BACKGROUND: The Kalispell City Planning Board met on September 11, 2007 and
held a public hearing to consider a request from the Seventh. Day Adventist Church for
a conditional use permit to allow three 8'x40' steel storage containers at their
Community Services Center. The Center is located in a residential neighborhood and the
property is zoned R-3, Urban Single -Family Residential. The existing Center is
considered a non -conforming use, and as such, a conditional use permit is required to
allow up to a 50% expansion. The property is located at 494 9th Avenue EN,
approximately one block north of Oregon Street. The property can be described as the
North 100 feet of the East 142 feet of Lot 1, Block 1 Northeast Addition in Section. 8,
Township 28 North, Range 21 west, P.M. M. , Flathead County, Montana.
Sean Conrad, with the Kalispell Planning Department, presented staff report KCU-07-
5 providing details of the proposal and the staff evaluation. Mr. Conrad noted that
staff recommended approval of the conditional use permit subject to eight conditions.
During the public bearing, Chare Largent and Trixie Neugebauer, who both work at
the Community Service Center spoke in favor of the proposal offering an overview of
the Center. Michael Blend, who has helped the church in the past, also spoke in favor
of the use permit. No one spoke against the requested use permit. The public hearing
was closed following these comments.
The Planning Board discussed the proposal which included a brief discussion on the
need for a visual screen, for the storage containers as recommended in condition # 7 of
the staff report. Following discussion on the project a motion was made to
recommend approval of the requested conditional use permit subject to the eight
conditions listed in the staff report. The motion was unanimously approved.
RECOMMENDATION: A motion to approve the conditional use permit would be in
order.
FISCAL EFFECTS: Minor positive impacts once fully developed.
ALTERNATIVES: As suggested by the City Council.

The applicant has applied to the City of Kalispell for a conditional use permit to allow three
8' x 40' steel storage containers to be located west of an existing building. The building is used as a
community service center and is a non -conforming use in the R-3 zone. The containers would
replace existing storage areas, allow for more storage of donated items and free existing space within
the building.
The Kalispell City Planning Board and Zoning Commission, after due and proper notice, on
September 11, 2007, held a public hearing on the application, took public comment and
recommended that the application be approved subject to eight conditions.
After reviewing the application, the record, the Kalispell Planning Department report, and
after duly considering the matter, the City Council of the City of Kalispell, pursuant to the Kalispell
Zoning Ordinance, hereby adopts Kalispell Planning Department Conditional Use Report #KCU-07-
5 as the Council's findings of fact, and issues and grants to the above -described real property a
conditional use permit to allow three 8' x 40' steel storage containers in the R-3, Urban Single
Family Residential zoning district subject to the following conditions:
1. That the proposal will be developed in substantial conformance with the approved site plan.
2. That the conditional use permit is valid for a period of 18 months from the date of
authorization.
3. The driveway and parking lot shall be paved within 6 months of installation of the storage
containers and in accordance with the approved site plan.
4. The existing 9' x 1 2' storage shed as well as the existing storage along the north side of the
building shall be removed upon installation of the storage containers.
5. The storage containers shall be placed on permanent foundations. A foundation permit shall be
obtained from the Building Department prior to construction. The owner shall also provide the
Building Department the locking mechanisms for the storage containers for the Department's
review.
6. The storage containers shall meet the following location requirements and use restrictions:
• No shipping containers shall be closer than 20 feet to a building.
• Shipping containers shall maintain a minimum distance of 10 feet from any property line.
• Shipping containers shall be separated from each other by 10 feet.
The containers shall not contain any sources of ignition, including electricity.
• Storage inside the shipping containers shall be orderly and in accordance with the
International Fire Code, 2006 Edition.
• Any storage of flammable and combustible liquids inside the shipping containers shall be in
accordance with the International Fire Code, 2006 Edition.
7. Prior to issuance of a foundation permit from the Building Department the following shall
occur:
a. The containers shall be reviewed and approved by the Kalispell Architectural Review
Committee. As part of the application materials submitted to the committee the
applicant shall include a landscaping and/or fencing plan to screen the containers from
properties to the north and west.
b. A revised scaled site plan shall be submitted which shows the property boundaries and
the existing building, storage containers, parking lot layout and associated landscaping
for the parking lot. Storage container locations shall be in accordance with condition
number 6. The type and size at planting for the landscaping shall be shown on the plan.
A minimum of 12 parking spaces shall be provided on the site. The revised site plan
shall be reviewed and approved by the Planning Department, Parks and Recreation
Department and Fire Department.
8. The approved screening plan for the containers and the landscaping associated with the parking
lot shall be installed per the approved plan.

