Findings of fact for the zone change request are discussed relative to the itemized criteria described. by 76-2-203, M.C.A. L Does the re nested zone c=ly with the Master Plan? The property is designated by the Kalispell Growth Policy 2020 as "Urban Residential" which is defined as anticipating four to 12 dwell n s per acre. Because of the plans for the provision of public sewer to the site, the proposed R - 2 zorAng designation is in con ante with the growth policy designation. The R- 2 zoru'ng has a minimum lot size re cerement of 9,600 square feet, which would provide densities of 4 units per acre on average. 2. is the re nested. zone designed to lessen cow estlo in the streets? No additional increase in the traffic in the area will result from the irclusi.on o this property into the City or the zoning of this property to -2 and will not impact the functioning of the streets in the area. 3. Will the requested zone secure sale from fire panic, aid other dangers? Adequate access and public facilities are available to the site in the case of an emergency. ency. There are no features related to the property which would compromise the safety of the public. New construction Will be required to be in compliance with the building sal ty codes of the City which relate to fire and building safety. All municipal services including police service, ire protection, and sewer are available to the property. . Will the re u sted zone rotnote the health and. neral welfare? The requested zonmg classification will promote the health and general welfare y restricting land uses to those which would be compatible with the ad on' u'ng properties and provides a place for new housing in the con=ur t . . Will the requested zone provide for ad e uate li t and air Setback, height, and coverage standards for development occurring on this site are established in the Kalispell Zoning Ordinance c to insure adequate light and air is provided. . Will the requested zone reve .t the overcro trdinof land? s previously noted this area has been antic*IP a.ted for resider tia.l, development and .a,,, in fact, developed in that manner. Since public water and serer are available to the area the urban lard use designation is appropriate. The anticipated density e .eraDy falls within the proposed. -2 zonmg designation. All public services and facilities will be available to serve this proper. An overcrowding of land would occur if infrastructure were inadequate to accommodate the development in the area. This is unlikely to occur. 7. Will the, reguested zone avoid undue concentration of people? Mftn'mur lot standards and use standards as well as subdivision development standards MR avoid the undue concentration of people if the property is fuser developed. . Will the re uested zone facilitate the ade ua.te provision of transportation, waiter sewerage, schools arks and offer pqbhc requirements? is All public services and facilities are currently available or can be provided to the property. Development should be encouraged in areas where these services are available. . Does the requested zone give consideration to the particular -suitability of the propertv for ardeular uses? The proposed R--2 onm district is consistent with the surrounding zoning and land uses in the area and gives due consideration of the suitability of this property for the permitted uses in the district. o. Does the requested zone ive reasonable consideration to the character of the district The general character of the surrounding area is urban sized lots for residential development, with. a neighborhood commercial development to the west. The roposed zoning is consistent with the groom policy and surrounding zoning in the area. RECOMMENDATION: Staff recommends that the Kalispell City Planning Board and Zoning Commission adopt Staff Report #KA-05-18 as findings of fact and recommend to the Kalispell.
