BACKGROUND: The Kalispell city Planning Board met on July 8, 2008 and held a public
hearing to consider a request for annexation and an initial zoning designation of R-4, Two --

west side of Meridian Road between 5th and 6th streets west just north of the Foys Fake Road
bend. The property is addressed 610 South Meridian Road and can be legally described as
Tract 7ABBB located in Section 13, Township 28, Range 22, P.M.M., Flathead county,
Montana.
Tom Jentz, Kalispell Planning Director, presented staff report # KA-08-04 providing details of
the proposal and the evaluation. He noted that the proposed R-4 zoning district was
compatible with surrounding land uses. Staff recommended the board consider approving the
initial zoning based on this and other facts determined in the findings of fact report.
No one wished to speak at the public hearing and the board approved the requested initial
zoning of R-4, Two -Family Residential, for the property upon annexation to the City of
Kalispell. The vote was unanimous.
RECOMMENDATION: A motion to approve the resolution annexing the property and a
motion to approve the first reading of the ordinance for initial zoning of R-4, Two -Family
Residential, would be in order.
FISCAL EFFECTS: Minor positive impacts once fully developed.
ALTERNATIVES: As suggested by the City council.

BACKGROUND: This is a cost of services analysis based on a request to annex the subject
property. The 20,000 square foot property is located on the west side of Meridian Road between 5th
and 6th streets West just north of the Foys bake Road bend. The property address is 610 South
Meridian Road and can be legally described as Tract 7ABBB located within Section. 13, Township
28, Range 22, P.M.M., Flathead county, Montana.
Once annexed to the city, full city services will, be made available to the property owner. Note that only
a connection to water has been requested at this time. A cost of services analysis is provided in the
attached Exhibit A which details the anticipated costs to the city, revenues from assessments and
taxes and impact fees associated with the property should the Council wish to annex it into the
city. These numbers are based on a variety of assumptions and the information should only be
used as a general. estimate. A complete and accurate calculation will be completed at the time a
connection to water and sewer is requested and/or a building permit is applied for as the necessary
information would be available at that time.
CONCLUSIONS: cost of services for this annexation is estimated to be $1,512. Approximately
$ 1,269 will be generated from assessments and taxes and a one time impact fee for water, police
and fire is estimated to be $2,731. Based on these estimated figures, the annexation would cost
the city $240. However, this figure does not reflect the city services, like police and fire, and road
infrastructure that are already being provided to the property due to its proximity to the city
boundary at no cost. Annexation of the property would recoup some of those costs and overall.

A report to the Kalispell City Planning Board and the Kalispell City Council regarding
an initial zoning designation of R-4 upon annexation to the City of Kalispell. A public
hearing has been scheduled before the Kalispell City Planning Board for July 8, 2008
beginning at 7:00 PM, to consider appropriate zoning for the property to be annexed.
The planning board will forward a recommendation to the Kalispell City Council for
consideration.
BACKGROUND INFORMATION
The applicant has petitioned for annexation and an initial zoning designation of R--4, a
two-family residential district, on an existing lot appro=* ately one-half acre in size.
Mr. Tonkinson was previously using water from wild Geese Gardens to water his lawn.
Unfortunately, the commercial business can no longer provide him with water. Mr.
Tonkinson is now requesting to connect to the city water main within the Meridian
right-of-way to water his lawn and to do so his property needs to be annexed into the
City of Kalispell. This report evaluates the appropriate assignment of a City zoning
classification in accordance with Section. 27.03.010(4) of the Kalispell Zoning
Ordinance. This property will be annexed under the provisions of Sections 7-2-4601
through 7-2--4610, M. C.A. , Annexation by Petition.

A. Location and Legal Description of Property: The property proposed for
annexation and initial zoning is located on the west side of Meridian Road
approximately 200 feet south of Fifth Avenue west and 250 feet north of the Foys
Labe Road curve. The property address is 610 Meridian Road and is just east of
Wild Geese Gardens. The property can be legally described as Tract 7ABBB
located within Section 13, Township 28, Range 22, P.M.M., Flathead County,
Montana.