A report to the Kalispell City Planning Board and Kalispell City Council regarding a request
by the seventh Day Adventist Church for a conditional use permit to allow the expansion
of their existing Community service Center building in an R-3, Urban single -Family
Residential, zoning district. A public hearing on this matter has been scheduled before the
planning board for September 11, 2007, beginning at 7:00 PM in the Kalispell City Council
Chambers. The Planning Board will, forward a recommendation to the Kalispell City
Council for final action.
BACKGROUND INFORMATION

B. Size and Location: The site is located approximately one block north of Oregon
Street. The entire parcel contains approximately 14,200 square feet. The property
can be described as the North 100 feet of the East 142 feet of Lot 1, Block 1
Northeast Addition in section S, Township 28 North, Range 21 West, P.M.M.,
Flathead County, Montana.
C. Nature of Request: The applicants are requesting a conditional use permit to alloy
-three 8' 40' steel storage containers which would be located to the vest of the
��isting ?,? � square foot building. This is a non --conforming use, and as such, a

conditional use permit is required to allow up to a 50% expansion. This building is
used as a community service building for the distribution of donated items. The
building currently has one 9'x 1 2' detached storage shed and a 9'x33' storage shed
attached to the buildings north wall. The requested containers would replace these
existing storage areas and allow the center to store more donated materials and free
up existing space within the building.
The Seventh Day Adventist Church applied for and received a conditional use
permit (KCU-05-7) to expand the existing community service building in September
of 2005. At that time the church sought and received approval to expand the
building by approximately 1,100 square feet. The addition was proposed on the
crest side of the current building. However the expansion plans have stalled
because the fire code requires a nunnnum of 1,500 gallons per minute of flow from
the hydrant serving this end of the street. This hydrant, located approximately 50
feet north of the property on the crest side of the street, currently provides 975±
gallons per minute. In order to obtain 1,500 gallons per minute from this hydrant
the church would have to upgrade and/or loop the water lines from SthAvenue EN
to the existing hydrant. This upgrade has made it cost prohibitive to continue with
the original expansion plans. The proposed storage containers would allow the
additional storage needed on -site without the need to upgrade the fire flow from the
existing hydrant. A further discussion of the Fire Department's recommendation on
the storage containers can be found under section H.3 . d of this report.
D. Existing Land Use and Zoning: There is an existing building on the property,
which has a total square footage of approximately 2,233 square feet. The history
of this building is unclear, but it has operated for many years as a community
service center, and is a non -conforming use. As such, they are applying for a
permit to expand a non -conforming use. The current zoning on the property is R-
3, Urban Single -Family Residential.
E. Surrounding Zoning and Land Uses Zoning: All of the properties in the
immediate area are residentially zoned with the general character of the area being
residential. To the northwest, property is zoned R-4 (Two --Family Residential) in
Flathead County.
North: Single family residential and some undeveloped lots, city R-4 zoning
South: Single family residential, city R-3 zoning
East: Single family residential, City R-3 zoning
West: Shining Mountain Church, City R 3 zoning
F. Growth Policy Designation. The Kalispell City Growth Policy Map designates this
area as `urban residential". The plan itself anticipates the need for semi. -public
services such as schools and services within residential districts. This proposal can
be found to be in substantial compliance with the growth policy.

Evaluation of the Request.
Site Suitability:
a.. Adequate Useable Space: The property owned by the church contains
approximately .33 acres, 23% of which would be developed with buildings.
The remainder of the parcel would be parking and landscaping. There
appears to be adequate usable space on the property to accommodate the
proposed expansion.
b. Ade uate Access: There is one approach to the site from 9th Avenue EN. No
new accesses are proposed or necessary in connection with the proposed
expansion..
C. Environmental constraints: The site is flat and level. The remaining areas
around the building provide adequate space for required setbacks. There are
no obvious environmental constraints associated with this property.

