BACKGROUND: This is a request by Flathead Hospital Development Company, LLC
for a conditional use permit to locate and expand the existing kindergarten
(Individualized Learning Center) and operate a sick child day care center (Dinosore
program) in the lower portion of the existing building at 00 Claremont Street. The Kid
mare program, a day care center, currently occupies the upper level of the building
and until recently the ETA Clinic, a medical use, occupied the lower level portion of the
building. The property is zoned H- 1, Health Care, and a conditional use permit is
required for the proposed change in use. The property can be legally described as the
Amended Plat of Lots 3 and 4, Highland Park 2nd Addition, Lot 4A, Located in Section
0, Township 28 North, Range 21 west, P.M.M. , Flathead County, Montana.
The Kalispell City Planning Board held a public hearing on April 10, 2007, and after
hearing the staff report and testimony from the applicant, the board recommended the
City Council approve the conditional use permit subject to the conditions listed in the
staff report.
RECDMMMNDATIDN: A motion to approve the conditional use permit with the six
listed conditions would be in order.
FISCAL EFFECTS: Minor positive impacts once fully developed.
ALTERNATIVES: As suggested by the City Council.

The applicant has applied to the City of Kalispell for a conditional use permit to locate and
expand the existing learning center and to operate a sick child day care center in the lower portion of
an existing building in the Health Care, H-1, zoning district for up to 34 children. The center would
be open from 6:30 am to 6:00 pm, would be used for children of employees of Kalispell Regional
Medical Center and would be open to the public.
The Kalispell City Planning Board and zoning Commission, after due and proper notice, on
April 10, 2007, held a public hearing on the application, took public comment and recommended that
the application be approved subject to six conditions.
After reviewing the application, the record, the KPD report, and after duly considering the
matter, the City Council of the City of Kalispell, pursuant to the Kalispell zoning ordinance, hereby
adopts Kalispell Planning Department Conditional Use Report #KCU-07-3 as the Councils findings
of fact, and issues and grants to the above -described real property a conditional use permit to expand
the existing learning center and to operate a sick child day care center in the lower portion of an
existing building in the Health Care, I I-1, zoning district subject to the following conditions:
1. The proposal will be developed in substantial conformance with the approved site plan and
other application materials. That the conditions associated with this permit shall be met prior
to use of the building.
2. The applicant shall apply for and receive a sign permit for the proposed changes to existing
signs prior to making any improvements. The proposed changes shall be in compliance with
the Kalispell Zoning Ordinance as specified above (Section 2. Appropriate Design, e. Signs).
3. The existing parking lot shall be re -striped and at least one van accessible space (16 feet
wide) must be provided (Section 2. Appropriate Design, e. Parking Scheme).
4. The applicants shall consult with the Kalispell Fire Marshal and comply with any noted
requirements prior to occupancy.
5. Existing exterior lights shall be brought into compliance with the City's outdoor lighting
standard per the Kalispell Zoning Ordinance (27.22.104) prior to occupancy.
6. The conditional use permit is valid for a period of 18 months from the date of authorization
after which time if the commencement of activities has not occurred the permit shall be void.
A continuous, good faith effort to design the building, obtain financing and other activities
shall be considered a commencement.

Dear Jim:
The Kalispell City Planning Board met on April 10, 2007 and held a public hearing to
consider a request by Flathead Hospital Development Company, LLC for a conditional
use permit to locate and expand the existing kindergarten(Ind*vidualized Learning
Center) and operate a sick child day care center (Dinosore program) in the lower
portion of the existing building at 60 Claremont Street. The Kid Kare program, a day
care center, currently occupies the upper level of the building and until recently the
VA Clinic, a medical use, occupied the lower level portion of the building. The
property is zoned H-1, Health Care, and a conditional use permit is required for the
proposed change in use. The property can be legally described as the Amended Plat of

Nicole C. Johnson, with the Kalispell Planning Department, presented staff report
KCU--07-03 providing details of the proposal and the staff evaluation. She noted that
the proposal would combine the three day care related functions under one roof to
better serve the hospital employees and the general public. Staff recommended
approval of the conditional use permit subject to six conditions.
During the public hearing, T. Ma.rcello Pierrottet, Facilities Manager for the Kalispell
Regional Medical Center, spoke in favor of the proposal offering an overview of the
program and highlighting the importance and need for such a facility in the
community. He noted that the change in use would also alleviate some of the traffic
congestion and parking issues in the area as the old VA Clinic parking area is more
than adequate to serve the proposed lower level functions and would support any
overflow parking generated from the other uses. No other comments from the public
were received and the public hearing was closed.
The Planning Board discussed the proposal and voted unanimously to recommend
approval of the requested conditional use permit subject to the six conditions listed 'in
the staff report.

