlilzac
Corporation, The proposed subdivision would cute 44 cottage lots divided into three separate
development ent clusters. 'three Mile Drive is located along the so t ,em boundary and Mountain
Vista Estates is adjacent to the proposed subdivision on the west. No formal subdivision
application has been submitted and the Planning Department is treating this as a pre -
application m order to provide comments to Long Engineeringon the proposed subdivision..

1. A request from The Trinity Lutheran Church for a conditional use permit to allow a
youth center to be placed on the church complex site. The property is zoned. .-3
(Urban. Single Family Residential) which requires churches and accessory buildings to
obtain a conditional use permit prior to construction and operation. . The property
proposed for the youth center is located along Third Avenue WN apprwdmately 250
feet south of the intersection of Third Avenue WN and vest California Street. The
propel address is 452 Third. Avenue WN. The site can be desciibed as Assessor's
Tract - Y and -3 in Section 7, Township 28 North., Range 21 West, Flathead County,
Montana.
2. A request from Flathead High School District 5 for a conditional use permit to allow
final design and. construction of a new 12,400 square feet student commons/food
court addition to the high school. Flathead High School is located at 644 4thAve.
West. The high school occupies four city blocks between 4th Ave. west and 5thAve.
West. The property is 7.7 acres in size can be described as Lots 1-12 Block 9 1, Lots 7-

4. A request from Blsl ger Properties, bLC and Lyle and Joanne Davis for a growth pollicy
amendment, petition for annexation and lnitial zoning on two properties totaling 15.4
acres. The property owners are requesting to amend the growth policy designation on
the properties from Neighborhood Commercial and Suburban Residential to
Commercial. The owners have also submitted a petition to annex into the City of
Kalispell and have requested. B-2 (GeneralCommercial) zoning for each of the
