I am in receipt of your letter dated June 16, 1999 in which you
address the application of Section 8.1, Development Agreement
between the City of Kalispell and RSI, L.L.C..
This office has reviewed the covenants contained in the letter and
has determined that said covenants substantially protect the City's
interest under Section 8.1, Development Agreement. Therefore, the
City has no objection to your utilization of a new limited
liability company to build the RSI grocery store.
I am sorry for the delay in responding to your letter. I hope my
delay has not unduly inconvenienced any of your activities.
