I am writing to you today to again ask you to evaluate this project and ensure that your staff is aggressively pursuing the installation of a traffic signal on US Highway 93 at the intersection of Kelly Road. City records should indicate that on November 7, 2001; the City of Kalispell entered into a contract with Murcon Development, Inc. for the purchase of Lot 3 of Daley Field Subdivision. As part of our Buy -Sell agreement, the City provided that they would "aggressively and persistently" pursue the installation of a traffic light at the intersection of Kelly Road and US Highway 93. We believed at the time and continue to assert that this traffic light is fundamental to achieve the highest and best use for our property purchase from the City of Kalispell. Since entering into this agreement with the City of Kalispell, Murcon Development, Inc. has continued to pursue the installation of a light. Murcon Development, Inc. has secured a Memorandum of Understanding for extending the frontage road from our property south to Murdoch's. Additionally, Murcon Development, Inc. has engaged the services of Schwarz Architecture & Engineering, Inc. to design significant components of the frontage road, retained the services of Perteet Engineering to complete the signalization design, and hired Pavlik Electric to install the underground loons in the signal. Clearly, Murcon Development, Inc. has shown a considerable level of commitment to pursuing the light, through engagement of engineering services, coordination with adjacent land owners, and securing a funding pool to pay for the installation of the light. In order for the City to fulfill the contractual obligation set forth in our contract for purchase of Lot 3 of Daley Field, we believe the City of Kalispell must actively dedicate resources and personnel to the goal of securing a light at Kelly Road. We understand this may involve preparation of engineering analyses, securing traffic data, evaluating traffic flow and traffic patterns, and providing adequate data to justify the need for the traffic light. As noted above, Murcon Development, Inc. has engaged multiple engineering firms to pursue this task and we are certain that these firms will provide data to the City staff to assist in your tasks. We continue to believe that the light at Kelly Road represents a J oint need to Murcon Development, Inc. as well as the residents of the City of Kalispell. With the completion of the Jim Patrick, City Manager 1211712004 Re: Traffic Light at Kelly Road/US Highway 93 Page 2 of 2 widening of US Highway 93 into a five lane highway, Murcon Development, Inc. is now actively involved in the construction of the frontage road servicing the recently approved Daley Field subdivision. More importantly, we now have a number of potential purchasers who are very interested in the property. These are very qualified users who are proposing commercial development that would be a significant benefit the City of Kalispell in general. Until such time as we receive approval from the Montana Department of Transportation regarding the light at Kelly Road, we will not be in a position to secure and close these users. Additionally, I believe you are already familiar with the general support from both the businesses and residences located east of US Highway 93 and the Kelly Road intersection that need southbound access from Kelly Road unto US Highway 93. For these reasons, time is now of the essence. Again, I would ask that you engage your staff and the necessary resources to ensure that this project moves forward. I have directed Schwarz Architecture & Engineering, Inc. to provide you with any available information that has been secured to date. I would be available to meet with you and or your staff to further review this protect and to evaluate tasks that must be corapl.eted in order secure the light at Kelly Road.