This is a report to the Kalispell. City Planning Board and Kalispell City Council
regarding a request for a conditional use permit to locate and expand the existing
learning center and operate a sick child day care center in the lower portion of the
existing building at 66 Claremont Street. The property is zoned H-1, Health Care, and
a conditional use permit is required for the proposed change in use. A public hearing
to review this request has been scheduled before the planning board on. April 10,
2007 begm=g at 7.00 PM, in the Kalispell City Council Chambers. The planning board
will forward a recommendation to the Kalispell City Council for final action.
BACKGROUND INFORMATION: Note that a conditional use permit was granted in
2005 to allow a day care center (the Kid Kare program) to operate in the upper level of
the building and an administrative conditional use permit was granted in 2006 to
allow the kindergarten. (Individualized Learning Center) to locate temporarily in a
portion of the lower level of the building. The conditions of the previous permits have
been met.

C. Sum ary of Request: This is a request for a conditional use permit to locate
the existing kindergarten and sick child day care in the lower portion of the
building located at 66 Claremont Street. The Kid Kare program, a day care
center, currently occupies the upper level of the building and until recently the
VA Clinic, a medical use, occupied the lower level portion of the building. The
applicant is proposing to remodel the interior of the old ETA Clinic to provide for
an expanded. kindergarten (individualized Learning Center) and add space for
the Dinosore program (sick child day care) now located in the Medical Arts
Building. The old kindergarten space would become office space for staff and
encompasses 1,593 square feet. The project combines the two day care
operations and learning center program under one roof.
Day care centers are listed as a conditionally permitted use in the H-1 zoning
district. For the purposes of this request staff is considering the proposed
functions, Individualized Learning Center and Dinosore program, a day care
center use. The following list provides details for the two programs.

Both programs would be operated primarily for the employees of the Kalispell
Regional Medical Center, however the public is not excluded from the services
offered. The applicant owns this property and is affiliated with the Kalispell
Regional Medical Center. The learning center and sick child day care would
share a main entrance/exit and each would have multiple exits at the lower
level portion of the building. The parking lot is more than adequate to
accommodate the proposed use and the mature landscaping will not be
changed as a result of this remodel.
D. Existing Lana Use and Zoning. There is a two-story building on the site
which has provided for a variety of functions related to the hospital over the
years. Currently the Kid Dare Program occupies the upper level of the building
and was conditionally permitted in 2005. The kindergarten is temporarily
operating from a small portion of the lower level of the building which was
granted through an administrative conditional use permit in 2006. The ETA
Clinic, a medical use, recently vacated the major portion of the lower level and
is part of the area proposed for remodel. As previously mentioned, the property
has a zoning designation of H-1, Health. Care, which lists day care centers as a
conditionally permitted use. The existing building falls well within the property
development standards outlined in the City of Kalispell zoning Ordinance for
the H-1 zoning district.
E. Surrounding Zoning and Land Uses zoning: This area is generally part of the
medical campus associated with the hospital. All of the surrounding zoning is
H--1, Health Care.
North: Medical offices, H-1 zoning
East: Parking lot and medical offices, H-1 zoning
South: Buffalo Hill Terrace senior housing, H--1 zoning
West: Church and parking lot, H- 1 zoning
F, relation to the Growth Policy: The current Kalispell City Growth Policy Map
designates this area as Urban Mixed Use and recognizes the Kalispell Regional
Medical Center as an important contribution to the economic diversity and
prosperity of the area. Chapter 4, Policy 3 of the Growth Policy, anticipates
development at the Kalispell Regional Medical. Center to accommodate a wide
range of compatible residential, office, commercial and medical ' uses, which
provides the basis for the H--1, Health Care zoning district. Day care centers,
schools and churches would be some of the support services anticipated in
these areas. Therefore, the proposed project is in compliance with the Growth
Policy land use designation.

EVALUATION OF THE REQUEST
The application has been reviewed in accordance with the conditional use review
criteria in. the Kalispell zoning Ordinance.
1, site suitability;
a. Adequate Useable S ace: The existing structure and site provide
adequate space to accommodate the proposed uses with regard to the
number of children and staff, parking requirements and access. The site
contains mature landscaping and circulation within the area is

