KA LISPELL ZONING ORDINANCE,(ORDINANCE No. 1460), BY ZONING CERTAIN REAL
PROPERTY DESCRIBED AS ASSESSORS TRACTS 3ABB, 3AC, 3AD, 3AB, AND 3ACA LOCATED
IN SECTION 12, TOWNSHIP 28 NORTH, RANGE 22 WEST, P,M.,M., FLATHEAD COUNTY,
MO TA.NA. (PREVIOUSLY ZONED COUNTY R-I, SUBURBAN RESIDENTIAL) To CITY R-
(SINGLE FAMILY RESIDENTIAL), IN ACCORDANCE WITH THE KALISP I.}L GROWTH
POLICY � AND To PROVIDE AN EFFECTIVE DATE.
WHEREAS, Allen and Virginia Rie e, William and Cindy Rlebe and Polly Webster, the owners of the
properties described above, petitioned the City of Kalispell that the zoning classification
attached to the above described tracts of land be zoned -2, Single :Family Residential, on
approximately 12.84 acres of land, and
WHEREAS, EREAS, the property is located along the southern side of Three Mile Drive, approximately 400 feet
west of the intersection of Three Mile Drive and Stillwater Drive, and
WHEREAS, the Riel e Webster petition was the subject of a report compiled by the Kalispell Planning
Department, Staff Report #KA-064, dated June 5, 2006, in which the Kalispell Planning
Department evaluated the petition and recommended that the property as described above be
zoned R- 2, Single Family Residential, as requested by the petition, and
WHEREAS, after considering all the evidence submitted on the proposal to zone the propel as described
R-., Single Family Residential, the City Council finds such initial zoning; to be consistent
with the Kalispell Growth Policy 2020 and adopts, based upon the criterion set forth in
Section 7 - -6 0 8, M.C.A,, and State, Etc. v. Board of Counly Com-missioners Etc. 5 9 o P2d
2, the findings of fact of KPD as set forth in Staff Report No. K.--.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS
FOLLOWS4
SECTION I. Section 27.02.0 10, of the Official Zoning Map of the Kalispell Zoning
Ordinance, (Ordinance No. 0) is hereby amended by designating the
properties described above as R- , Single Family .Residential, on
approximately 12.84 acres of land.
S CTION II. The balance of Section 27.02.010, official Zoning Map, City of Kalispell
Zoning ordinance not an -ended hereby shall remain in fall force and effect.
SECTION III. This Ordinance shall be effective thirty (30) days from and after the date of
its final passage and approval by the Mayor.
