BACKGROUND:* The Kalispell City Planning Board met on January 8, 2008 and held
a public hearing to consider a request for a zone change from R-3 (Urban Single
Family Residential) to R-5 (Residential/ Professional Office) for two lots that encompass
32,167 square feet along Meridian Road. The properties proposed for rezoning he
along the western side of North Meridian Road, approyimately 100 feet south of the
intersection of Three Mile Drive and North Meridian Road. The property addresses for
the two lots are 1080 and 1086 North Meridian Road and can be legally described as
Lot 2 and Lot 3 of the Adams Addition located in Section 12, Township 28 North,
Range 22 west, P.M. M. , Flathead County, Montana.
Nicole C. Johnson, of the Kalispell Planning Department, presented staff report #KZC-
07-03 providing details of the proposal and the evaluation. She noted that the
proposed R-5 zoning district was compatible with surrounding land uses and also
consistent with the Growth Policy which identifies the land as urban 1 ed use. Staff
recommended the board consider approving the zone change based on this and other
facts determined in the findings of fact report.
No one spoke either for or against the zone change at the public hearing.
The board approved the requested zone change of R-5 for the two properties with a
unanimous vote.
RECOMMENDATION.* A motion to approve the zone change request would be in
order.
FISCAL EFFECTS: Positive impacts once fully developed.
ALTERNATIVES: As suggested by the City council.

REAL PROPERTY MORE PARTICULARLY DESCRIBED AS LOTS 2 AND 3 OF THE
ADAMS ADDITION LOCATED IN SECTION 12, TOWNSHIP 28 NORTH, RANGE 22
WEST, FLATHEAD COUNTY, MONTANA (PREVIOUSLY ZONED CITY R-3, URBAN

WHEREAS, Sandra Aderholt, the owner of the property described above, petitioned the City of
Kalispell that the zoning classification attached to the above described tract of land
be zoned R-5, Residential/Professional Office, on approximately 32,167 square feet
of land, and
WHEREAS, the property is located on the west side of North Meridian Road approximately 100
feet south of the intersection of Three Mile Drive and North Meridian Road, and
WHEREAS, the petition of Sandra Aderholt was the subject of a report compiled by the Kalispell
Planning Department, Staff Report #KZC-07-3, in which the Kalispell Planning
Department evaluated the petition and recommended that the property as described
above be zoned R-5, Residential/Professional Office, and
WHEREAS, the Kalispell City Planning Board held a Public hearing on the matter on January 8,
2008, and recommended that the zoning be City R-5, Residential/Professional Office,
and
WHEREAS, after considering all the evidence submitted on the proposal to zone the property as
described R-5, Residential/Professional Office, the City Council finds such zoning to
be consistent with the Kalispell Growth Policy 2020 and adopts, based upon the
criterion set forth in Section 76-3-608, M.C.A., and State, Etc. v. Board of County
Commissioners, Etc. 590 P2d 602, the findings of fact of KPD as set forth in Staff
Report No. KZC-07-3.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, AS FOLLOWS:
SECTION I. Section 27.02.010, of the Official zoning Map of the Kalispell zoning
Ordinance, (Ordinance No. 1460) is hereby amended by designating the
property described above as R-5, Residential/Professional Office on
approximately 32,167 square feet of land.
SECTION II. The balance of Section 27.02.010, Official Zoning Map, City of Kalispell
Zoning Ordinance not amended hereby shall remain in full force and effect.
SECTION III. This Ordinance shall take effect from and after 30 days of its passage by
the City Council.

regarding a zone change for two lots just over a half acre in size from R--3 to R--5. A
public hearing has been scheduled before the Kalispell City Planning Board on
January S, 2008 beginning at 7.-00 PM, to consider the zone change request. The

B. Location, Size and Legal Description of Property: The properties proposed
for rezoning lie along the western side of North Meridian Road, approximately 100

C. Existing zoning. The property is within city limits and is currently zoned R--3,
Urban Single -Family Residential. The intent of the R-3 zoning district is t0 pro -ride
for an urban residential district 4vith =' 'nimum lot areas of 7,000 square feet in
size where single family homes are perrmtted.
D. Proposed Zoning: City R-S, Residential f Professional Office, has been
proposed for the property. This district permits low intensity professional offices
that are architecturally harmonious with adjacent residential structures. The
district is intended to be a buffer between residential areas and other commercial
districts. The rninimum lot size for the district is 7,1000 square feet and the
minimum lot width is 70 feet. Setbacks in the front are 1 15) feet; in the rear are 10
feet; and on the sides are S feet.
E. Existing Land Use: Currently the properties are developed, each with a single
family residence and detached garage. The addresses for the homes are 1080 and
1086 North Meridian Road.
P. Adjacent Land Uses and Zoning. The area surrounding the subject property
includes a variety of land uses including residential, professional office, and retail.
There is B-1 Zoning irnmediately north of the project site where the professional
offices known as the Glacier Centre exists. Across the street on the east side of
North Mex ' dian Road is a Conoco gas station, vacant land and residential
dwellings. The zoning across meridian Road includes B-1, R-3 and 1 -- districts.
South of the project site is R-S zoning with residential and commerclal
development.

