Patrick, City Manager SUBJECT Conditional Use Permit for the Women's recovery Horne Facility MEETING DATE: July 7, 2008 BACKGROUND: The Kalispell City Planning Board met on June 10, 2008 and held a public heaving to consider a request from the Flathead Valley Chemical Dependency C ' ' c to operate a woamen's recovery home facility in an existing house located at 87 Northern Lights Boulevard. The property is zoned R-3, Urban Single -Family Residential, which requires a conditional use permit to operate a foster or group home within the district. The property can be legally described as Lot 7 of Block 1 Olson Addition located in Section 12, 'township 28 North., Range 22 west. Planning staff presented staff report KCU-08-2 providing details of the proposal and the staff evaluation. staff noted that state law considers these type of group homes as residential uses and that cities are prohibited from denying permits or adding conditions that wouldn't otherwise apply to residences in general; the public hearing is a forum to provide information and allow for comment. Staff recommended approval of the conditional use permit subject to four conditions. During the public hearing, Michael Cumn-Lns, Executive Director of the Flathead Valley Chemical Dependency Clinic and Doc Harkins, a member of the Chemical Dependency Board, spore in favor of the proposal offering an overview of the program and highlighting the importance and need for such a facility in the community. Five individuals from the neighborhood area spoke against locating the recovery home at this site. Their concerns about having this facility in their neighborhood included safety, declining property values, and other impacts to the neighborhood. The public hearing was closed following these comments. During the planning board's discussion the board took issue with the fact that staff members will only be present during the day and early evening hours. A 24 hour camera surveillance system will be in place to monitor the home during night and early morning hours. However, the planning board members did not feel comfortable with a home of up to 8 persons in drug recovery without a staff member present during the night to handle any problems that may arise. Therefore,, a motion to amend the conditions of approval to include a requirement that supervisory staff be on -site 24 hours a day, 7 days a week was was unanimously approved. The motion to recommend approval of the use permit subject to the five conditions as amended was approved by a vote of 3-0 with 2 abstentions. After the planning board hearing Mr. Cummins met with the Chemical Dependency Board to discuss the planning board's staffing recommendation. The board opposes this condition because it will not make the recovery home project financially feasible. The grant received by the Flathead Valley Chemical Dependency Clinic has some flexibility for additional staffing but not enough to cover the cost to provide staffing on a 24 hour basis 7 days a week. A public hearing on this matter has been scheduled before the Planning Board for June 10, 2008 be ' g at 7.-00 PM, in the Kalispell city council chambers. The planning board will forward a recommendation to the Kalispell city council for final action. BACKGROUND IN'FORMA'T`ION: This facility will accommodate eight or fearer women and help theme recover from drug addictions. The facility falls under a special provision in the state statutes, Section 76-2-412, M. c.A., that give them a specific "residential" status. Because of this special status no conditions may be placed on the conditional use permit that would not otherwise apply to residences in general. Additionally, a conditional use permit for this facility cannot be denied by the governing body and the public hearing is intended as a forum for information and public comment. The Flathead Valley Chemical Dependency Clinic is requesting a conditional use permit to allow a women's recovery home facility serving eight or fewer women. The recovery facility will occupy the existing home at 87 Northern Lights Boulevard. Some interior remodeling to the house will be required and will include adding a kitchen and several rooms to the garage. Parking needs will be ' al as the women will not own cars. The goal of the recovery home is to bring in women who need a helping hand to get a fresh start on life. Women will learn life skills and attend group and individual counseling sessions at Flathead Valley Chemical Dependency Clinic. Between the hours of S a.m. and 9 p.m. there will be a recovery home coordinator and two half time case managers on -site to assist the women. The house common areas and entrances will be monitored 24 hours a day, seven days a week via a computer controlled system for security purposes. C. Existing Land Use and Zoning: The property is zoned R-3 , Urban Single --Family Residential, and is developed with a single family residence. D. Adjacent Land Uses and Zoning: The immediate area is characterized by single- family and apartment units on lots ranging from approximately 11,000 square feet to just over three acres. Relation to the Growth Policy: The current Kalispell City Growth Policy Map designates this area as urban residential, which provides the basis for the R--3, Urban Single Family Residential., zoning designation. Chapter 3, Policy 10 of the Growth Policy, states that single family homes are the primary housing types in the urban residential land use category. 2 F. Adequate w Useable Space: The property is 10,980 square feet in size and contains an existing house with an attached two car garage. 