B. Size: The area proposed for annexation and zoning contains approximately
2 0, 000 square feet.
C. Existing Land Use and Zoning: The half acre property is currently developed
and contains a large prefabricated budding approximately 20 feet by 50 feet in
size, two covered storage areas each 12 by 24 feet in size and a metal shed
approximately 12 feet by 12 feet in size. There are a number of mature pine trees
on the property and a grass lawn.
The property proposed for annexation is zoned in Flathead County as R--1,
Suburban Residential. The district is intended "to provide estate -type
development" in rural areas located away from concentrated urban development.
These low density developments typically utilize wells and septic systems.
Permitted uses include agriculture, nurseries, single family homes, parks,
livestock, stables, etc. as well as a number of conditional uses that require a
permit. The minimum lot size requirement in the R--1 zoning district is 1 acre.
D. Proposed Zoning: The proposed City R--4, Two -Family Residential, zone allows
single-family and two -unit duplex dwellings. Shops, garages and sheds are
generally considered accessory and permitted in the zone given the structures
meet the property development standards outlined in the zoning code. R-4
requires that lots be at a minimum 6,000 square feet in size with a minimum lot
width of 50 feet. Setbacks are as follows:

Maximum building height is 35 feet and permitted lot coverage is 45 percent.
The proposed zoning would continue the existing city R-4 zoning across Meridian
Road to the east and to the north.
E. Adjacent Land Uses and ?roving: The area proposed for annexation is on the
boundary of the City of Kalispell and currently contains a mix of land uses. To
the east, there are primarily single family and two --family dwellings that exist on
tract land. wild Geese Gardens occupy the area to the west along with some
other rural and residential land uses. Residential land uses also exist to the
north as well as businesses. To the south, larger rural tracts of land are bisected
by the meandering Ashley Creep. The proposed US 93 Bypass is planned to be
located on the other side of the railroad tracks to the wrest.
North: City Rr-4, Two -Family Residential, zoning
South.: County R--1, Suburban Residential, zoning
Bast: City R--4, Two -Family Residential, zoning
West: County R-1, Suburban. Residential, zoning; BNSF railroad;
F. General Land Use Character: The general land use character of this area is
mixed commercial and small and large lots with residential and multi -family
buildings. As the city grows, these rural, agrarian and industrial lands begin to
transform and this is the case for this area. The area can be described as

primarily residential with some commercial uses along the old railroad line Like
Wild Geese Gardens.

G. Utilities and Public Services: All available public services and facilities would
be available to the owner. A crater main can be accessed from the Meridian Road
right-of-way where stormwater drains are also located. The owner does not
intend to connect to sewer at this time. However, should he decide to do so in
the future, the closest main is between Fourth Avenue west and Fifth Avenue
West approximately 400 feet north of the property.

I. EVALUATION BASED ON STATUTORY CRITERIA
The statutory basis for reviewing a change in zoning is set forth by 76-2-303,
M.C.A. Findings of fact for the zone change request are discussed relative to the
itemized criteria described by 76-2--304, M. C.A. and Section 27.30.020, Kalispell
Zoning ordinance.
1. Does the requested zone comply with the aowth -policy?
Policy 1, Chapter 1 of the Kalispell Growth Policy directs the use of the growth
policy as a guide for development within the city. The existing land uses,
surrounding growth policy designations and past council actions on the
appropriateness of land use make an R--4 zoning designation consistent with the
growth policy's guidelines.
The property is located in a transition area between industrial and urban
residential. The property generally to the north is urban residential. The
property east across Meridian is urban. residential. The property in question
along with the abutting properties to the west and south are shown on the edge
of the industrial classification. As discussed by the council last fall, this
industrial designation is an old hold over from the days when the railroad was
active to the merest and the O Neil mill site was an active lumber yard. Both those
facilities are now gone and the overriding character of the area is residential. we
will be working with the general neighborhood in the next year to re-classify this
land to a residential or mixed use designation, much as we did with the Turner
property last fall with the willow Creek project.
2. Is the requested zone designed to lessen con gestion in the streets?
No changes to the property are currently proposed.. There is one access from.
Meridian Road for the entire property. Should the property be developed in the
future, any plans would be required to ,meet city standards. In that case, traffic
in the area would increase from the existing use, but insignificantly. The
requested zoning designation and potential development of the site will not lessen
congestion in the streets in the area, but this level and type of development is
anticipated to occur as development of the area continues. At some point,
Meridian Road will need to be improved.
3. Will the requested zone secure safety from fire, panic, and other dangers?
Adequate access and public facilities are available to the site in the case of an
emergency. There are no features related to the property which would
compromise the safety of the public. All municipal services including police and
fire protection, water and sewer service is available to the area or will be extended
as part of the development of this property. There is an existing city hydrant on
the northeast corner of Meridian Road and Sixth Avenue west. Upon inspection
by the fire department, it was determined the existing hydrant could serve the lot
requesting annexation if a fire were to break out on the property.

