Patrick, City Manager SUBJECT Amendments to the Lighting Standards - Kalispell Zoning Ordinance MEETING G ATE: February 6, 200 This 's the second reading of are ordinance to amend the recently adopted lighting regulations. The amendments were minor in nature and intended to eliminate some potential hardships created. This included amending the defm.tion of a full cutoff light so that installers could readily purchase off' the shelf light fixtures, lowefing the height of the light poles to mitigate the potential glare from the new light fxturo standard, speeding only non- o fo��g light fixtures had to be brought Mto compliance and not the light poles at the end of the grace period and exempting athletic fields from the lighting standards. The Kalispell City Council approved the first reading of the ordinance at their regular meeting of January 17, 2006. Patrick Director City Manager Report compiled: January 20, 2006 Theresa White, Kalispell City Clerk Attachment: Lighting Standards ORDINANCE NO, 1563 AN ORDINANCE AMENDING THE KALISPELL ZONING ORDINANCE (ORDINANCE NO. , BY CREATING NEW CHAPTER. 27.22A, OUTDOOR LIGHTING STANDARDS, DECLARING AN EFFECTIVE DATE, AND AUTHORIZING THE CITY ATTORNEY TO CODIFY THE SAME, WHEREAS, on August 1, 2005, the City Council of the City of Kalispell passed Ordinance 1, amending the Kalispell Zoning Ordinance (Ordinance to incorporate standards for outdoor lighting that would apply to both commercial and residential development, and WHEREAS, the City of Kalispell has submitted a written request to amend Section 27.22.104, Outdoor Lighting Standards, of the Kalispell Zoning Ordinance, by creating a new chapter 27,22A., removing them from the Supplemental Regulations, and making minor changes, and '"WHEREAS, the request was forwarded to the Kalispell City Planning Board and Zoning Commission by the Kalispell planning Department after having been evaluated under 27. 0.020, Kalispell Zoning Ordinance, and WHEREAS, the Kalispell City Planning Board and Zoning Commission recommended that the text of the Kalispell Zoning Ordinance be amended by adding new Chapter 27.22A, Outdoor Lighting Standards, and making minor changes, and WHERF,,AS, the City Council has reviewed the KPD Deport and the transmittal from the Kalispell City Planning Board and Zoning Commission and hereby adopts the findings made in Report # KZA--7 as the Findings of Fact applicable to this Ordinance. NOW, THEREFORE, BE IT ORDAINEDY THE CITY COUNCIL OF THE CITY OF KA ISPEL AS FOLLOWS: SECTION 1. The City of Kalispell Zoning Ordinance, Ordinance No. 1, is hereby amended as follows on Exhibit "A"', attached hereto and thereby made part hereof. SECTION II. All parts and portions of Ordinance No. 1460 not amended hereby remain unchanged. SECTION III. This Ordinance shall take effect thirty days after its final passage. SCION IV.
