BACKGROUND: This is a preliminary plat request for a. two lot nor subdivision o
are emsting residential lot located at 1515 Wester. Drive in Kalispell. The property is
zoned R- (Two Family Residential) and contains .28 acres of land. Each of the
proposed lots would be o. 14 acres (6,213 square feet) in size. Although the proposed
subdivision is define as a nor subdivision as it is creating less than 5 lots, it is the
second subdivision from the o ffal tract of record and, therefore, is being processed
as a major subdivision pursuant to Section 2.04 of the Kahspell Subdivision
Regulations.

The planning Board held a. pubhc hearing on the proposed subdivision at its March
thmeeting. Staff provided a brief presentation of the proposed subdivision. One
person spoke M* favor. No one else wished to speak and the public hearing was close..
After the public hearing the board discussed the proposal and a motion was made
which passe na * ousl y to recommend approval of the preliminary plat to the
Kalispell City Council subject to the seven conditions listed in the staff report.

The Kalispell City Planning Board met on March 14, 2006 and held a public ea to
consider a request by Paul and Mary Husted for preliminary plat approval of a two lot
residential subdivision on approximately 0.2 acres. The property is located at 151
Wester Dave in the southwestern comer of Kalispell. The, site is described as Lot
of western Acres located in the SW 14 of Section 18, Township 28 North, Range 21
West, PMM, Flathead County Montana. The property is zoned R-4 Two Family
Residential which errn*ts single family and duplex houses on a single tract of land.
Sean Conrad of the r ahs eH planning Department, presented staff report K-o -1
and recommended the Planning Board consider recommending approval of the
relirr nary plat subject to seven conditions.
Beau Math a son from Montana Mapping, Inc. spoke in favor of the project. No one
else wished to speak and the public hearing was closed.
After the public fearing the board discussed the proposal and a motion was made
which passed unanimously to recommend approval of the preliminary plat to the
Kalispell City Council subject to the seven conditions listed M the staff report.

a request for prelinfinary plat approval of a two lot residential subdivision. A public
hearing on this matter has been scheduled before the Kalispell Planning Board for
March 1 , 2006 beginningat ' :oo PM in the Kalispell City Council Chambers. A

Council for final action.
BACKGROUND: On August 1, 2005, the City Council approved the final plat for the
resubdivision of lot 7 of Western Acres to create two residential lots, lot 7A and lot 7B.
The City Council also annexed the two lots at the August 1-smeeti-ng through
Resolution 5055. On August 15, 2005, the City Council approved Ordinance 1547,
amending the zoning on lots 7A and 7B from County - 5 (Two Family Residential) to
City R- (Two Family Residential). . The owners of lot 7A are now requesting to further
subdivide the lot into two lots at 6,213 square feet each..

east of the property. Properties located to the vest of the project site are zoned
County R - I (Suburban Residential).

has a minimum lot width requirement of 50 feet and a. minimum lot size
requirement of 6,000 square feet. The proposed lots are in compliance with the
zoning.
F. Relation to Growth Policy Map: The property is designated as Urban
Residential entia.l. in the KalispeR Growth Policy 2020. The emsting R-4 zoning and the
proposed uses for the site comply with the anticipated development for the area.

COMMENTS FROM THE SITE DEVELOPMENT REVIEW COMMITTEE
The proposed subdivision came before the Site Development Review Committee on
'e ruax-y 23, Zoo . The Committee did not offer any comments on the proposed
subdivision.
.REVIEW AND FINDINGS OF FACT
This application is reviewed as a. major subdivision in accordance ce with State statutory
review criteria and the Kalispell City Subdivision Regulations.
A, Effects on He lth and Safety:
Fire: The area is anticipated to be at low risk from wildfire clue to the urban
location, lack of woody fuel and good access to the site. The proposed
subdivision is not expected to significantly impact the service provided by the
district. Fire hydrants are located at the northeast corner of the intersection o
Ave West and Sunnysi e Drive and at the northwest corner of the
intersection of Sunnysi le Drive and Western Drive.

