Consent Agenda — Included in your packet is the Consent Agenda, consisting of the following: A) The Council Minutes of the Regular City Council Meeting of August 3, 1998 are included for your review and approval. C) The Approval of Claims per Payable Register in the Amount of $485,434.50 is included for your review and approval. Agenda Item No. 2. Hear the Public Jim Sappington — Real Estate Review Agenda Item No. 3. Resolution No. 4429 — Adopt Municipal Record Retention Schedule The City of Kalispell generates documents at the rate of 600,000 pages per year. Management, retention and disposition of the records has become problematic for the City of Kalispell, and for that matter, other cities in Montana. The I=\wp\agendamemo -I- Post Office Box 1997 • Kalispell, Montana 59903-1997 Telephone (406) 758-7700 • FAX (406) 758-7758 Montana Local Government Records Committee under Title 2, Chapter 6, Part 4, Montana Code Annotated, has authority to prohibit the destruction of records by local governments. The Committee, pursuant to Section 2-6-403, MCA, has developed a Municipal Records Schedules book which establishes a retention and disposition schedule for categories of records for which a disposal request is not required. Resolution No. 4419 adopts by reference the Municipal Records Schedules compiled by the Montana Local Government Records Committee. A motion to adopt Resolution No. 4429 is appropriate. Agenda Item No 4. Ordinance No. 1290 — Zone Change — Ivan and Marian O'Neil Ivan and Marian O'Neil have applied for a zoning map amendment on three (3) tracts of land located between 3rd and 5th Avenues East, generally East of the Outlaw Inn and North of Western Building. The property is currently zoned Low Density Residential Apartment, RA-1. The O'Neil's desire to re -zone the property to General Business, B-2. B-2 zoning would authorize a more intense use of the property for commercial purposes than is allowed under the RA-1 designation. FRDO reviewed the application and recommended approval (KZC-98-2). The City -County Planning Board and Zoning Commission recommended approval of the zoning amendment after altering Finding of Fact # 2, to reflect the marginal ability of the road system to handle traffic generated from development of the property. Ordinance No. 1290 passed let reading at the August 3, meeting. Passage of a motion to approve Ordinance No. 1290 would be appropriate. Agenda Item No. 5. Ordinance No. 1291 -- Building Fee — First Reading During the budget process the Council determined that charging expenses for zoning administration to the Building Department was probably not advisable under current law. This office and the Building Department have prepared Ordinance No. 1291 which reduces the fee charged for a building permit within the City of Kalispell and within the jurisdictional area of the Kalispell Building Department by 20%. We believe that such a reduction will not permanently damage the Building Depart- ment's reserve and will serve as a relief to possible action establishing a zoning fee for construction of buildings within I:\wp\agendamemo -2- the City of Kalispell, under Ordinance No. 1292. The Council after discussion may want to pass a motion adopting Ordinance No. 1291 and reduce the building permit fee. Agenda Item No. 6. Ordinance No. 1292 — Zoning Fee Staff, in connection with reducing the building permit fee by 20%, is recommending that the City institute a zoning fee of 20% of the building permit fee for construction of buildings, only, within the corporate limits of the City of Kalispell. We do not feel that such a fee will fund the entire Zoning Administration Office, but it will provide a substantial amount of funds, perhaps as much as $25,000 to assist in the operation. Shortfalls may be assigned to General Fund appropriations. In light of uncertainty connected with this program we will constantly monitor the income/expenses of the zoning function and recommend changes as they may be required. Staff recommends that we adopt the approach for perhaps a year subject to constant evaluation. A motion to adopt Ordinance No. 1292 is appropriate. Agenda Item No 7. Ordinance No. 1293 — Salary Ordinance The AFSCME employees became entitled to a salary increase of approximately 25� per hour on July 1, 1998. The staff has recommended a salary range increase of 5% for appointed officers, supervisors and other salaried employees. A range increase does not, automatically, result in an increase in compensation for any employee, but merely increases the range available for pay. The last adjustment to the range was accomplished in 1995. Finally, Mike Baker has suggested certain adjustments to the recreational department crew salaries which are comprised of Summer employees working in park maintenance and recreational programs. The changes include raising Park Maintenance, Park Labor, Camp Counselor, and Head Counselor by 50� per hour, establishing a Recreational Aide I paying $6.50 and Recreational Aide II at $7.50 per hour, and lowering the pay for an Office Aide from $6.00 to $5.15. The Parks Department is having a difficult time in retaining and assuring the return of good employees because competing private landscapers and groundskeepers pay up to a $1. 00 more per hour than the City does. The Salary Ordinance included in your packet reflects the required and recommended changes, at this time necessary, to reflect I:\wp\agendamemo -3- current conditions. Subsequent salary ordinances will be needed when contract negotiations with the Police and Fire bargaining units are complete. After consideration of the proposed changes the Counsel may desire to adopt Ordinance No. 1293. Agenda Item No - a- Evergreen Sewer Rate Approval Included in your packet are documents compiled by the Finance Director analyzing the charges to be levied by the City on Flathead County Water & Sewer District #1 — Evergreen for treatment of sewage by the City's waste water treatment plant. The charge is made pursuant to an Interlocal Agreement between the City and the District dated July 25, 1990 and a subsequent Addendum, dated June 24, 1996. Sewer rate adjustments for flows contributed by the District are adjusted yearly retroactive to July 1 of the calendar year. The rate has increased substantially which is perhaps primarily due to the mild weather which resulted in lower infiltration rates within the City and a slight increase in District flows. A motion to approve the rate should be approved by the Council. I:\wp\agendamemo -4-