adequate. H-1 zoning allows up to 45 percent of the lot to be occupied
by permitted structures; the existing building does not exceed this limit.
b. Adequate Access: Access to the site is provided by way of the existing
driveway to the north of the building off of Claremont Street. This
driveway services the Kid Kare program operating from the upper level of
the building and leads to the lower level parking lot where the
Individualized Learning Center and Dinosore programs would be
accessed. The driveway is approximately 24 feet wide with a curb,
gutter and sidewalk adjoining the roadway. No access or parking
modifications are proposed or required to accommodate the proposed
change in use. Access is adequate.
C. Environmental Constraints: The area is developed and the site slopes
down to the west which provides for the split level building design.
There will be no change to the exterior of the building or site as a result
of this request. There are no obvious environmental constraints apparent
on the property.
2. Appropriate Design:
a. Parking Scheme: The Individualized Learning Center and Dinosore
programs are considered a general day care center operation. The
Kalispell zoning ordinance 27.26.050 provides minimum parking space
standards for the proposed use which is detailed below.
Day Care Center: I space per teacher/employee, plus one loading space per
six students with a maximum of two loading spaces to be provided on the
street adjacent to the property where the facilities are located for day care
centers.
The existing parking lot intended to service the lower level portion of the
building is more than adequate containing approximately 28 parking
spaces. only 13 spaces would be required for the proposed change in
use and as such no additional parking would be necessary. The existing
parking lot will need to be re -striped and at least one van accessible
space (16 feet wide) must be provided. The table below identifies
compliance with the aforementioned standards.

b. Site Circulation: Traffic circulation within the site appears to be
adequate to accommodate the proposed change in use. The private
driveway off of Claremont Street leads down to the lower parking lot
which loops back to the driveway. Space is provided in front of the
building for customers to pick-up and drop-off their children. Traffic
flow is expected to peak in the morning between 6:30 AM and 9:00 AM
and in the afternoon between 4:00 PM and 6:00 PM. No changes are
proposed or appear to be necessary.
C. Open Space: No specific open space requirements exist in the zoning
regulations for a change in use of this type. The zoning requirements for
the setbacks and lot coverage have been met and the mature
landscaping will be maintained.
d. Fencin Screeningl Landsca in The property is nicely landscaped
with mature vegetation around the property which provides a buffer
between this property and the surrounding properties. No additional
screening or landscaping is proposed or appears to be necessary.
e. Signs. No new signs are proposed. However, the new functions will be
added to the existing sign off of Claremont Street and the VA clinic sign
attached to the front of the lower level portion of the building will be
replaced to identify the services offered. The changes to existing signs
shall be in compliance with the Kalispell Zoning Ordinance. The zoning
allows one ground sign of 24 square feet or less with a six --foot height
limitation and one wall sign not to exceed 20 square feet per use. In
addition, the directional sign along the private driveway would be limited
to four square feet in size. A permit for the proposed sign changes
would be required.
f. Li hts : Existing exterior lights will need to be brought into compliance
with the City's outdoor lighting standards per the Kalispell Zoning
Ordinance (27, 22.104) prior to occupancy.

3. Availability of Public Services/ Facilities:
a. Schools: This site is within School District # 5 . No impact is associated
with the proposed day care center.
b . Parks and Recreation: There are parks within close proximity of the site,
but none are within walking distance for small children. No impacts are
expected to occur as a result of this use to parrs and recreation programs
and facilities.
C. Police: Police protection will be provided by the Kalispell Police
Department. No unusual impacts or needs are anticipated from the
proposed facility.
d. Fire Protection: Fire protection will be provided by the Kalispell Fire
Department. No unusual impacts are anticipated from the proposed
change in use, however the fire department will need to approve the
facility for compliance with the fire code requirements prior to
occupancy.
C. Water and sewer: Water and sewer are available to the existing building
and the proposed use is not anticipated to result in significant impacts
to capacity.
f. solid Waste: solid waste pick-up will be provided by the city and
existing enclosures will be utilised in accordance with City requirements.
No change of refuse and service areas are expected and will remain at
the north end of the property near the top of the entrance ramp leading
to the lower level of the building. Note that containers were moved in
accordance with the pervious use permit requirements.
g. Streets: Claremont Street was built to city standards; the street is paved
with curb, gutters and sidewalks. The private driveway leading down to
the layer level portion of the building is approximately 24 feet wide and
is paved with curbs and gutters. The change in use is not expected to
increase impacts to these existing streets.
4. Neighborhood. Impacts: Impacts of the proposal are not anticipated to be
dissimilar to other property uses in the immediate neighborhood. Traffic
generation for a day care center would be generally higher than office uses, but
peak flows would occur in the morning and again in the afternoon or evening.
No significant impacts are anticipated from noise, vibration, or dust. No
additional outdoor lighting is proposed, however, the existing lights will need to
be brought into compliance with the City's light ordinance. No impacts from
smoke, fumes, gas, odors, or inappropriate hours of operation are anticipated
beyond the norm of an urban density neighborhood. A notice of public hearing
was mailed to property owners Within 150 feet of the site approximately 15
days prior to the hearing. Staff had not received any comments from neighbors
on the proposal at the time this report was written.
S. Consideration of historical use patterns and recent changes: The proposal
is compatible with the immediate area, where a mix of uses are anticipated and
encouraged. This is in are, area at the edge of the city's residential area and
part of the main hospital campus. The zoning is H-1, Health Care, and the
growth policy anticipates this kind of development and use in the area. The
project will combine the two day care operations and learning center program
under one roof to better provide service to the community.
6. Effects on property values: No significant negative impacts on property
values are anticipated. As previously mentioned, the proposal is compatible
with the neighborhood, and the development and land use impacts would be
typical of that anticipated for the area.

