I've looked over the ordinance, its rules and rates and find they are reasonable only
for those who are on the storm sewer systenL
There should be a flat fee for parcels, regardless of size/where their run off does not
affect city streets or storm sewers.
The storm sewer assessments brought in $234,305.46 last year. The assessment list
had 628 pages with 8 or 9 parcels on each page. That makes 5000 - 5600 tax
payers a flat fee of $50.00 for 5100 tax payers would bring in $255,000 which is
more than what you are getting now.
If you look on the 4th shee I gave ou<see what each of you a for Storm

Service. It totaled $238.66 averagingt6.52 each.
We alone pay $299.26. There is no storm sewer in our area at all. Our snow and
rain run off either it's absorbed or runs into the old Ashley irrigation ditch.
We receive the same benefits as everyone else so why should we have to pay more
than all of you and almost 5 times what the highest councilman pays?
The Kalipsell maintenance fee is even more inequitable.(We are the only individual
homeowners in the city who pays more than all but 20 of the 5100 tax payers in the
city. Business, schools etc. included3
Just because we have 980 feet of road. frontage doesn't give us anymore benefits
than anyone else.
Actually there are around 1200 'tax payers who pay under $20 , 2000 pay between
$20 - $40. We pay $980.10 over twice what you pay all together. It is legally
within you power to correct this and it's only fair and just that you do so.

Dear Mr. Wilson.
We would like an adjustment made to reduce our Kalispell Special Maintenance and Storm Sewer
fees. We do not feel that as individual homeowners, we are being taxed just or equitable (Ord.
#862-2.07).
Our Kalispell Special Maintenance fee is more than most of the businesses in the city of Kalispell.
In fact, there are only 19 tax payers in the city of Kalispell paying more than us.
If this fee is based on square feet, then why does our neighbor who has a little less than half
the square footage we have, pays only $88.01. Why not at least half of what we pay? if this
fee is figured on road front footage, then why does the neighbor who has just half the road
frontage we have, pays only $86.25?
To the best of our knowledge there are approximately 5125 tax payers in the city of Kalispell. At
$980.00 (Kalispell Special Maintenance fee) a year, we are paying more than 5,105 tax payers.
This includes aft businesses, individuals, and everything in the city limits. The average
homeowner pays only $26.00. It takes 38 taxpayers at this rate to pay as much as we do.
Our storm sewer fee is also out of reason compared to all other homeowners. The city receives
$234,304.46 a year for storm sewers. That divided by 5125 tax payers equals $45.72. (This
average price includes all businesses.) We pay $299.26; 6.5 times more than the average.
We were forced into the city in spite of our protests. Being annexed to the city raised our taxes
$1,296.36 just for city maintenance and storm sewer fees.
These fees seem unfair, unjust, and unequitable compared to everyone else's.

