BACKGROUND: The Kalispell city Planning Board met on December 11, 2007 and
held a public hearing to consider a request for a zone change from R-4 to B-1 on two
properties totaling 1.1 9 acres. The properties are located along the western side of
North Meridian Road, approximately 1/4 mile north of the intersection of Three Mile
Drive and North Meridian Road. Each property includes an existing house addressed
as 1270 and 1288 North Meridian Road. The properties requesting the zone change can
be legally described as Lots 19 and 20 of the Sinopah Subdivision located in Section 1,
Township 28 North, Range 22 west, P.M.M., Flathead County, Montana.
Sean Conrad, of the Kalispell Planning Department, presented staff report #KZC-07--02
providing details of the proposal and the evaluation. He noted that the proposed B-1
zoning district was compatible with surrounding land uses and also consistent with
the Growth Policy which identifies the land as urban mixed use. Staff recommended
the board consider approving the zone change based on this and other facts
determined in the findings of fact report.
No one spoke either for or against the zone change at the public hearing.
The board approved the requested zone change of 13--1 for the two properties. The vote
was unanimous.

REAL PROPERTY MORE PARTICULARLY DESCRIBED AS LOTS 19 AND 20 OF THE
SINOPAH SUBDIVISION LOCATED IN SECTION 1, TOWNSHIP 28 NORTH, RANGE 22
WEST, FLATHEAD COUNTY, MONTANA (PREVIOUSLY ZONED CITY R4, TWO

WHEREAS, Jeff and Karen Thiesen, the owners of the property described above, petitioned the
City of Kalispell that the zoning classification attached to the above described tract of
land be zoned B-1, Neighborhood Buffer District, on approximately 1.19 acres of
land, and
WHEREAS, the property is located on the west side of North Meridian Road approximately 114
mile north of the intersection of Three Mile Drive and North Meridian Road, and
WHEREAS, the petition of Jeff and Karen Thiesen was the subject of a report compiled by the
Kalispell Planning Department, Staff Report #KZC-07-2, in which the Kalispell
Planning Department evaluated the petition and recommended that the property as
described above be zoned B- 1, Neighborhood Buffer District, and
WHEREAS, the Kalispell City Planning Board held a Public Hearing on the matter on December
111 2007, and recommended that the zoning be City B-1, Neighborhood Buffer
District, and
WHEREAS, after considering all the evidence submitted on the proposal to zone the property as
described 13-1, Neighborhood Buffer District, the City Council finds such zoning to
be consistent with the Kalispell Growth Policy 2020 and adopts, based upon the
criterion set forth in Section 76-3-608, M.C.A., and State, Etc. v. Board of County
Commissioners, Etc. 590 P2d 602, the findings of fact of K_PD as set forth in Staff
Report No. KZC-07-2.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, AS FOLLOWS:
SECTION I. Section 27.02.010, of the Official Zoning Map of the Kalispell Zoning
Ordinance, (Ordinance No. 1460) is hereby amended by designating the
property described above as B-1, Neighborhood Buffer District on
approximately 1.19 acres.
SECTION II. The balance of Section 27.02.010, Official Zoning Map, City of Kalispell
Zoning Ordinance not amended hereby shall remain in full force and effect.
SECTION III. This Ordinance shall take effect from and after 30 days of its passage by
the City Council.

This is a report to the Kalispell City Planning Board and the Kalispell City Council
regarding a zone change for approximately 1.19 acres from R_4 to B--1. A public
hearing has been scheduled before the Kalispell City Planning Board on December 11,
2007 beginning at 7:00 PM, to consider the zone change request. The Planning Board
will forward a recommendation to the Kalispell City Council for consideration..
BACKGROUND INFORMATION: The owners are proposing to amend the Official
Kalispell Zoning Map on two lots from the existing R-4, a Two -Family Residential
zoning district, to B-1, a Neighborhood Buffer District. This report evaluates the zone
change request in accordance with Section 27.30.020 of the Kalispell Zoning
Ordinance.