Staff recommends that the planning board adopt the staff report #KCU--07--3 as
findings of fact and recommend to the Kalispell City Council that the conditional use
permit be approved subject to the following conditions:

Application for Conditional Use Permit City of Kalispell
Legal Description: Amended Plat of Lots 3 and 4, Highland Park 2nd Addition, Lot 4A,
T28N, R21 W, PMM.
Response to Item 3 from Application for Conditional Use Permit as follows:
a. Traffic flow and control.
Traffic flow at 66 Claremont will remain unchanged. Traffic flow will peak at
morning, (between 0630 and 0900 hours) and afternoon (between 1600 and 1800)
rush hours due to children arrival and departure times and will be coordinated
with the existing Day Care business hours.
The new Kindergarten and Dino Sore program will be located in the space
recently vacated by the VA Clinic at the Lower Level of 66 Claremont. This
allows better traffic flow, circulation., and control for the separate children' s
functions.
b. Access to and circulation within the property.
Access to site is to remain the same as with previous users: the same drive way
will serve the Kindergarten and the Dina Sore programs at the Lower Level and
the Day Care at the Main Level. The Kindergarten and the Dino Sore areas will
have their own entrance from the lower level allowing better circulation for the
separate functions. See attached Site Plan and proposed Lower Level Floor Plan.
c. off-street parking and loading.
No off-street parking is included in the parking count or considered in this
application.
No change in loading patterns is expected. Designated areas to remain on an
existing fifty -foot curb cut at the southeast corner of the site off of Claremont
Avenue and at the southwest corner of the building.
The Kindergarten and Dino Sore programs will have their own dedicated parking
immediately adjacent to their main entrance. In addition, there are thirty parking
spaces east of Claremont Avenue, (directly east of the site), specifically dedicated
for the use of the Day Care employees and for any overflow required, see attached
Site Plan. Due to the change of use from Business to Education, the parking
available on site at 66 Claremont is sufficient without consideration of the added
thirty parking spaces.

d. Refuse and service areas.
No change of refuse and service areas are expected. Services are to remain at the
south, southwest end of the building.
e. Utilities.
No change to utilities is expected. Services are to remain at south end of the site.
f Screening and buffering.
No additional screening or buffering is being considered as part of this
application.
g. Signs, yards and other open spaces.
No additional signs, yards or open spaces are being considered as part of this
application with the exception of identifying the new functions at the Lower Level
within the existing sign and identifying the main lower level entrance — this sign
will replace the existing VA Clinic sign.
h. Height, hulk and location of structures.
No change to existing building foot print configuration is proposed. Extent of
construction work is to be interior remodel.
Location of proposed open space uses.
No new open spaces are proposed as part of this application.
j. Hours and manner of operation.
The proposed hours of operation will be coordinated with and will fall within the
existing Day Care business hours from 0630 to 1330. See item "a" above for
peak hours of traffic low.
k. Noise, light, dust, odors, fumes and vibration.
No change of any of the above mentioned items is expected as part of this
application.
The Kindergarten was issued an Administrative Conditional Use Permit in August of
2006 for its current temporary location at the southeast corner of the Lower Level of
same building, see floor plan. To provide a better learning and teaching environment for
the expected 20--22 students, Kalispell Regional Medical Center is proposing to relocate
and expand the Kindergarten to the northwest corner of the Lower Level. This
permanent relocation will highly improve the egress requirements for the Kindergarten.
The existing space used by the Kindergarten will remain for use as a meeting or office
space.

The Dino Sore program is currently temporarily located in the Medical Arts Building. It
focuses on sick children ranging in ages from three months to twelve gears. It is used by
employees of KRMC, IICNW, and the general public when space is available.
By allowing these three functions within one roof, (Kid Dare, Dino Sore, and
Kindergarten), 66 Claremont will become a single use Type E Building.
