BACKGROUND: This is the second reading of an ordinance erta nm* g to a request
y Luther Preach for are initial zoning designation of R-2, Single Family Residential, on
approximately 1 acre. The propel is located at 1624 Woodland Avenue between
South Woodland Drive and Willow Glean. It is the intent of the propel owner to create
one additional lot through a. boundary lne adjustment and then connect bets. the
e stir g lot and residence and the new lot to city water. City Severer is not currently
available.
The Kalispell City Council approved the first reading of the ordinance and annexation
of the propel at their regular meeting of February 6, 2006.
RECO ATION; A motion to approve the second reading of the ordinance for
initial zoning of R- 2 would be in order,

KALISPELL ZONING ORDINANCE, (ORDINANCE NO. 1 , BY ZONING CERTAIN REAL
PROPERTY DESCRIBED AS ASSESSOR'S TRACT , 6HA, 6HB., 6RBA AND LOT 32X BLOCK
1 OF GREEN ACRES LOCATED IN SECTION 17, TOWNSHIP 28 NORTH, RANGE 21 WEST,
P,M,Mi, FLATHEAD COUNTY, MONTANA(PREVIOUSLY ZONED COUNTY -2, SUBURBAN
RESIDENTIAL) ENT, CITY R-2 (SINGLE FAMILY RESIDENTIAL), IN ACCORDANCE WITRTHE
KALISPELL GROWTH POLICY 2020, N To PROVIDE AN EFFECTIVE DATE.
WHEREAS, Luther L. Preach, the owner of the property described above, petitioned the City of Kalispell
that the zoning classification attached to the above described tract of land be zoned R-2,
Single -Family Residential, on approximately one acre of land, and
WHEREAS, the property is located on the south side of woodland Avenue between South Woodland
Drive and Willow Glen, and
WHEREAS, " . 's petition was the subject of a report compiled by the Kalispell Planning e . t t,
Staff Report #KA-05-19, dated December 23, 2005, in which the Kalispell Planning
I e artment evaluated the petition and recommended ended that the property as described above be
zoned R-2. Single -Family Residential, as requested by the petition, and
WHEREAS, after considering all the evidence submitted on the proposal to zone the property as described
-2, Single -Family Residential, the City Council finds such initial zoning to be consistent
with. the Kalispell Growth Policy 2020 and adopts, used upon the criterion set forth in
Section 6-3-608, M.C.A., and State, Etc. v. Board of County Commissioners,Etc. 590 P2d
02, the findings of fact of KPD as set :forth in Staff Report No. KA-05-19.
NOW THEREFORE, BE IT ORDA NE BY THE CITY COUNCIL OF THE CITY of KALISPELL AS
FOLLOWS:
SECTION' 1. Section 27.02.010, of the official Zoning Map of the Kalispell Zoning
Ordinance., (ordinance No. 1 60) is hereby amended by designating the
property described above a -2, Single -Family Residential, on
approximately one acre of land.
SECTION 11. The balance of Section 27.02.010, licial Zoning Map, City of Kalispell
Zoning ordinance not amended hereby shall remain in full force and effect.
SECTION 111. This ordinance shall be effective thirty 3 days from and after the date o
its final passage and approval by the Mayor.
