Jim Oliverson, on behalf of Northwest Health Care, applied to the City of Kalispell for a
conditional use permit to add a temporary modular office building on the property described above.
The Kalispell City -County Planning Board and Zoning Commission, after due and proper
notice, on November 10, 1998 held a public hearing on the application, took public comment and
recommended that the application be approved subject to three conditions.
After reviewing the application, the record, the FRDO report, and after duly considering the
matter, the City Council of the City of Kalispell, pursuant to the Kalispell Zoning Ordinance, hereby
adopts Flathead Regional Development Office, Conditional Use Report #KCU-98-9 as the Council's
findings of fact, and issues and grants to the above -described real property a conditional use permit
to allow the placement of a temporary modular office building in the H-1, Hospital zoning district
subject to the following conditions:
The building will be developed and used in substantial conformance with the approved
site plan and other application materials. The conditions herein shall be met prior to
occupancy.

Dear Glen:
The Kalispell City -County Planning Board held a public hearing at their regular meeting of
November 10, 1998 to consider a request by Northwest Health Care for a conditional use
permit to allow a temporary medical office building in an H-1, Health Care, zoning district.
The property is located at 1275 US Highway 93 in Kalispell.
Steve Kountz with the Flathead Regional Development Office reviewed the proposed
project for the day care center. Staff recommended approval of the proposal subject to
five conditions.
Dave Greer, Montana Planning Consultants, spoke in favor of the project. He had one
objection to condition #4 in the staff report. No one spoke in opposition.
The Planning Board discussed Condition #4 which would require the applicants to
install a three-foot high visual relief screen along the highway frontage of the parking
lot. A motion was made to delete Condition #4 and adopt Staff Report KCU-98-9 as
findings of fact and recommend that the City Council grant the conditional use permit
subject to the amended conditions. The motion passed on a 3-2 vote with one
abstention. The recommended conditions are listed in Attachment A.
This recommendation for approval is being forwarded to

Heinecke asked why R-3 was chosen instead of R-2. It was explained
that it provided more lots and it was better infill. Heinecke asked Hall
why he had decided on R-3. Hall responded that it was the other
neighbors who had wanted that designation and he had gone along
with them.
Question The question was called. On a roll call vote Carlson, Heinecke, Bahr,
Stevens, Johnson and Hines voted aye. The motion passed on a 6-0
vote.
NORTHWEST The fourth public hearing was introduced by Carlson on a request by
TH CARE CUP Northwest Healthcare for a conditional use permit to allow a
temporary medical office building in an H-1, Health Care, zoning
district. The property is located at 1275 U.S. Highway 93 in Kalispell.
Staff Report Kountz gave a detailed overview of Staff Report KCU-98-9. Kountz
said staff was recommending that a three-foot high visual relief screen
be placed along the parking lot perimeter where it faces the highway
in order to provide additional screening for the temporary building
and screening for the permanent parking lot. Staff recommended
approval of the conditional use permit subject to the five conditions
as stated.
Letter was received from Dr. Johnson with no objections, he is in
favor of the application.
Rob Heinecke excused himself due to conflict of interest.
Public Hearing:
David Greer, of Montana Planning Consultants and representing the
Proponents applicants, spoke in favor of the project. Greer showed the board a
video of the existing buffer from the highway, and stated he believes a
3-foot requirement is overkill. Greer stated he didn't believe there
was the need for the additional cost of the visual relief screen.
Opposition There was no opposition.
Board Discussion Stevens asked Kountz about condition #2. Kountz said this condition
is common if more parking requirements were needed. Kountz said he
couldn't measure the setback which is why he included it. Stevens
said he would have to do it whether condition #2 was in the staff
report or not. Kountz said if the building was moved further in to
make it less than 24 ft wide it would not comply with parking
requirements.
Hines asked if it was valid for 18 months to place the building there.
Kountz said it was 18 months to place the building or get a building
permit. Greer said they would be placing the building before

Christmas. Hines asked how long they would use the building. Greg
said it would probably be 3 years.
Motion Stevens moved to adopt Staff report #KCU-98-9 as findings of fact and
recommend to the Kalispell City Council that the conditional use
permit be approved subject to the amended conditions of # 1, 2, 3,
and S and the deletion of Condition #4; Bahr seconded the motion.
On a roll call vote Bahr, Stevens and Johnson voted aye, Carlson and
Hines, nay, and Heinecke abstained. The motion passed on a 3-2
vote.
COOK TEXT Carlson submitted a request by Bob Cook for an amendment to the
AMENDMENT Kalispell Zoning Ordinance to allow an exception for private garages
on lots that do not abut an alley to be placed in the front yard.
Staff Report Kountz gave a summary of Staff report #KZTA-98-3, and recommends
that the board approve the request subject to two minor editorial
changes intended for clarification: replace the term "private garage"
with "residential garage", and replace the "constructed" with "located".
It was asked if set back corners applied and Kountz stated that it did
not.
Public Hearing:
Proponents Doc Dahlquist, representing the applicant, spoke in favor of the
proposed text amendment.
Opposition No one was opposed.
Board Discussion Heinecke asked if his property didn't meet the setbacks then he
couldn't put a detached garage on his property. Kountz said he could
add an attached garage but not a detached garage.
Motion Hines moved to adopt staff report #KZTA-98-3 as findings of fact and
recommend approval of the request subject to two minor editorial
changes intended for clarification: replace the term "private garage"
with "residential garage", and replace the word "constructed" with
"located", in order to read as follows: 27.22.020(3)(a) No accessory
structures, except fences, walls, and residential garages on lots that
do not abut an alley, shall be located in any front yard; Heinecke
seconded the motion. On a roll call vote: Carlson, Heinecke, Bahr,
Stevens, Johnson, and Hines voted aye. The motion passed on a 6-0
vote.
NEW BUSINESS The board discussed the master plan update. Kountz said he would
mail the draft to approximately 30 people and have copies on hand at
various other placed. It was decided to have meetings in December
and January to take public comments. Stevens said he didn't want to
have public comments at the regular meeting. Hines said new
members will be seated in January and it would be better to take
public comments before that because the new members would not be