G. General Land Use Character: The character along North Meridian Road is
predominately commercial with limited amounts of residential development. The
existing residential areas like this one will most likely develop into commercial uses
over the next several years. North Meridian Road, a minor arterial, has been
constructed to accommodate this type of development.
H. Availability of Public Services and Extension of Services: water and sewer
services are located within the right -of -moray along North Meridian road and
currently serve both properties.
EVALUATION BASED ON STATUTORY CRITERIA
The statutory basis for reviewing a change ire zoning is set forth by 76-2-205, M.C.A.
Findings of fact for the zone change request are discussed relative to the itemized
criteria described by 76-2--203, M.C.A.
1. Does the re uested zone comply with the uowth ❑licv?
The property is designated by the Kalispell Growth Policy 2020 as "Urban Mixed
Use Area" which encourages the development of compact, centrally located
services and employment areas that provide easy connections between existing
commercial and residential : ,-eighborhoods. Section. 7.d of chapter 4 of the
growth policy also recommends creating a gradual transition into the residential
neighborhoods by encouraging multi --family, offices, and other compatible uses
as a transition tool with sensitivity to compatible design.
The Kalispell zoning Ordinance, section 27.08.010, states the intent of the R--5
zoning district is to accommodate professional offices where it is not deemed
desirable to permit a more intensive business activity of a retail nature. These
office structures need not be commercial in appearance; they shall be
architecturally harmonious with the adjacent residential structures. such a
district should serve as a buffer between residential areas and other commercial
districts and should be associated with arterial or minor arterial streets.
Lased on the policies regarding Urban Mixed Use Areas in the Kalispell Growth
Policy and the purpose of the proposed zoning district, the R-5 district is
consistent with the growth policy and the current land use designation on the
properties.

The uses allowed under the proposed R-5 may potentially generate more traffic
than those allowed under the existing R--3 zoning. However, North Meridian
Road is a minor arterial and has recently been upgraded by the Montana
Department of Transportation to handle additional traffic. The additional traffic
generated as a result of this zone change would be insignificant due to the
small size of the lots and the limited professional office and residential uses
permitted within the R-5 zoning district. with North Meridian Road providing

lessened. The roadway would be capable of adequately serving additional traffic
generated from the residential /professional office district.
Will the requested zone secure safety from fire anic and other dangers?
Adequate access and public facilities are available to the site in the case of an
emergency. There are no features related to the property which would
compromise the safety of the public. New construction will be required to be in
compliance with the building safety codes of the City which relate to fire and
building safety. All municipal services including police and fire protection., water
and sewer service is available to the property and will be utilized.
Will the reguested zone romote the health and general welfare?
The requested zoning classification will promote the health and general welfare
by restricting land uses to those which would be compatible with the adjoining
properties and provides a place for mixed uses in the community.
Will the requested zone rovide for ade uate light and air?
Setback, height, and coverage standards for development occurring on this site
are established in the kalispell zoning ordinance to insure adequate light and air
is provided.
Will the requested zone_prevent the overcrowding of land?
As previously noted, this area has been anticipated for mixed use development

Road has become increasingly business oriented and acts as a buffer between
adjacent residential areas.
There are no limitations on the two lots with both sites being level. New
construction would be required to be architecturally harmonious with ad j acent
residential structures and all zoning regulations, building codes and fire codes
need to be complied with.
10. Does the re uested zone a-ive reasonable consideration to the character of the
district?
The general character of the area to the north and south is urban sized lots with
commercial and professional office development. Residential uses exist to the
west and east across North Meridian Road. However, these lots have been
increasingly used for commercial or office development. The same type of
development can be anticipated to occur on the properties included in the zone
change request and will be consistent with the character of the district.
11. Will the ro osed zone conserve the value of buildin s?
Value of the buildings in the area will be conserved because the R.-5 zoning will
promote compatible and like uses on this property as are found on other
properties in the area. Any structures are required to be architecturally
harmonious with adjacent residential structures.
12. Will the re uested zone encoura e the most appropriate use of the land
throughout the munucip ality?
Urban scale commercial or residential development should be encouraged in
areas were services and facilities are available such as is being proposed on this
parcel. The proposed zoning is consistent with the growth policy and
surrounding zoning in the area.