4. Will the requested zone promote the health and general welfare?
The requested zoning classification will promote the health and general welfare
by restricting land uses to those that would be compatible with the adjoining
properties and providing a place for new housing m' the community.
5. will the reguested zone provide for a.de u.ate light and air?
No further development of the property is proposed at this time. However, should
the lot be developed at some point in the future, setback, height, and lot coverage
standards for development occurring on this site are established in the Kalispell
Zoning Ordinance to insure adequate light and air is provided.
6. will the re uested zone revent the overcrowding of land?
Currently this property is in the county jurisdiction and is zoned R--1, Rural
Residential. The proposed R-4 zoning designation would increase densities from
what exists on the lot, but future development would be consistent with the
existing and future planned developments surrounding the property. Water and
sewer lines are located within the Meridian Road right-of-way making city
densities and the proposed R--4 zoning designation appropriate. All public
services and facilities will be available. The zone is not expected to overcrowd the
land.
7. will the requested zone avoid undue concen.trati.on of people?
The allowable density for this property is greater than the County's R--1, Rural
Residential zone. While no development or subdivision plans were disclosed, the
R-4 zoning would allow the 20,000 square foot lot to be subdivided into three lots
given all zoning and subdivision requirements could be met. MirumuM lot
development standards of the R-4 zoning district will prevent the undue
concentration of people should the property be developed.
8. will the requested zone facilitate the adequate provision of trans ortation water,
sewerage, schools arks and other public requirements?
All public services and facilities are currently available or can be provided to the
property. Development is encouraged in areas where these services are available.
9. Does the requested zone give consideration to the particular suitability of the
roe for particular uses?
The proposed R-4 zoning district is consistent with the surrounding zoning and
land uses in the area. The R--4 zone also gives due consideration of the
suitability of this property for the permitted uses in the zoning district.
10. Does the requested zone gLve reasonable consideration to the character of the
district?
The general character of the area is urban scale residential development with
existing rural and industrial lots to the west and south of the project site. By

assigning the property with the R-4 zoning district the development of this
property will be consistent with the current trend of a neighborhood transitioning
to urban residential.
11. will the proposed zone conserve the value of buildings?
Value of the buildings in the area will be conserved because the R--4 zoning will
promote compatible and Nike uses on this property as are found on other
properties in the area.
12. will the re nested zone encourage the most appropriate use of the land
throughout the rnunici ali ?
Urban scale residential development should be encouraged in areas where
services and facilities are available. In this case water and sewer lines are
located in. the Meridian Road right-of-way. The proposed zoning is consistent
with the majority of land uses and urban residential development in the area.
Although. the Growth Policy identifies an industrial land use plan for this area,
residential development would be better suited for the area due to its proximity to
the city's urban core and the changing character of the area.
RECOMMENDATION
It is recommended that the Kalispell City Planning Board and Zoning Commission. adopt
Staff Report #KA-08-04 as findings of fact and recommend to the Kalispell City Council
that the initial zoning for this property upon annexation. be R--4, Two -Family Residential.

The regular meeting of the Kalispell city Planning Board and Zoning Commission is
scheduled for Tuesday, July 8, 2008 beginning at 7:00 PM in the *NEW* Kalispell City
Council Chambers, Kalispell City Ball, 201 First Avenue East, Kalispell. The planning
board will hold public hearings and take public comments on the following agenda items. The
Board will make a recommendation to the Kalispell City Council who will take final action.
1. A request from Tom Tonkinson for annexation and initial zoning designation of R-4
(Two -Family Residential) on an existing lot approximately one-half acre in size.
The property is currently developed and contains a prefabricated building, two
covered storage areas and a metal shed. Mr. Tonkinson is interested in connecting
to municipal services to water his lawn and the mature pine trees on the lot. The
property is located on the merest side of Meridian Road approximately 200 feet south
of Fifth. Avenue west and 250 feet north of the Foys Lake Road curve. The address
is 610 South Meridian Road and can be legally described as Tract 7ABBB located
within Section 13, Township 28, Range 22, P.M.M., Flathead County, Montana.
2. A request from Northwest Healthcare corporation for a conditional use permit to
locate the Kid Kare program, a day care center for infants and toddlers under the
age of two, in the north half of the building located at 200 Conway Drive. The
building sits on top of the hill in the northeast corner of the US 93 and Conway
Drive intersection and is part of the H-1 (Healthcare) zoning district. with the
exception of a play area fence and business signs, changes will be primarily to the
interior of the building. The property can be legally described as Lot 1,