request by Northwest Health Care, Inc. for a Conditional Use Permit -to allow the placement
of a temporary office building in an H-1, Hospital zoning district. A public hearing on this
matter has been scheduled before the planning board for November 10, 1998, beginning at
6:00 PM, in the Kalispell City Council Chambers. The planning board will forward a
recommendation to the City Council for final action.

B. Summary of Request: The applicants are requesting a conditional use permit for a
temporary building, a 60 foot by 24 foot modular office building to be in place for up to
three years. The building would provide office space for Home Options, located at
1280 Bums Way (just east of the Health Promotion Center), pending construction of
a new Home Options Building. Crowded working conditions in the existing building
create an unsafe working environment according to the Fire Marshall. The building
would be identical to one approved earlier this year for Corporate Accounting near the
ALERT building. The modular building will comply with the required building code
standards for offices and be hooked up to municipal sewer and water.
C. Size and Location: The property proposed for the temporary office building is
located in the parking lot of the Health Promotion Center near the intersection of
Highway 93 and Conway Dr. The address 1275 Highway 93 N. The property is
described as a portion of Lot 1, Highland Park Second Addition, Section 6, Township
28 North, Range 21 West, P.M.M., Flathead County, Montana.
D. Existing Land Use and Zoning: The proposed location for the temporary building is
a parking lot. The zoning for this property and the surrounding area is H-1, Hospital.
Temporary uses are listed as a conditionally permitted use in this district.
E. Surrounding Zoning and Land Uses Zoning: All of the surrounding properties are
located in the H-1, Hospital, zoning district. All of the surrounding uses provide
support services to the hospital or are related to medical care.

EVALUATION OF THE REQUEST:
The application is reviewed in accordance with the conditional use criteria in the Kalispell
Zoning Ordinance.
1. Site Suitability:
a. Adequate Usable Space: There is adequate usable space to accommodate
the proposed building. The site would displace approximately seven parking
spaces. The application notes that the parking lot is oversized for the existing
uses at the Health Promotion Center, and the affected portion of the parking
lot is seldom used due to the distance of the spaces from the main building
entrance. Upon site inspection by staff on a Wednesday morning at 11 a.m.,
the 32-space parking lot was nearly empty. The building will not generate
additional parking demand but rather will shift the parking demand to a less
crowded lot.
b. Adequate Access: Access to the office would be adequate. Access would be
from the parking lot off of Conway Drive.
C. Environmental Constraints: There are no significant environmental constraints
apparent on the property. It is generally level and within a highly developed
area of Kalispell.

2. Appropriate Design:
a. Parking Scheme: As described above under adequate usable space, park
needs would be sufficiently met by the existing paved parking lot. The building
will not generate additional parking demand but rather will shift the parking
demand to a less crowded lot.
b. Traffic Circulation: Traffic will generally enter and exit from the parking lot
abutting Conway Drive. Access is paved and suitably designed for traffic
circulation.
C. Open Space: No specific open space requirements are required under the
zoning other than the required setbacks.
d. Fencing/Screening/Landscaping: The building would look comparable to a
manufactured home and is in a relatively prominent location at the intersection
of Highway 93 and Conway Drive. No additional landscaping or screening is
proposed. The steep slope adjacent to the highway would partially screen the
building from highway view, and the building would only be temporary. Staff
recommends provision of a three-foot high visual relief screen (e.g., hedge,
planter box, berm) along the parking lot perimeter where it faces the highway,
a zoning requirement for new parking lots with more than four spaces which is
not currently met (27.26.030(6)(b)). Doing so would provide additional
screening for the temporary building and conventional screening for the
permanent parking lot.
e. Signage: The application notes that no freestanding sign would be installed,
but a building identification sign may be needed. No signage plan has been
proposed in the application.
3. Availability of Public Services/Facilities:
a. Schools: This site is within the boundaries of School District #5, however, this
proposal would have no impact on the school district.
b. Parks and Recreation: No impacts to the parks and recreation facilities in the
area are anticipated as a result of this use.
C. Police: Police protection will be provided by the Kalispell Police Department.
No significant impacts are anticipated as a result of the proposed facility.
d. Fire Protection: Fire protection will be provided by the Kalispell Fire
Department. No significant impacts are anticipated as a result of the proposed
facility. There are fire hydrants in the area as well as good emergency access
to the site in the case of a fire.
e. Water: City water will be extended to the building.