Roads- Access to proposed lot 2 is provided b t Avenue west, a City
maintained road. Access to proposed lot i is provided by Westem Drive, a
privately maintained roadway.
B. Effects on Wildlife and Wildlife Habitat:
The site is not mapped ed within any big game winter range and does not provide
significant habitat to wildlife and toes not host any significant or endangered
wildlife.
C. Effects on the Natural Environment:
There are no significant environmental factors that would pose an u' n a.ot o
the natural environment of the area..
D. Effects on Local Services:
Sewer and water: There are emsting water and sewer lies located within the
7thAve West road right-of-way. Water to the existing residence is provided by a.
shared well which serves all of the lots within the Western. Acres subdivision.
As a recommended condition of approval the existing house will be required to
abandon the water limes from the shared re l and connect to the City's water
main located within. the 7thAve. West road right-of-way.
In order to develop proposed lot 1 grater are.d sewer service -will need to be
extended from 7th Ave. West. As a recommended condition of approval, prior- to
filing the final plat, plans for the extension of water and sewer limes to proposed
lot 1 shall be reviewed and approved by the Kalispell Public Works Department
and subsequently installed to the eastern boundary of proposed lot 1.
Stormwater management: Stc rmwa.ter management will reviewed upon
further development of each of the proposed lots through the site plan review
process.
Roads: ,As mentioned previously, access to the site is provided by 7thAve. West
and Westem Drive. ive. Seventh Avenue West is apprommately 24 to 28 feet wide
and does not have a curb or sidewalks in the area of this subdivision. Western
Drive is approximately 24 feet wide with no curbs or sidewalks. Due to the
substandard nature of the streets, a condition has been added to require the
owners of lots i and. 2 to waive their might to protest the creation of an SID to
improve TAve. Nest and Western give at some point in the future.
T-he proposed lots have the potential to be developed with either a duplex or
single family dwelling, however, additional traffic impacts generated by future
development to the roadways in the area will be minimal.
Schools: This subdivision is within the boundaries of School District 5. There
will be minimal imal impacts to the school districts with an anticipated I additional
school aged child that might be added to the district's enrollment as a. result of
this subdivision.
Parks: This subdivision is not subject to the parkland dedication requirement's-,
because it is a minor subdivision as outlined in the Kalispell Subdivision
Regulations and as under State Statute.
Police Protection: This development will be served by the Kahs eU Police
Department, According to the Kalispell Police Department, they gill be able to
adequately serve this area.
Fire Protection: This development ill be served by the Kalispell Fire
Department. t. The subdivision will not create additional impacts to Fire service.
RefuseDisposal: The subdivision will be served by a private hauler for solid
waste disposal as provided for under the state statutes that addresses solid
waste provisions. Adequate space at the County landfill is available for the
solid waste which will be generated by the subdivision.
Medical Services: Kalispell Regional Medical Center is approxImately two miles
from the site. Ambulance services are available to serve this subdivision and
access is good.
El Effects on Agriculture and Agricultural Water Users Facilities:
This subdivision is in the urban area. of Kalispell and the area has been
developed to an urban density. This property has not been used for
agricultural purposes in the past and will have no effect on agricultural
activities in the Valley.
, CompHance it the growth Policy:
This property is included the Kalispell Growth Policy 2020 potential utility
service area and is designated on the lard use map as Urban Residential. The
existing R-4 zoning can be fond to be consistent with the Urban. Residential
land use designation and the proposed subdivision is in compliance with the
goals and policies contained in the Kalispell Growth Policy.
G. Compliance with Zoning Regulations:
This subdivision complies with the minimum lot size and lot width
requirements of the R- , Two Family Residential, zoning district. Each lot
meets the minimum lot size requirement for the current and proposed uses on
the property.

There is an existing house on proposed lot 2 with the em'sting garage to be
located on proposed lot 1. if the subdivision ivision is approved, proposed lot 2 would
not have off-street parking for the existing house on site. The Kalispell zoning
regulations require two off-street parking spaces be rovi e l on the lot if it is
developed with a. single family dwelling. Therefore, in order to comply with the
parking requirements of the zoning regulations a. condition has been added
requiring the owner instal a. driveway access onto 7thAve. West and provide for
two paved off-street parking spaces in accordance with Chapter 27.26 of the
Kalispell Zoning Regulations.
H. Compliance with the Subdivision Regulations:
The preliminary plat is in compliance with the State and City Subdivision
Regulations.

material is nnweate-d, stratified, clareous silt that was deposited on old ter -aces to a thickness of 3
to 4 feet. This soil is well suited to small grain under dry farming. Nearly all of it is cultivated,
mainly for wilbter wheat. A small acreage is irrigated from Ashley creek and used mainly for alfalfa.
This soil is in capability unit eR.
The surrounding lands soils are Alluvia land, poorly drained Aa. This lard type differs from
alluvial land, well drained, in having poorer surface and internal drainage, darker- surface soil as a
whole, mottlings in the subsoil, and more uniformly loamy and silty surface soil and upper subsoil
layers. It occupies nearly level areas.