'There is adequate space on the site for the proposed structure, access and ' um parking requirements. b. Adequate Access: The property is accessed off of Northern Lights Boulevard, a 35 foot wide street. The existing access is adequate to serve the recovery home and its occupants. C. Environmental Constraints: There are no obvious environmental constraints apparent on the property. The site has a gentle slope to the south but would not hinder the proposed use of the property. 2. Appropriate Design. a. Parldng Scheme. As stated previously, the recovery home is considered a single family residential use per state law. The Kalispell Zoning Ordinance Section 27.26.050(27) requires two off-street parking spaces per single family residential home. The spaces must each be 9 feet by 20 feet in size. The Flathead Valley Chemical Dependency Clinic will be operating the recovery home and has informed the planning department that they will be converting the garage into living space. This will. remove the existing two off-street parking spaces. The distance between the garage doors and the street is approximately 42 feet, long enough to easily accommodate two off-street parking spaces. However, it is unclear where the property boundaries are located for the lot as no property pins were evident during a site inspection. The problem that arises is the zoning ordinance permits only one of the two required off-street parking spaces to count within the front setback. The front setback 'n the R 3 zoning district is 20 feet. Even with a distance of 42 feet from the garage door to the street, 3 depending on the location of the property boundary only one 9 foot by 20 foot space may count towards the off-street parking requirement. Fortunately, there seems to be a suitable area on the south side of the house, between the house and south property boundary, to locate a paved parking space to meet the requirements of the zoning ordinance. While it appears that there is adequate room for two off-street parking spaces in compliance with the above mentioned standards, there is not enough information to make that determination. To ensure compliance, the clinic will need to provide the planning department with a scaled drawing showing the lot boundaries and hour two off-street parking spaces would be provided that meet the zoning ordinance. Traffic Circulation: One to two staff vehicles will be present during the hours of 8 a.m. and 9 p.m. As stated previously, staff parking will be provided by the existing paved driveway. The use of the house as a recovery home is not expected to significantly alter current traffic circulation within the site and the neighborhood. C. Open Space: No specific open space requirements are required under the R--3 zoning district other than the required setbacks. d. Fencing/Screening/Landscaping: The around the rear yard. No impact is anticipated with the proposed use. b. Parks and Recreation: Hawthorn Parr is located immediately east of the recovery home. There should be no significant impact on the parks and recreation programs and facilities as a result of this use. C. Police: Police protection will be provided by the Kalispell Police Department. No unusual impacts or needs are anticipated from the proposed use. d. Fire Protection: Fire protection will be provided by the Kalispell Fire Department. No unusual impacts or needs are anticipated from the proposed use. e. water: City water currently serves the existing home. No significant impact on water services can be anticipated as a result of this facility. f. Sewer: Sewer service is currently provided by the City of Kalispell. No significant imp acts on pity sewer services can be anticipated as a result of the proposed use. g. Storm Water Drainage: There are currently no storm water drainage facilities in the area. h. Solid waste: Solid waste pick --up is provided by the City. This project will have no impact on current services. i. Roads: Northern Lights Boulevard serves as the access road to the recovery home. The street is in good condition.. 4. Neighborhood impacts: The recovery home will be located in a well -established urban residential area. Impacts to the neighborhood should be relatively insignificant as the women will be working and / or at counseling sessions during their stay at the recovery home. Traffic will be limited to the staff as most of the women will most likely not have access to a personal vehicle. To accommodate the women who will. stay M the home, the clinic will be remodeling the garage and turning it into living space. As part of their funding the clinic needs to provide kitchen facilities in the remodeled garage to comply with handicap accessibility requirements. The current kitchen located in the main part of the house is up a flight of stairs making access problematic for disabled women. Placing a second kitchen in the home creates the potential of a future home owner to convert the house into a duplex. However, the current zoning on the property is R-3, a single family residential district that prohibits duplexes as a permitted use. The 5 planning department recognizes the clinic's .need to provide equal access to kitchens for all clients of the recovery home. The planning department therefore recommends that if the recovery home is relocated in the future, the clinic or current operating agency remove the kitchen located in the garage. This will insure the continued single-family residential use of the house after the recovery home is gorse. 