KALISPELL ZONING ORDINANCE, ORDINANCE No. 1 Y ZONING CERTAIN
SAL PROPERTY DESCRIBED .AS ASSESSOR'S TRACT LOCATED IN SECTION 32,
TOWNSHIP 29 NORTH, RANGE 21 WEST, 'm.mt, FLATHEAD COUNTY, M NTANA
(PREVIOUSLY ZONED COUMfY RA-1, RESIDENTIAL APARTMENT) CITY R-5
(RESIDENTIAL/PROFESSIONAL OFFICE), IN ACCORDANCE WITH THE KALISPELL
GROWTH POLICY 2020, AND TO PROVIDE .AN EFFECTIVE DATE.
WHEREAS, John and Bobbi Bonner, the owners of the property described above, petitioned the
City of Kalispell that the zoning classification attached to the above described tract of
land be zonedB -,1ihborhood Buffer District,, on approximately o.e-half acre o
land, and
WHEREAS, the property is located on the west side of Whitefish Stage Road, north of the
intersection with West Evergreen Drive, and
WHERE1,AS, the Bonner' s petition was the subject f a report compiled by the Kalispell. Planning
Department, Staff Report KA-05- o, dated January 3, 200. in which the Kalispell
Planning Department evaluated the petition and recommended that the property a
described above be zoned B-1, Neighborhood Buffer District, as requested by the
titio , and
WHEREAS, the Kalispell Planning Board and Zoining Commission held a public hearing o
January 10, 2006, and determined from public comment and discussion that the
appropriate zoning designation should be R-5, Residential/Professional office, and
moved to amend the findings of fact of KA-05-20 as ucb, and
WHEREAS, after considering all the evidence submitted on the proposal to zone the property as
described R-5, Residential/Professional office, the City Council finds such initial
zoning to be consistent with the Kalispell Growth Policy 2020 and adopts, based
upon the criterion set forth in Section 7 -3-60 , M.C..A.., and Stag# Etc. v. Board of
County Commissioners, Etc. 590 P2d 602, the findings of fact of KPD as set forth i
Amended Staff Report No. KA-05-20A.
NOW THEREFORE, E IT ORDAINED BY THE CITY COUNCIL of THE CITY of
KALISPELLAS FOLLOWS:
SECTION I. Section 27.02.0 0, of the official Zoning; Map of the Kalispell
Zoning ordinance, (ordinance No. 1 0) is hereby amended b
designating the property described above a -5,
Residential/Professional office, on approximately ore -half acre of
land.

all .