Saline -alkali land (Sa) these are strongly saline soils in poorly drained swages and depressed arcs and
on slopes bordering small drai a eways, with a white crust on which only salt -tolerant weeds and
grasses grow. Areas that have good surface drainage but poor internal drainage have a brown,
weakly to moderately cemented, al ai hardpan in the subsoil. Some of the soils in this mapping unit
are moderately well drained and have profiles similar to those of the Denier and Tuffit soils.

Somers series
The Bogs series consists of deep, fine- to medium -
textured, moderately well drained soils that are sandy
elo r a depth o or 3 feet. The soils are on the r-
races of glacial lakes and streams in the UpperFlat-
head Valley Area. The parent material was derived
from ar il.lite, quartzite, and dolomitic rocks, all of the
Belt geological formation. These soils developed under
grasses and a scattering of ponderosa pine.
The Somers soils have a gray surf ace soil, 5 to
inces thick, a weak prismatic and blocky subsoil of
about the saute thickness, and a moderately to strongly
developed lime carbonate horizon at the top o h

Somers soils are more clayey* throughout their pro-
file file and are more poorly drained than the Kalispell

Areas of this complex are about 70 to so percent
Kalispell silt lofun, modera e1v deed over sand, and
o 30 percent, Demers silt loam. These two soils are

inap thein separately. The Demevs soil occurs as small

slick slots within the. Kalispell soil.
This complex is mainly on yell -drained terraces south
of Kalispell. It comprises the best agricultural soils
that are transitional behveen the typical, fairly produc-
tive ales ell soils and Saline-alk-ali land. The latter
includes areas of Demers soils and is poorly suited to
cultivated crops.

items. The Board will make a recommendation to the Kalispell City Council who will
take final action.
. A request by foul and Mary Husted for prehminary ...plat approval of a two lot
subdivision called the Re -subdivision of Lot 7A of Lot 7 of Western Acres. The
property contains .28 acres of land and each lot Is proposed to contain .14 acres
(6,2 13 square feet) . The site Is located at 15 15 Western Drive in the so .t .western
corner of KalispeR. The site is described as foot 7A In the SW V4 of Section 18,
Township 28 Fort., Range 21 West, PMM Flathead County Montana.. The property
is zoned R-4 Two Fly Residential and does alloy single family and duplex
houses on a sinee tract of land.
2. A request by the Kalispell City Airport affected Area Board on behalf of the City of
Kalispell and the Flathead County Commissioners to adopt a set of regulations
entitled the Kalispell City Airport Affected Area Ordinance. The purpose of the
ordinance is to protect the airspace around the city airport 0,000 feet from either
end of the runway and one mile wide on each side) by regulating the height of
structures and objects of natural groom in t . ,s area. By way of example, on those
lands outside of the city o rued airport property, the primary structures of height
concern will be towers (cell towers, elevated water towers, TV and radio
transmission towers) which tend to impact air travel corridors. The ordinance is
also intended to sere notice to the general public that an airport is operating
within this zone and upon adoption all sales of real property within the airport
affected area shall be accompanied with notice to the buyer of the incidence of
noise, fumes, vibration, hght and other effects from no=al and anticipated wort
operations.
3. A request by WCH 805, LLC to the amend Section 2 .2 . o 2 of the Kalispell
Zoning Ordinance Sign Code. The amendment is intended to give relief to the
d e minor of wall signs that are placed on larger buildings (in excess of Zoo feet o
frontage) which have undulating (varied gall) architecture which is typical with
larger fagade buildings where gall faces are varied in relied` to provide better
architecture. The cent text requires wall signs to be placed flat or within 12
mches of the wall on which it is placed. The amendment ent would allow wad signs to
e attached to and be placed parallel to the wall but not hold to the Mi'I um 12
mch rule if the wall architecture vaned over the length of the sign.