B. Location and Legal Description of Property: The properties proposed for
rezoning he along the western side of North Meridian Road, approximately 1/4 mile
north of the intersection of Three Mile Drive and North Meridian Road. The
combined acreage of the lots equal approximately 1.19 acres and can be
described as Lots 19 and 20 of the Sinopah Subdivision located in Section 1,
Township 28 North, Range 22 West, P.M.M., Flathead County, Montana.
C. Existing zoning: The property is within city limits and is currently zoned R-4,
Two -Family Residential. The intent of the R-4 zoning district is to provide for a
residential district with minimum lot areas in which two-family dwellings are
permitted on each lot. The minimum lot size in the R--4 zoning district is 6,000
square feet.
D. Proposed Zoning: City Br-1, Neighborhood Suffer District, has been proposed
for the property. The B-1 zoning district allows certain commercial and
professional office uses where such uses are compatible with the adjacent
residential areas. The minimum lot size for the district is 7,000 square feet and the
minimum lot width is 60 feet. Setbacks in the front are 20 feet; in the rear are 20
feet; and on the sides are S feet.
E. E7isting Land Use: Currently the properties are developed, each with a single
family residence. The addresses for the homes are 1270 and 1288 North Meridian
Road.
�. Adjacent Land Uses and Zoning: The immediate area can be characterized as
commercial along North. Meridian Road. There is B-1 zoning immediately north of
the project site however the B--1 zoned properties are currently vacant. Across the
street on the east side of North Meridian Road are commercial businesses in the B-
2 zoning district. South of the project site is a combination of residential and
commercial land uses with their respective zoning districts of R-4, R.-3, P-1, and B-
l.
North:

G. General Land Use Character: The character along North Meridian Road is
predominately commercial with limited amounts of residential development.
Immediately east of the project site are tire and aligrunent shops. North of the
project site, professional offices exist such as a chiropractic office. South of the
project site near the intersection of Three Mile Drive and. North Meridian road are
Centurytel and UPS central offices for the area. Although there is some residential
development south of the project site these areas will most likely develop into
commercial uses over the next several years as the land uses along this section of
North Meridian Road are predominately commercial businesses.