a. Parkin Scheme: currently the parking spaces are unpaved. According to
the Kalispell Zoning ordinance, parking for a retail business is based upon
the gross floor area of 1 space per 200 square feet. At 2,233 square feet the
parking requirement would be 12 spaces. The attached site plan shovers 20
spaces, which is more than adequate.
Upon reviewing the parking lot layout the parking plan will need to be
revised to address several issues in the Kalispell Zoning ordinance.
Specifically, section 27.26.030 (2) (d) prohibits parking spaces within, the front
yard setback except for parking associated with a single family residence.
The parking lot plan shows a handicap parking space on the east side of the
building between the building and 9th Avenue EN, within the required 20--foot
front yard setback. This space will need to be removed. In addition, section
27.26.030(6)(c) requires a visual relief screen when a parking lot is bordering
or adjacent to a residential zone. The parking spaces on the south side of
the parking lot plan are adjacent to an existing residence in an R-3 zoning
district. The owners have indicated that they will be planting a hedge along
this border to comply with this section of the code. Prior to issuance of a
foundation permit for the storage containers a recommended condition of
approval would require the owners to reJ71se the parking lot plan to meet the
requirements for parking lots in the Kalispell Zoning Ordinance.

The current parking lot is unpaved. The owners have stated that they intend
to pave the parking lot upon completion of the installation of the storage
containers. Paving of the parking lot complies with section 27.26.030(4) of
the Kalispell Zoning Ordinance and will be added as a recommended
condition of approval.
b. Traffic circulation: Peak times for traffic entering and leaving the facility are
Tuesdays, the only day the facility is open. Traffic enters the site from the
main access to the east of of 9th Avenue EN. Based on discussions with the
managers of the center, the center may have as many as 80-100 families
visiting the center on Tuesday.
C. 0-pen Space: No specific open space requirements are applicable to this use
other than those associated with the required setbacks, which have been
adequately observed on the site plan. Because of the size of the parcel, there
is not a significant amount of space on the site that is undeveloped.
d. Fencm' Screening/ Landsca in. : Limited landscaping has been placed
around the building, however the storage containers are proposed on the
west side of the building, using the building to shield the containers from
public view- along 9fh Avenue EN. It should be noted that the property
immediately north does have existing vegetation to screen the containers
however, should the existing vegetation die off or the owner remove the
vegetation, no visual screening would be zn place between the storage
containers and the property boundary.

Planning staff would recommend landscaping, such as bushes or hedges,
and/or fencing be installed along the western and northern property
boundary in the vicinity of the storage containers to screen the containers
from the property to the merest and north. Final designs on the screening
would be reviewed and approved by the city's architectural review committee.
e. i awe. There is an existing identification sign on the building that appears
to be in compliance with city codes. Under the current regulations, non --
dwelling uses in residential zones can have a non -illuminated sign not to
exceed 20 square feet per face. No additional signage has been proposed in
conjunction with the proposed expansion.
f. Building Height and Des M: An attached picture of the proposed storage
containers indicates the containers are 9' in height and, as previously
mentioned, are 8' wide and 40' long. The containers would be placed to the
merest of the existing building which would provide screening of the containers
from 9th Avenue EN.
Starting in 2006 the city requires all accessory buildings to a non-residential
use to be reviewed and approved by the city's architectural review committee.
As a recommended condition of approval the owners will need to obtain the
committee's approval on the storage containers and the landscaping and/or
fencing plan to screen the containers from neighboring properties.

3. Availability of Public Services/Facilities:
a. Schools: This building is within the boundaries of School District #5. No
impact on the school district can be anticipated as a result of the proposed
expansion.
b. Parks and Recreation: No apparent impacts to the Kalispell Parks and
Recreation. Department appear to be associated with the proposed
expansion.
C. Police: This facility is currently served by the Kalispell Police Department.
No increased impacts to the police can be anticipated as a result of the
proposed expansion.
d. Fire Protection: Fire protection is currently provided by the Kalispell Fire
Department. Given the size of the site, fire access is not a problem. 'There
are currently fire hydrants along 9th Avenue EN, the closest hydrant
approximately 50 feet north of the project site. However, fire flows for the
hydrant closest to the site are approximately 975 gallons per minute. The
existing community service center is classified as a retail use and therefore
requires a minimum. fire flow of 1,500 gallons per minute from hydrants
servicing the property. As mentioned in section C of this report, the church.'s
previous approvals for expansion did not materialize due to the insufficient
fire flows in the area.
After reviewing the application the Fire Department would prefer that
adequate fire flows be provided for the project. However, given the non-
combustible nature of the storage containers, the Fire Department will allow
placement of the storage containers under the following conditions:
■ No shipping containers be closer than 20 feet to a building.
• Shipping containers must maintain a minimum im um distance of 10 feet from
any property line.
• Shipping containers must be separated from each other by 10 feet.
• The containers will not contain any sources of ignition, including
electricity.
• Storage inside the shipping containers will be orderly and in accordance
with the International Fire Code, 2006 Edition.
• Any storage of flammable and combustible liquids inside the shipping
containers shall be in accordance with the International Fire Code, 2006
Edition.
The above recommendations from. the Fire Department have been included
in the conditions of approval.
e. water: City water currently serves the building and no significant impact on
water servrices provided by the City can be anticipated as a result of this

