Box 1997 Kalispell, MT 59903-1997 TO: Doug Russell, City Manager FROM: Charles Harball, City Attorney Tel 406.758.7709 Fax 406.758.7771 charball@kalispell.com SUBJECT: Resolution No. 5621— Amending the Fee Schedule for Special Events Held on City Owned Property MEETING DATE: May 20, 2013 — Regular Council Meeting BACKGROUND: The City currently charges fees to individuals and organizations that conduct special events, such as parades, on city owned property and right-of-ways. Currently there is a $100 parade fee and a $50 barricade fee in place. These fees help defray such costs as additional personnel staffing for police and for public works to place barricades at these special events that are therefore incurred by the City. As the special events have become more popular and frequent the City has experienced the costs of additional solid waste removal and some damages to city owned property related to the special events. For this reason the city staff is recommending that the Council consider approving a $100 solid waste removal fee as well as a $100 refundable damage deposit. The City will only charge such approved fees to the applicant to the extent that the special event necessitates the additional City services. RECOMMENDATION: It is recommended that Council consider and approve Resolution No. 5621 so that the appropriate fees may be charged for special events to recoup costs to the City. Respectfully submitted, C� Charles Harball, City Attorney RESOLUTION NO.5621 A RESOLUTION AMENDING PARADE PERMIT AND SPECIAL EVENT FEES TO BE CHARGED BY THE CITY OF KALISPELL TO APPLICANTS SEEKING TO MAKE USE OF CITY PROPERTY AND PUBLIC RIGHT OF WAYS FOR SUCH USES AND DECLARING AN EFFECTIVE DATE. WHEREAS, pursuant to Resolution No. 5490 the City of Kalispell requires anyone desiring to make use of city property and public right of ways for a parade or a special event to obtain a Parade/Event Permit from the City; and WHEREAS, parades and special events that utilize public right of way or city property generally require additional manpower to provide reasonable maintenance of the public facilities and to put prudent public safety precautions in place and this often calls upon additional city services at an additional cost to the City; and WHEREAS, depending upon the logistics of the planned event the City of Kalispell may need to employ the additional services of its various departments to erect safety barricades and provide for additional solid waste removal, make utility and landscape repair, or provide for police overtime and manpower to direct traffic and oversee the event; and WHEREAS, the Kalispell City Council finds that it is in the best interests of the City to charge a reasonable fee to an applicant for a special event permit in order to defray a portion of the additional costs the City would otherwise bear for these parades and events. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION I. The City of Kalispell Parade Permit and Special Event Fees for services provided shall be as follows: Parade Permit Fee: $100.00 Barricade Fee: $ 50.00 Solid Waste Removal $100.00 Refundable Damage Deposit $100.00 SECTION II. This resolution will become effective immediately upon passage by the City Council.
