01/14/98 Kiemle & Hagood to Gallagher/Survey PaymentAG 0 OD C O M P A N Y January 14, 1998 Mr. Lawrence Gallagher Director, Planning & Economic Development City of Kalispel P. O. Box 1997 Kalispell, MT 59903-1997 RE: CITY OF KALISPELUROSAUERS Dear Larry: I have tried unsuccessfully to reach you a couple of times by phone since returning from vacation. Again, thank you and all the other fine people at the City of Kalispell for the expeditious closure on the Rosauers project. Approximately a month before this transaction closed, you and I discussed that the cost to complete the Dailey Field subdivision should be the responsibility of the City of Kalispel. Since we needed the same professionals to do work for Rosauers in order to determine the exact legal description and size of our lot, we decided that Rosauers should proceed with contracting for the work and that the City of Kalispell would reimburse for the subdivision portion. To that end, I am enclosing an $877 invoice from Jerry Lipp, Environmental Consulting, for his services regarding the subdivision, which I understand included taking the plat to the State of Montana. Yet to come will be an invoice from Smith Surveying for completion of the survey. Pasold Architects has not yet received a copy of that invoice. In fact, Ferman thinks that Smith may bill the City directly for its share. Please let me know whether the City would prefer to pay Lipp and Smith directly, or whether you wish to reimburse for these costs. If there is going to be a delay paying for these services, I suspect either our company or Rosauers would prefer to make timely payment to these professionals and then have the City reimburse us. Let me know as soon as you can your preference on handling this matter. I look forward to talking with you as related to Lots 1 and 3. Best wishes. lb511 00 v cc: Ferman Pasold Dik Salsbury Sincerely, KI EM LE & HAGOOD COMPANY Gerald L.