f. Sewer: Sewer service is currently provided by the City of Kalispell. No
significant impacts on City serer services can be anticipated as a result of
the proposed expansion.
g. Solid Waste: Solid waste pick-up is currently provided by the City and no
significant increased impacts can be anticipated as a result of the proposed
expansion.
h. Roads: Currently, access is provided by way of 9thAvenue EN and there are
no known circulation or access problems in the area associated with the use.
9 to Avenue EN is not a through street and ends just north of this site.
i, Immediate Neighborhood Impact: The general character of this
neighborhood is residential. The expansion will occur in the rear yard
behind the existing building and thus be generally blocked from
neighborhood view. The recommended landscaping and/or fencing on the
north and west sides of the containers will provide screening to neighboring
properties. By providing the storage containers the managers running the
center have stated that the existing 9'x 1 2' storage shed will be removed as
well as the existing storage along the north side of the building. This will be
added as a recommended condition of approval. The proposed expansion
wild. not have a significant impact to the neighborhood and will not adversely
affect property values in the area.
RECOMMENDATION
it is recommended that the Kalispell city Planning Board adopt staff report #KCU-07-5 as
findings of fact and recommend to the Kalispell City council that the conditional use
permit be granted subject to the following conditions:
1. That the proposal will be developed in substantial conformance with the approved
site plan.
2. That the conditional use permit is valid for a period of 18 months from the date of
authorization..

After calling your office, we were asked to write our comments regarding the request of the Seventh Day
Adventist church for a conditional use permit to allow for the addition of three steel storage containers on the
property at 494 9th Avenue East North. We have no problem with this request. The church's community service
center has operated out of its present location for as long as we can remember and to our knowledge, there has
never been a problem. They have had external donation containers which have been more than inadequate, too
often full and running over. The added storage will definitely be to the center's advantage. As a neighbor, we
have seen frequent trips to the present storage area by neighborhood children (and some adults) who rifle
through the contents and help themselves to whatever they want. These donations are intended by those who
donate to be used to help people. We feel that having this additional storage for the church will eliminate this
wrongful taking of donated property by these children and others that are not authorized to do so. The Church
has been a very good neighbor throughout the years. We encourage your vote for the approval of this request.

RE: Seventh Day Adventist Church project
As follow-up to our discussions of the last several weeks regarding the seventh Day Adventist
Church's desire to utilize shipping containers to Increase storage space for their community
Service Center, I provide the following information.
Fire flow remains an issue, and although provided with options to meet the intent of providing
adequate fire flow, the Seventh Day Adventist organization appears to continue their resistance
to exercising any of the options they have been previously provided. Although the Fire
Department would prefer that adequate fire flows be provided, given the non --combustible nature
of the storage containers, the Fire Department will allow placement of the storage containers
under the following conditions:
I . No shipping container may be closer than 20 feet to a building.
2. Shipping containers must maintain a minimum distance of 10 feet from any
property fine.
I Shipping containers must be separated from each other by 10 feet.
4. The containers will not contain any sources of ignition, including electricity.
5. Storage inside the shipping containers will be orderly and in accordance with the
International Fire Code, 2006 Edition.
0. Any storage of flammable and combustible liquids inside the shipping containers
shall be in accordance with the International Fire Code, 2006 Edition.
These conditions are a reasonable compromise due to the lack of available fire flow for the
Seventh Day Adventist Community Service Center to increase the size of their operation.