5. Consideration of historical use patterns and recent changes: This area has historically included residential and apartment housing with little change over the years. 6. Effects on property values: No significant negative impacts on property values are anticipated. As previously mentioned, the proposal is compatible with the neighborhood, will not create any adverse impacts with regard to noise or traffic and the use of a house as a recovery home will have little impact to surrounding neighbors. CO DIENTS FROM ADJACENT PROPERTY OWMRS The planning department has received two letters from adjacent property owners against the proposed recovery home. The adjacent property owners cite neighborhood safety, , staff not present 24 hours a day, and the recovery home being inappropriate in this community as reasons for the use permit to be denied. The letters are attached. The planning board and council cannot however deny the use permit based on Section 76--2--412, M.C.A. that gives there a specific "residential" status. RECOhOWNDATICN The staff recommends that the planning board adopt the staff report #KCU-08-02 as findings of fact and recommend to the Kalispell City Council that the Conditional Use Permit be approved subject to the following conditions: 1. I am a co-owner of 85 Northern Lights Boulevard, next to the proposed site. I don't feel that a facility of this kind should be put in a residential neighborhood. Currently I have three families, and three children living at this site. It is imperative that I provide my tenants, the opportunity to have a safe, peaceful, secure, and healthy environment. The planned facility would be located next to a park, where families Lorne, or send their children alone to play. How can any parent feel that their children are safe, next to a home where someone has to be monitored, or be watched by a security system? Another concern is that the facility would not have a staff member present 9-1 2 hours each day. None of us should have to have concerns for our safety, the safety of our children, our neighbors, or weather or not someone living within 150 feet is being monitored properly on a security system. As co-owner of one of the adjacent properties to the planned site, I have deep seated concerns regarding this project. I am a current medical professional, and in that capacity I have seen the ill effects of drug use on individuals as well as the communities that are infected. I have seen the inability of addicts to continue on the path to recovery, and what desperation leads to in these individuals; thus I am distressed. I believe that this facility will not be able to provide the necessary security to ensure that no negative impact will be felt in the neighborhood. Even if security is in place it is unlikely that the response would be quick enough to keep unfortunate events from. occurring. I feel that the proposal to place this facility in this quiet family based community is a poor idea. There are children who play frequently on the area playgrounds and I worry about the negative interactions that might take place. I have worked extremely hard to maintain a property that allows my tenants to live quietly and to feel safe in their homes. I want to continue to offer a quality property where my tenants can live peacefully and without fear for their children and what might happen in the neighborhood. The locations for these facilities must meet certain criteria. As ASAM 3.1 requires access to intensive treatment services for all, sites must have access to intensive outpatient treatment. In addition in order to adequately teach and practice like skills, all sites must have adequate employment opportunities for residents. The specific location of Kalispell has been identified as ASAM 3.1 for women. A specific location within the city limits of Kalispell has been identified as 87 Northern Lights Boulevard, Kalispell, Montana 59901. As of this preliminary application submittal a buy -sell has been agreed upon between the sellers and the Flathead Valley Chemical Dependency Center contingent upon approval of Community Facilities funding through Rural Development as well as the building inspection by both a Home Inspection Firm and a potential General Contractor that the home can be made handicapped accessible for the common living areas of the first level. Both of these inspections have been made and the home can be made handicapped accessible. The bids have been let and a contractor selected to do the remodeling. Arrangements have been made with Area on Aging's Eagle Transit System to have a permanent bus stop on Liberty Street which is just two lots away. FVCDC will also be purchasing transportation for the women to use in receiving treatment at the clinic (1/2 mile away) as well as reaching their employment sites when they progress to that level. The home is actually within walking distance of a food/drug market, the U.S. Post office, a hardware store and numerous restaurants during nice weather. The proposal submitted by Boyd Andrew Community Services for the proposed group home in Kalispell is based on the treatment model utilized at the Elkhorn Treatment Center in Boulder, as it is a 100 % match to the requirements of the RFP; all other facilities will offer a subset of the Elkhorn model. Elkhorn offers programming ten (10) hours per day 6 days a week for 9 months in a secure setting. It is not realistic to expect lower intensity setting to match the quantity of service. A presentation can be made, if requested, to discuss how Recovery Support Homes will differ when appropriate. BAGS will expect each Recovery Support Home subcontractor to follow the treatment model defined in this proposal. Each Recovery Support Home will be provided the same date rate. These day rates are based upon a uniform staffing at each facility of 1.5 case managers and .5 FTE Rehabilitation Aides, $2,000 per month housing costs, resident supplied food, 80 % recovery of the $12.00 per day rent charge and realistic census projections. BAC S will in essence provide a turnkey operation to subcontractors, which includes prograning, therapeutic materials and consultation, and all furniture and electronics. The day rates for the ASAM 3.5 services offered by Rim rock and Elkhorn ($208 and $125) are already established from pre-existing contracts with the State of Montana are not, therefore, presented in a justification in this process. 