The regular meeting of the Kalispell city Planning Board and zoning commission is
scheduled for Tuesday, January 8, 2008 beginning at ' :00 PM in the Kalispell city council
Chambers, Kalispell City Hall, 312 First Avenue East, Kalispell. The planning board will hold
public hearings and take public comments on the following agenda items. The Board will
make a recommendation to the Kalispell city Council who will take final action.
1. A proposal to adopt the Kalispell Area Transportation Plan 2006 Update as an
addendum to the Kalispell Growth Policy to serve as a guiding policy for
transportation decisions. This plan will serve to update and replace the existing
Kalispell Transportation Plan last updated in 1993. The Transportation Plan
addresses the city plus an area up to 3 miles beyond the city limits of Kalispell. It
provides an analysis of existing transportation conditions, transportation demand
forecasting, a discussion of alternative travel modes within the area and identification
of specific problem areas relative to crash occurrences, intersection capacities, and
street corridor capacities. The plan also includes recommendations for travel demand
management and traffic calming techniques and provides a series of
recommendations for improvements to the transportation system including short
term management changes, major street system improvements and miscellaneous
upgrades to the existing transportation system. The plan concludes with a financial
analysis for implementing the plan.
2. A request from Sandra Aderholt for a zone change from city R-3 (Single Family
Residential) to City R- 5 (Residential / Professional office) for two lots in the Adams
Addition of Kalispell. The land encompasses roughly 32,000 square feet and is
located along North Meridian Road approximately 100 feet south of the intersection
with Three Mile Drive. The property addresses include 1080 and 1086 North
Meridian Road and can be legally described as Lot 2 and Lot 3 of the Adams Addition
located in Section 12, Township 28 North, Range 22 west, P.M.M., Flathead County,
Montana.
3. A request by the city of Kalispell to amend the Kalispell Subdivision Regulations to
address recent legislative changes in the subdivision and platting act. Section. 3.193
and Appendix D were corrected to require parkland dedication for minor subdivisions.
In addition, references to the Countywide Administrative Board were changed to
reflect the current regulatory body, the Kalispell City Council. The document was
also updated to correct references to the Uniform Fire Code which has been replace
with the 2006 edition of the International Fire Code per Ordinance 1617.

The regular meeting of
the Kalispell City Plan-
ning Board and Zoning
Commission is sched-
uled for Tuesday, Janu-
ary 8, 2008 beginning at
7:00 PM in the Kalispell
City Council Chambers,
Kalispell City Hail, 312
First Avenue East, Ka-
lispell. The planning
board will hold public
hearings and take public
comments on the follow-
ing agenda items. The
Board will make a rec-
ommendation to the Ka-
lispell City Council who
will take final action.
1. A proposal to adopt
the Kalispell . Area
Transportation Plan
2,006 Update as an ad-
dendum to the Kalispell
Growth Policy to serve
as a guiding policy for
transportation decisions.
This plan will serve to
update and replace the
existing Kalispell Trans-
portation Plan last up-
dated in 1993. The
Transportation Plan ad-
dresses the city plus an
area up to 3 miles be-
yond the city limits of
Kalispell. It provides an
analysis of existing
transportation condi-
tions, transportation de-
mand forecasting, a dis-
cussion of alternative
travel ;nodes within the
area and identification
of specific problem
areas relative to crash
occurrences, intersec-
tion capacities, and
street corridor capaci-
ties.. The plan also in-
riudes recommenda-
tions for travel demand
management and traffic
calmna techniques and
provides a series of rec-
ommendations for im-
orovements to the trans-
portation system includ-
ing ,;h=-};l term manage-
ment changes, mal'or
street system improve -
is ents and miscellane-
ous upgrades to the ex -
sting transportation uys-

passes ; oughly 32,000
square feet and is iocat-
ed along North ivleridian
Road approximately 100
feet south of the inter-
section with Three Mile
Drive. The property ad-
dresses include 1080
and 1086 North Meridi-
an Road and can be le-
gally described as Lot 2
and Lot 3 of the Adams
Addition located in Sec-
tion 12. Township 28
North, Range 22 West,
P.M.M., Flathead Coun-
ty, Montana.
3. A request by the
City at Kalispell to
amend the Kalispell
Subdivision Regulations
to address recent legis-
lative changes in the
subdivision and platting
act. Section 3.19. B and
Appendix D were cor-
rected to require park-
land dedication for mi-
nor subdivisions. In ad-
dition, references to the
Countywide Administra-
tive - Board were
changed to reflect the
current regulatory body,
the Kalispell City Coun-
cil. The document was
also updated to correct
references to the Uni-
form Fire Code which
has been replaced with
the 2006 edition of the
International Fire Code
per Ordinance 1617,

tion at the Kalispell
Planning Department,

ble for public review
during regular office
hours,