f. Sewer. City sewer will be extended to the building.
g. Solid Waste: Solid waste pick-up will be provided by the City.
h. Roads: No additional traffic generation is anticipated as a result of this use;
instead, traffic would be shifted to a less crowded parking lot closer to the
street. Access will generally be onto Conway Drive, a City paved street which
is in good condition and well maintained. Roads in the area are adequate to
accommodate the proposed use.

No significant impacts are anticipated from traffic, dust, vibration, glare, smoke,
fumes, gas, odors, or inappropriate hours of operation. A notice of public hearing was
mailed to property owners within 150 feet of the site approximately 15 days prior to
the hearing. As of this writing, no comments from neighbors have been received.
5. Consideration of historical use patterns and recent changes:
The character of this area is related to hospital and medical office uses. A conditional
use permit for another modular building within the hospital campus was approved
earlier this year.
6. Effects on property values:
No significant negative impacts on property values are anticipated. As discussed
above, the character of this area is related to hospital and medical office uses.
RECOMMENDATION
Staff recommends that the Kalispell City -County Planning Board adopt staff report #KCU-98-
9 as findings of fact and recommend to the Kalispell City Council that the Conditional Use
Permit be approved subject to the following conditions:

BACKGROUND
The purpose of this CUP application is to seek approval for a temporary (modular) office
building in the area of the Health Promotion Center building located at the intersection of
Conway Drive and U.S. Highway 93. The temporary office is needed to accommodate staff
of Home Options, which is headquartered in the medical office complex at 1280 Bums
Way, just east of the Health Promotion Center building. Crowded working conditions in the
existing building create an unsafe working environment according to the Fire Marshall. At
present, the Health Promotion Center houses Kid Kare (corporate day care), Dino Sore
(sick child care), and EAP (employee assistance program). Although the Health
Promotion Center could satisfy the space needs of Home Options, the structure does not
comply with a variety of building and safety codes. The temporary office building will serve
to alleviate some of the overcrowding in the existing building, pending construction of a
new office building for Home Options. The proposed temporary office building will be
located on the north side of the Health Promotion Center as shown in the site plan. This
site was selected for a variety of reasons including (1) convenient access to sewer & water,
(2) close proximity to the Home Options building, (3) separation from main entrance to
Health Promotion Center, (4) convenient access from Conway Drive, and (5) relative
isolation from other uses.
The modular building will be 60' X 24. It will
comply with building standards for office uses.
The building will be identical to the one recently
approved for Corporate Accounting, near the
ALERT building. The structure will be set-up in
the parking lot as shown on the plans to avoid
unnecessary excavation into the adjoining
landscaped areas. The affected portion of the
parking lot is seldom used due to the distance
of the spaces from the main building entrance
and due to the minimal occupancy of the
Health Promotion Center. The need for the building is temporary but may need to function
for up to 3 years.
RESPONSE TO ITEMS 2 & 3 ON THE CUP APPLICATION

g. The proposed use is a temporary "office" for staff of Home Options.
a. The temporary building will not significantly alter the existing "traffic flow
& control". The addition of the building does not represent any additional
traffic to the surrounding area -since no additional employees will be
associated with the building. The existing parking and circulation system is
adequate to serve the needs of the building at the proposed location.
b. Access and circulation will not be affected. Employees still have the
same general destination for work.

d. The use will not interfere with refuge and service areas of the Health
Promotion building. Sufficient room is available in the area of the proposed
modular building to accommodate trash storage, if necessary, and pick-up.
e. All necessary utilities are in place or available to serve the building.
f. The structure will be located on the north side of the Health Promotion
building at a location that is substantially set back from Conway Drive and
from the Highway. The steep topography adjacent to the Highway should

screen most of the building from
highway views. A substantial
area of "greenspace" separates _-
the use from both public roads.
g. The use will not require any
ground signage but may require
a building identification sign. The
location will not displace any
landscape area.
h. The temporary building will be
a manufactured modular structure, constructed to comply with all relevant
building codes for offices. The building is low profile, with only a gentle roof
pitch. The structure will not be placed in any required setback areas. Refer
to the site plan and building plans.
i. No open spaces are required other than those associated with setback
requirements. Landscaped areas are substantial, especially along the south,
west, and north lot boundaries.
j. The structure will be operated primarily during normal working hours but
may have occasional use during "off -hours" as per the routine demands of
the services provided by HomeHealth, Hospice, and PrivateCare. There are
no nearby residential uses that will be affected by the occasional off -hour
schedules.
k. The structure will not create any "impacts" beyond those normally
expected by office -related uses.