ORDINANCE ESTABLISHING AND PROVIDING FOR COLLECTION OF STORM SEWER CHARGES:
ESTABLISHING CLASSES OF PROPERTY WITHIN THE CITY AND PROVIDING FOR RATES
APPLICABLE THERETO AND METHOD OF CALCULATION THERW- F: PROVIDING METHOD AND
PROCEDURE FOR ADJUSTMENT OF CHARGES FOUND TO BE INEQUITABLE: REPEALING ORDINANCES
1NCONSISTANT HEREWITH: AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED by the Council of the City of Kalispell, Montana as follows:
Section 1. Findings and Authority.
1.01. The Sewerage System. The City presently owns and operates a
sewerage system for the collection and disposal of sewerage and storm and other
surface waters (the System). This Council has caused studies to be conducted
and, based thereon and on an investigation of facts and circumstances relating
to the System (including developing state and federal policies concerning the
collection and disposal of sewage and storm and surface waters), has determined
that it will in the coming years be necessary and desirable to construct
improvements and extensions to the System for collection and disposal of storm
,and surface waters.
1.02. Authority. The City is authorized by Chapter 24, Title 11, Revised
Codes of Montana 1947, by resolution adopted by this Council so providing, to
reconstruct, better, improve and extend the System and issue revenue bonds to
finance in whole or part the costs thereof. The City is further authorized and
required by Chapter 24, Title 11 and Sections 11-2217 and 11-2219•to establish just'
and equitable rates, fees and charges alid rentals for the services and faciliti.
provided by the System so as to make the System self-supporting which rates, fees
and charges will be at least sufficient to pay when due the principal of and
interest on bonds issued and to provide for all expenses of operation and
maintenance of the System, including reserves therefor.
1.03. Findings and Determinations. It is hereby found, determined and
declared as follows:
(a) those elements of the System for the collection of and disposal
of storm and surface waters are of benefit and provide services to all property
within the City including property not presently served by the sanitary or the
storm elements of the system.
(b) the cost of operating and maintaining the City Sewer System and
particularly the Storm Sewer portion thereof and financing necessary repairs,
replacements, improvements and extensions thereof should, to the extent
praeticable,e allocated in relationship to the benefits enjoyed and services
received therefrom
(c) a just and equitable measure of the benefits enjoyed and
services received as a result of the collection and disposal. of storm and
surface water is the relative area and character of use of the various properties
within the City, because the extent of storm and surface water drainage from
a particular lot or parcel is largely a function of its' area and the different
types of surfaces and other physical characteristics thereof.
1__� (d) it is necessary and desirable and in the best interests of the
City, its citizens and the users of the System to establish a cnecial charge
for the facilities and services provided by the Storm Sewer, which charge
shall be designated the storm sewer charge and shall be imposed and collected
as Drovided in this ordinance.
II ,
Section 2. A STORM SEWER CHARGE
2.01. Application and Classification. A special stoivt sewer charge
is hereby imposed on each lot and parcel of land within the. City, except
the Airport, Golf Course, Woodland Park, Lawrence Park and adjacent City
owned areas, for services and facilities provided by the storm sewer. For
purposes of imposing the storm sewer charge all lots and parcels within the
City, except in those areas as exempted hereby, are classified as follows:
(1) Class 1, which shall include all undeveloped parklands and play-
growids having an age egate coefficient of rwioff in the range of .05 to .25
inclusive.
(2) Class 2, which shall include all parcels and lots which Have an
aggregate coefficient of rnuioff in the range of .26 to .50, inclusive.
(3) Class 3, which shall include all. parcels and lots which have an
aggregate coefficient of runoff in the range of .51 to .75, inclusive.
(4) Class 4, which shall include all parcels and lots which are in
the central business district and all lots or parcels having an aggregate
runoff coefficient in the range of .76 and over.
The City Engineer is directed to prepare a list of all lots and parcels
within the City and the area thereof and using the table as set out hereinafter
assign the class applicable thereto and file said list with the City Treasurer
on or before the first Monday in October next following the effective date hereof.
The City Engineer shall at least once each year thereafter revise and lipdai:e

unjust or inequitable for appropriate action under Sec. 2.05 hereof.
2.02. Rates. The annual storm sewer charbes for the calender year for
lots and parcels within each of the classes of property described in Section
2.01 hereof shall be as follows:

2.03. Determination of Coefficient of Runoff; Schedule. Me aggregate
coefficient of runoff is determined by considering the different types of
surfaces within each lot or parcel, by determining the areas of each diffi::J•(nit
surfaces upon each lot or parcel and assigning a runoff value fur each type
of surface, and, calculating the reasonable and approximate proportion of
such type in the whole of said lot, a weighted aggregate coefficient of run.-)ff
for all of said lot is calculated. Such runoff values shall be as follows:

2.04. Determination of Charge. Upon review of the .list as prepared by
the City Engineer, hereunder, the City Council shall on or before
determine the annual storm sewer charge for each parcel and lot subject thereto.
2.05. _Collection of Change. The City Treasurer shall, on or before the
last day of October of each year mail to every owner of a lot or parcel within
the City whose ownership is determined on the same date and in same manner as
are real property taxes, a statement setting forth the annual charge to be
assessed as said lot for the storm sewer service thereto. Such charge shall be
due and payable on or before five o'clock p.r. on the 30th day of November of
each year. Upon failure of the owner to pay said charge same will be in arrears
and deliquent on Pecember 31 of said year and shall be collected by the City
Treasurer according to the provisions and authority of Section 84-4726.1 x.C.m.
1947 as amended.
2.06. Deposit of Collections. All collections of the storm eewPr chargd
shall be deposited in the Revenue Bond Account of the Sewer Fund.
2.07. Adjustment of Charge. Any person who considers the charges

