SUBJECT Resubdivision of Lot 1 of Minor Subdivision Plat # 117 - Request for one-year
preliminary plat extension
MEETING DATE: December 7, 2009
BACKGROUND: This is a request by Montana Mapping Associates, Inc. on behalf of the owner for
a one year extension of the preliminary plat of the Resubdivision of Lot 1 of Minor Subdivision Plat
# 117. The subdivision would create 7 residential lots and was approved on February 5, 2007 by
the Kalispell City Council subject to 25 conditions.
The subdivision is 4 acres in size and is located on both the east and west sides of Denver Avenue
at 60 Denver Avenue. The 4 acre subdivision site is zoned R-3, Urban Single Family Residential,
with a PUD, Planned Unit Development, overlay zoning district.
The Kalispell Subdivision Regulations, section 2.06.E.7, allows the subdivider to request a one year
extension of the preliminary plat approval deadline from the city council. A one year extension
would give the developer until February 5, 2011 to file the final plat.
RECOMMENDATION: A motion to adopt the resolution and grant a one-year extension to the
preliminary plat approval for the Resubdivision of Lot 1 of Minor Subdivision Plat # 117 would be in
order.
FISCAL EFFECTS: Minor positive impacts once fully developed.
ALTERNATIVES: As suggested by the city council.

A RESOLUTION APPROVING A ONE YEAR EXTENSION TO THE PRELIMINARY
PLAT OF THE RESUBDIVISION OF LOT 1 OF MINOR SUBDIVISION PLAT #117,
LOCATED ON THE EAST AND WEST SIDES OF DENVER AVENUE AT 60 DENVER
AVENUE.
WHEREAS, the City Council of the City of Kalispell granted preliminary plat approval for the
Resubdivision of Lot 1 of Minor Subdivision Plat #117 on February 5, 2007, and
WHEREAS, Montana Mapping Associates, Inc., on behalf of the owner, now desires a one-year
extension to the preliminary plat for the Resubdivision of Lot 1 of Minor Subdivision
Plat #117 in order to finish the infrastructure necessary for final plat, and
WHEREAS, Section 2.06 of the Kalispell Subdivision Regulations and Montana Subdivision and
Platting Act allows the City Council to grant a one-year extension to the preliminary
plat in addition to the original three year approval; and
WHEREAS, good cause exists for the request for extension by Montana Mapping Associates, Inc.
and it is in the best interests of the City that the extension be given.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, MONTANA AS FOLLOWS:
SECTION I. That the application of Montana Mapping Associates, Inc. for a one-year
extension of the preliminary plat of the Resubdivision of Lot I of Minor
Subdivision Plat #117, Kalispell, Flathead County, Montana is hereby
approved.
PASSED AND APPROVED BY THE CITY COUNCIL AND SIGNED BY THE MAYOR OF THE
CITY OF KALISPELL, THIS 7TH DAY OF DECEMBER, 2009.
