Patrick, City Manager SUBJECT Final Plat for Glacier High School MEETING DATE: May 5, 2008 BACKGROUND: This is a request for final plat approval of the Glacier High School, a single lot subdivision which created a school site for the high school on a lot approximately 59.8 acres in size. The lot is located at the southeast corner of the intersection of Nest Reserve Drive and Stillwater Road. Preliminary plat approval for this subdivision was granted by the Kalispell City Council on September 6, 2005 subject to 12 conditions. Well over 95% of the site work has been completed to date. The consultants have noted that approximately 80% of the landscaping for the high school has been installed with the remaining 20% to be completed throughout the spring, summer and fall of 2008 and 2009. The Kalispell Parks and Recreation. Department has signed a memorandum of understanding (MOU) with the school district which both approves the landscape plan and establishes the time frame for the completion of the landscaping. R.ECQMMENDATION: A motion to approve the final plat for Flathead Nigh School District No. 5 would be in order. FISCAL EFFECTS: Positive impacts once developed. That the development of the site will be in substantial conformance with the approved preliminary plat which shall govern the general location of the lot, easements and roadways. (Kalispell Sub. Regs. Appendix C - Final Plat I(A) Contents of final plat.) • The development of the high school is in substantial compliance with the approved preliminary plat. As noted in the letter from CTA dated March 7, 2005 some minor modifications were made to right-of-way boundaries to accommodate adjacent roads, softball and tennis courts will be installed at a later date as well as additional parking spaces on an as needed basis. Condition No. 2. That a letter be obtained from the Kalispell Public Works Department approving the installation of the public infrastructure to the site. Certification from an engineer licensed in the State of Montana shall be submitted with the final plat stating that all of the improvements have been. constructed accordingly. As built drawings shall be provided to the public works department prior to final plat submittal. (Kalispell Sub. Regs. Section 3.12 - 3.15). • This condition is met. The Public Works Department has approved the plans and specifications for the public infrastructure in a letter to Corey Johnson of CTA Architects dated March 6, 2008. The department's approval is based on a certification from. CMG Engineering Inc. and CTA Architects Engineers. Condition No. 3. That a traffic analysis be performed that assesses the impacts to all of the transportation systems in the immediate area under multiple jurisdictions with a single study done under the Montana Department of Transportation's Systems Impact Process through the Helena headquarters office. This would be a comprehensive review including but not necessarily limited to system capacity, signal warrants and access issues for west Reserve Drive, Stillwater Road and the Bypass including the new City street along the southern boundary of the property. Impacts and mitigation shall be clearly identified and the study shall be subject to acceptance by both M D CST and Kalispell Public works Department. e This condition is met. A traffic analysis was performed by Stelling Engineers, Inc. in September of 2005. An agreement between the Montana Department of Transportation. (MDT) and Stelliarng :engineers with regard to the conditions and scope of improvements to adjacent streets was reached in November of 2007. All necessary improvements to MDT's roadways have been completed. An email from. James Freyholtz, Kalispell Area Traffic Engineer, dated March 14, 2008 states that the Glacier High school has met approval for access to MDT roadways. The access onto Stillwater Road was reviewed and approved by the Kalispell Public works Department. Condition No. 4.The future City Street indicated on the accompanying site plan along the southern boundary of the property be fully developed as follows: a. The School district shall acquire a 60 foot wide R/W for the entire length of the proposed southerly street extending from Stillwater Road on the west to the Section 36 Connector on the east. This R/W shall be dedicated to the City of Kalispell at said time that the city formally requests it. A note shall be placed on the final plat noting that the R/W I s intended to be dedicated to the city of Kalispell at the time the city requests dedication. The city may request a phased dedication or the entire dedication. * This condition is met. The school district has purchased the 60-foot wide right-of-way and the required note is shown on the final plat. b. The school District shall develop the westerly 300 feet of this proposed R/W extending from. Stillwater Road easterly. The Road shall be built to city standards with the design and construction approved by the Kalispell Public works Department. This street shall be maintained as a private street until such time as the city of Kalispell requests dedication to the city. • This condition is met. The westerly 300 feet of wolfpack Way has been constructed to city standards and the school district is showing the completed road with a city right-of-way to be accepted by the council. The Public works 2 Department is recommending the council accept this portion of the right--of- way to be maintained by the city at this time. C. The DNRC will be responsible to ensure that the remainder of the RJ W is developed as a city street over time as development occurs along the R/ W but no later than 2 years after the completion of the Section 36 bypass connector. ■ Once the Highway 93 Bypass is constructed through Section 36 the DNRC will be required to complete Wolfpack Way within 2 years if the roadway has not already been constructed through subsequent development south of the high school. Condition No. a.Th.e following requirements shall be met per the Kalispell Fire Department: (Kalispell Subdivision Regulations, Section 3.20). ■ Water mains designed to provide minimum fire flows shall be installed per City specifications at approved locations. Minimum fire flows shall be in accordance with International Fire Code (2003) Appendix B. • Fire hydrants shall be provided per City specifications at locations approved by this department, prior to combustible construction. ■ Fire Department access shall be provided in accordance with International Fire Code (2003) Chapter 5. ■ It should be noted that hazardous weed abatement shall be provided in accordance with City of Kalispell Ordinance 10-8. ■ Street naming shall be approved by the fire department. ■ This condition is met. A letter from the Kalispell Fire Department dated April 30, 2008 approves of the crater main, fire hydrant locations, fire flours, and fire department access. Condition No. 6. That landscaping of the site be done in accordance with a plan approved by the Kalispell Parks and Recreation Department. ■ This condition is met. The Kalispell Parks and Recreation Department has approved a landscape plan, the majority of which has been completed. The remaining landscaping will be installed based on a signed memorandum of understanding by Kalispell School District 5 and the parks and recreation department. Condition No. 7. All existing and proposed easements shall be indicated on the face of the final plat. Utility easements for City water and sewer shall be provided to allow for the logical extension of utilities fromthis subdivision to adjoining properties. A letter from the Kalispell Public Works Department shall be obtained stating the easement locations have been reviewed and approved. ■ This condition is met. The required easements are shown on the final plat and have been reviewed and approved by the Public Works Department per their letter dated November 29, 2007. 