plicable to his lot or parcel to be unjust or unequitable may apply to the
ty Engineer for ad�us tment thereof, stating in writing the grounds of his
mplaint. The City Engineer shall cause appropriate investigation thereof and
port his findings to the City Council for review if said complaint is not
thdrawn. The Council shall promptly review such report and hear the complaint;
the City Council determines that an adjustment of the changes for any
ch lot or parcel is necessary to provide for the just and equitable

pplication of the storm sewer charge, it shall so provide, either by
ordinance amendatory hereto, or by directives to the City Treasurer fixing
special charges for individual lots or parcels.
2.08. Delinquent Ch?rge. All charges iii arrears and delinquent
hereunder shall bear interest and be assessed penalty in the same amounts
and at the same rates as are assessed to delinquent real estate taxes.
2.09. Repeal. All ordinances of the City in conflict herewith are
hereby repealed.
2.10. Effective Date. This ordinance shall be in effect for the period
beginning the Third Day of September , 1976 and all annual assessments
levied hereunder prior to 1-1-77 shall be pro -rated ac ordingly.

ORDINANCE NO. 1035
AN ORDINANCE CREATING SPECIAL MAINTENANCE DISTRICT NO. 1, FOR THE
PURPOSE OF MAINTAINING THE STREETS AND AVENUES OF THE CITY OF
KALISPELL, TO DEFINE THE BOUNDARIES OF SAID DISTRICT, TO PROVIDE
FOR ASSESSMENTS, AND TO PROVIDE AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Kalispell considers
it necessary and desirous to create SPECIAL MAINTENANCE DISTRICT
N0. 1 for the purpose of maintaining the streets, avenues, alleys
and public roads of the City of KALISPELL, and
WHEREAS, SPECIAL MAINTENANCE DISTRICT NO. 1 shall replace
Water Sprinkling District No. 1 and Oil Sprinkling District No. 2
as authorized and required by the Title 7, Chapter 12, Part 44,
Montana Code Annotated, and
WHEREAS, the funds generated by specially assessing property
within the City shall be used for sprinkling, graveling, oiling,
chip sealing, seal coating, overlaying, treating, general cleaning,
sweeping, flushing, snow removal, leaf and debris removal and
other general maintenance of the streets and avenues, and
WHEREAS, the City has the authority to create maintenance dis-
tricts and to specially assess property within said district for
costs pursuant to Title 7, Chapter 12, Part 44, Montana Code Anno-
tated, and
WHEREAS, work undertaken and paid for by special assessment
shall be maintenance of streets, avenues, alleys and public roads
which are of a durable and continuing benefit to the City of Kal-
ispell.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL
SECTION I. That there is hereby created Special Main-
tenance District No. 1 for the purpose of maintaining
the streets, avenues, alleys and other public roads
in the City of Kalispell.
SECTION II. That maintenance as used herein shall include
but not be limited to sprinkling, graveling, oiling, chip
sealing, seal coating, overlaying, treating, general clean-
ing, sweeping, flushing, snow removal, and leaf and debris
removal.
SECTION III. That the Boundaries of said Special Main-
tenance District No. 1 is that area described in Reso-
lution No. 3490 , passed and adopted by the City Council
of the City of Kalispell and Mayor on the 6th day of
September 1 1983, and shall be subject to change by
further resolution of the City Council not more than one
time in any succeeding calendar year.
SECTION IV. The work undertaken"as maintenance in Special
Maintenance District No. 1 shall be accomplished either
by contract or by forces employed by the City in such a
manner as the Council may direct.

SECTION V. That the cost of and expenses of maintaining
the streets, avenues, alleys and public roads shall be
assessed against each lot or parcel within the Special
Maintenance District No. 1 for that part of the whole
cost which its area bears to the area of the entire dis-
trict, exclusive of streets, alleys, and public places,
the amount assessed and levied against all property in
the District shall not be less than seventy-five percent
(75%) of the entire cost of said maintenance. -
SECTION VI. The City Clerk is hereby authorized and
directed to give notice of the creation of Special
Maintenance District No. I as required by law.
SECTION VII. THIS ORDINANCE shall be effective from and
after 30 days next succeeding its passage by the Council
and approval by the Mayor.