H. Availability of Public Services and Extension of Services: water and sewer
services are located within the right-of-way along North Meridian Road in front of
this property and would only require service connections to provide service to the
property.
EVALUATION BASED ON STATUTORY CRITERIA
The statutory basis for reviewing a change in zoning is set forth by 76--2-205, M.C.A.
Findings of fact for the zone change request are discussed relative to the itemized
d
criteria described by 76-2-203, M. C.A.
1. Does the requested zone comply with thegrowth- ohc ?
The property is designated by the Kalispell Growth Policy 2020 as "Urban Mixed
Use Area" which encourages the development of compact, centrally located
services and employment areas that provide easy connections between existing
commercial and residential neighborhoods. Section 7.d of chapter 4 of the
growth policy also recommends creating a gradual transition into the residential
neighborhoods by encouraging multi -family, offices, and other compatible uses
as a transition tool with sensitivity to compatible design.
The Kalispell zoning ordinance, section 27.13.010, states the intent of the B-1
zoning district is to provide certain commercial and professional office uses
where such uses are compatible with the adjacent residential areas. The B- 1
district is intended to serve as a buffer between residential areas and other
commercial districts. The B-1 zoning district is not intended for those
businesses that require the outdoor display, sale and/or storage of
merchandise, outdoor services or operations to accommodate large-scale
commercial operations.
Based on the policies regarding Urban Mixed Use Areas in the Kalispell Growth
Policy and the purpose of the B--1 zoning district, the B--1 district is consistent
with the growth policy and the current land use designation on the properties.
2. is the reguested zone designed to lessen congestion in the streets?
The uses allowed under the proposed B-1 may potentially generate more traffic
than those allowed under the existing R-4 zoning. However, North Meridian
Road is a minor arterial and has recently been upgraded by the Montana
Department of Transportation to handle additional traffic. The additional traffic
generated as a result of this zone change would be insignificant due to the
small size of the lots included in the zone change and the limited retail uses
permitted within the B-1 zoning district. with North Meridian Road providing
access to the project site, congestion in the surrounding streets will be lessened
as the roadway would be capable of adequately serving additional traffic
generated within a business zoning district.
Will the requested zone secure safety from fire panic, and other dangers?
Adequate access and public facilities are available to the site in the case of an
emergency. There are no features related to the property which would
compromise the safety of the public. New construction will be required to be in
compliance with the building safety codes of the City which relate to fire and
building safety. All municipal services including police and fire protection., water
and sewer service is available to the property and will be utilized at the time
another lot is created in the future.
4. will the requested zone promote the health and general welfare?
The requested zoning classification wiU promote the health and general welfare
by restricting land uses to those which would be compatible with the adjoining
properties and provides a place for mixed uses in the community.
Will the requested zone provide for adequate light and. air?
Setback, height, and coverage standards for development occurring on this site
are established in the Kalispell zoning ordinance to insure adequate light and air
is provided.
6. Will the re uested zone prevent the overcrowding of land?
As previously noted, this area has been anticipated for mixed use development
and since public water and sewer are available to the area the B--1 zoning
designation is appropriate. The anticipated uses within the Urban Mixed Use
designation in the growth policy fall within those permitted and conditionally
permitted in the proposed B-1 zoning designation. All public services and
facilities will be available to serve this property. An overcrowding of land would
occur if infrastructure were inadequate to accommodate the development in the
area. This is not the case.
7. Will the reguested zone avoid undue concentration of people?
Minimum lot standards and use standards will avoid the undue concentration of
people at the tiaae the property is further developed.
8. will the requested zone facilitate the aade uate provision of transportation, grater.
sewerage, schoolsparks,_and other ublic requirements?
All public services and facilities are currently available or can be provided to the
property. Development should be encouraged in areas where these services are
available.
9. Does the requested zone nve consideration to the particular suitabiliof the
property for particular uses?
The proposed B-1 zoning district is consistent with the existing and anticipated
Tana. uses in the area and gives due consideration of the suitability of the
properties for the permitted uses in the district.

Lot 19 of the Sinopah Subdivision is located on the south facing slope of a small
bill. There are slopes north of the existing house on the property that vary
between 10 and 15 percent. The existing house is cut into this hill, establishing
a building pad with parking for the house in the rear. A future office or retail
store could locate on this property however the scale of the conamercial or office
budding may be limited due to the topography on the site and the need to
address both on --site parking and provide for adequate storm grater drainage.

10. Does the re nested zone 've reasonable consideration to the character of the
district?
The general character of the area to the north and east is urban sized lots with
commercial and professional office development. The same type of development
can be anticipated to occur on the properties included in the zone change request
and will be consistent with the character of the district.
11. Will the roposed^zone conserve the value of buildings r

properties in the area..
1 2 . Will the re uested zone encoura e the most appropriate use of the land
throughout the municip9ty?
Urban scale commercial or residential development should be encouraged in
areas were services and facilities are available such as is being proposed on this
parcel.. The proposed zoning is consistent with the roaster plan and surrounding
zoning in the area.
RECOMMENDATION.
Staff recommends that the Kalispell City Planning Board and zoning Commission adopt
the findings in Staff Report #KZC-07-2 and recommend to the Kalispell City Council
that the initial zoning for this property be changed to B--1, Neighborhood Buffer District.

Although the houses are addressed off of Three Mile Drive the properties are located
at the northern end of Meadows Lane, which connects to Three Mile Drive
approximately one-fourth mile west of the intersection of Three Mile Drive and
Stillwater Road. The project site is south of Quarter Horse Estates and Spring Creek
defines the western boundary. The owner is also requesting preliminary plat approval