2 . Plan of the affected lot which identifies the following items: a. Surrounding land uses: The land surrounding the subject has multiple land uses. There is a park to the east, the lot to the south, lot to the west and lots to the north are single family residential. East of Hawthorn Ave is single family residential. To the southwest of the subject is a church parking lot and south of Liberty Street is low income housing. b. The site is relatively square. The west boundary (street) is 100 feet, the north boundary is 109.84 feet, the east boundary is 100 feet and the south boundary is 109.75 feet. c. The site is level to gently sloping to the south. d. The existing house is 1,262 square feet on the upper level and 624 square feet on the lower level with a 552 square foot built-in garage. The house sits 41 feet east of Northern Lights Boulevard. e . There is proposed interior remodeling that will not change the foot print of the house on the site. f. The current use of the house is a single family residential dwelling with a fenced back yard. g. The proposed use of the house is for a Women's Recovery Home Facility. The remodeling will not change the foot print of the house. h. The exterior landscape and fencing will not change. The backyard is currently fenced with cyclone fencing. The only addition will be an addition to the driveway on the south. An asphalt driveway will be installed for additional parking should it be needed. 3. Miscellaneous topics relative to the proposed use; a. Traffic flow and control; it is estimated that there will be limited traffic to the Recovery Horne since the majority of the women will not have a car. Traffic will be limited to the staff members Z to 3 trips a day. b. Access to and circulation within the property; access to the property will be off of Northern Lights Boulevard onto the driveway with no access to the rear of the site. c. off-street parking and loading; off-street parking will be the driveway in front of the house. d. Refuse and service areas; the refuse and service areas will remain the same as they are with single family residential. e. Utilities; the utilities will remain the same as they are with single family residential. f. Screening and buffering; there will be no additional screening or buffering added to the existing landscaping. g. Signs, yards and other open spaces; there will be no signs posted on the property and the yard will remain as it currently exists. h. Height, bulk and location of structures; the height, bulk and location of the house will not change. i. Location of proposed open space uses; these uses will be similar to single family residential. j . Hours and manner of operation; the Recovery House will be operated seven (7) days a week twenty-four hours a day. There will be staff on site 12 to 15 hours a day with the remaining hours monitored on a closed security system accessed by computer for monitoring purposes. k. Noise, light, dust, odors, fumes and vibration; there should be no more activity from the recovery house than a single family resident maybe even less activity. 4. The women that will be residing in the recovery house will be monitored 24/7 with a computer controlled monitoring system that can be picked up by computer at any time and any place to check on the activity in the house. The camera's will be in common areas only and not in bedrooms or bathrooms. They will be at exterior doorways to monitor who is corning and going and at what time as well as if an unwanted guest- comes . The women will be free to come and go at any time and some may end up with jobs during evening hours . The goal of the Recovery House is to bring in women who need a helping hand to get fresh start at life. Not only will the women be attending group meetings and individual counseling at Flathead Valley Chemical Dependence Clinic but will be assisted in doing many other aspects of everyday living that they never learn because of their addictions. There will be a woman or women on site from roughly eight (8) a.m. to nine (9) p.m. to assist with such items as; finding jobs, writing resumes, working with court and parole officers in some cases, grocery shopping and bill paying. There is to be a full time Recovery Home Coordination who will be on site and over see the full operations of the program. This will include any and everything that has to do with the running of the Recovery Home. There will be a half time Case Manager that will work with the women on their recovery and connect them with community services, such as; literacy, parenting classes and the like. There will be a half time Case Manager/Technician that will be an assistant to the Case Manager. These women will work staggered hours to give the Recovery Home the maximum assistance to the women in the home.