3 Condition No. S. Street lighting shall be located in accordance with Kalispell's Standards for Design and Construction.. • This condition is met. Street lights have been installed along Wolfpack Way. The location of the lights was approved in the construction drawings for Wolfpack Way by the Public Works Department. Condition No. 9. Site lighting shall be accomplished through the use of a full -cut off lens and in accordance with the same standards as required under the development agreement between the City of Kalispell and the developers of the Spring Prairie site, to wit not to exceed 30 feet in height with the light fixture that does not shine above a 70 degree horizontal plane. • This condition is met. The site lighting complies with this condition. Condition No. 10. That a minimum of two-thirds of the necessary infrastructure for this subdivision shall be completed prior to final plat submittal. • This condition is met. All necessary infrastructure to serve the subdivision has been installed. As noted previously the only outstanding item not finished is the site landscaping. Condition, No. 11. All new utilities shall be installed underground. (Kalispell Sub. Regs. Section 3.17A) . • This condition is met. All utilities have been placed underground per sight inspection and per city standards. Condition No. 12. That preliminary approval shall be valid for a period of three years from the date of approval. (Kalispell Sub. Regs. Section 2.04 (E (7)). • This condition is met. The city council granted preliminary plat approval on September 6, 2005. This application has been submitted within the three year time frame. COMPLIANCE PLIANCE WITH APPROVED PRELIMINARY PLAT The final plat is in substantial compliance with the preliminary plat which was submitted and approved. COMPLIANCE WITH THE SUBDIVISION REGULATIONS. This subdivision plat has been found to be in substantial compliance with the State and City Subdivision Regulations. All taxes are current. COMPLIANCE WITH THE ZONING REGULATIONS This subdivision complies with the Kalispell Zoning Ordinance and the R-5/PUD zoning designation. All of the conditions of preliminary plat approval have been adequately addressed. The staff recommends that the Kalispell City Council approve the final plat for this subdivision. The development of the Glacier High School site is in substantial conformance with the approved Preliminary Plat. The only modifications that were made for the approved documents are as follows: a. A GHS Parking Plan agreement with the City of Kalispell was reached to not build the full number of parking spaces as shown on the Preliminary Plat. 877 spaces initial spaces were provided, which includes 18 ADA parking spaces. 354 future parking spaces are identified for further school growth and needs, which brings the future total parking build out count to 1,231 spaces. School District 5 has been conducting and submitting to the Kalispell Planning Department periodic parking surveys to determine the adequacy of the current parking arrangement. This agreement was approved in Ordinance No. 1549. A. copy has been attached. b. The right-of-way lines were modified around the new MDDT rounda- bout and transitions areas along Stillwater Road and West Reserve Loop to accommodate the widened roadway improvements. c. The softball fields and tennis courts will be future site developments and are not currently installed. The softball fields will be installed the summer of 2008. There are currently no plans to install the future tennis courts. This land will be planted in grass and maintained. 2. A letter obtained from the Kalispell Public Works Department, along with a Licensed Montana Engineer's Certification, stating that the public utilities were constructed in compliance with the Preliminary Plat, local codes and standards is being provided in this submittal. 3. A Traffic Impact Study was submitted by Stelling Engineers, Inc. in September of 2005. Existing and proposed utility easements for City of Kalispell water and sewer are shown in the Final Plat drawing documents. A letter of acceptance by the Kalispell public work Department has been provided in this submittal. S. A street light has been installed along Wolfpack way extending from Stillwater Road. This light location and illumination was approved by the City of Kalispell Public Works Department. 9. Site lighting was installed per current City of Kalispell lighting standards, which exceeds the requirements stated in the Conditions of the Preliminary Plat. 10. All improvements are in place with exception of the site landscaping, which is currently estimated at 80% complete. This meets the minimum two-thirds complete criteria for submitting the Final Plat. 11. All new utilities are installed underground. Enclosed is an Overall Landscape Plan showing the modifications and denoting the future landscape work that remains. The plan calls out for the remaining play field area to be planted in grass and completed by October 3 Is', 2008; It calls for the internal perimeter access drive boulevards to be planted in grass by October 31 ", 2008; It calls for the current parking rock islands to have live vegetations (plants, native grass, shrubs, etc.) by October 31'% 2008; And it calls for the undeveloped perimeter area to have grass by October_ 31 St, 2009. This Landscape Plan has been reviewed and signed by an authorized School District 5 representative. This Overall Landscape Plan changes the original plant locations and types, but observes the total amount of plants that were approved during the City permit application process. After two recent meetings with the Architectural Review Committee (4/22/08) and the Site Development Review Committee (4/24/08) an enclosed 8-1/2 x 11 GHS Parking Island Landscape plan is being submitted as part of this MOU as it better defines the landscape intent. The City of Kalispell Parks and Recreation Department wants the future trees aligning the internal GHS access roads moved to the perimeter of the east side of the campus along West Reserve Loop. The Architectural Review Committee suggested more future pine trees and clustering the landscape along West Reserve Loop to allow views to the high school facility while screen parking and service areas. They also suggested low-water native grasses for water conservation principals where green turf is not required. This MOU submittal serves as an official agreement between School District 5 and the City of Kalispell and defines the schools landscape masterplan, scope, and timeline.
