MEETING DATE: July 17, 2006 BACKGROUND: This is a second reading request for an initial zoning of R-2, Single Family Residential, on apprwdmately 12.8 acres. The property is located at 386 and 394 Three Mile Dave, Kalispell. It is the intent of the propel owners to subdivide the property into 23 single family y lots and corned the lots to city services. The Kalispell City Council approved the first reading f the ordinance at their regular meeting f July 3, 2006. (PREVIOUSLY ZONED COUNTY R-1, SUBURBAN RESIDENTIAL) TO CITY R- (SINGLE FAMILY RESIDENTIAL), IN ACCORDANCE WITH THE KALISPELL GROWTH POLICY 2020, AND To PROVIDE AN EFFECTIVE DATE. WHEREAS, Alien and Virginia Riebe, William and Cindy Riebe and Polly Webster, the owners of the properties described above, petitioned the City of Kalispell el that the zoning classification attached to the above described tracts of .hand be zoned -2, Single Family Residential, on approximately 12.84 acres of land., and WHEREAS, the property is located along; the southern side of T rce Mile Drive, approximately 400 feet west of the intersection of Three Mile Drive and Stillwater Drive, and WHEREAS, the Rie e/Webster petition was the subject of a report compiled by the Kalispell Planning Department, Staff Report KA-0 -4, dated June 5, 2006, in which the Kalispell Planning Department artm.ent evaluated the petition and recommended that the property as descrI ed above be zoned -, Single Family Residential, as requested by the petition, and WHEREAS, after considering all the evidence submitted on the proposal to zone the property as described -2, Single Family Residential, the City Council finds such initial zoning to be consistent with the Kalispell Growth Policy 2020 and adopts, based upon the criterion set -forth in Section -- o , M.C.A., and State, etc. v..hoard of County Commissioners, Etc. 590 P2d 02, the findings of fact of KPD as set forth in Staff Report No. KA-0-4, NOW THEREFORE. BE IT ORDAINED THE CITE' COUNCIL of THE CITY of KALISPELL AS FOLLOWS: SECTION 1. Section 27.02.0107 of the official Zoning Map of the Kalispell Zoning Ordinance, (ordinance No. 4 0) is hereby amended by designating the properties described above as -2, Single Family Residential, on approximately 12. 4 acres of land. SECTION 11. The balance of Section 27.02.010, official Zoning Map, City of Kalispell Zoning ordinance not amended hereby shall remain in full force and effect. SECTION M.
