Dear Mr. Neier,
I am enclosing some information regarding property acquisition along Whitefish Stage Road in
conjunction with the Edgerton Trail Project as we briefly discussed on the afternoon of June 29.
I would like to request that this matter be brought before the Kalispell City Council on July 6 if
possible.
We are asking for donation of the property highlighted on the engineer drawing. The subject
property is ten feet wide at the north end and tapers back to the existing boundary approximately
250' to the south. I have included a waiver form which would allow Flathead County to proceed
with the transaction process if approval is granted. We have been working with Mike Baker of
the Kalispell Parks Department on a related project which will link this trail with Lawrence Park
if you should have any questions regarding this project. I have also enclosed a copy of the letter
from the Kalispell Golf Association, who is leasing the subject property from the City of
Kalispell.

Dear Steve,
Thank you for your letter dated June 8, 1998 regarding the Bike/ Pedestrian Trails along
Whitefish Stage Road. As we discussed, the Kalispell Golf Association (Buffalo Hill
Golf Club) supports this project and will cooperate and assist FRDO in any way possible.
However, since the KGA does not own the golf course property, we cannot consent or
sign the waiver of rights documents as requested. The City of Kalispell actually owns the
Buffalo Hill Golf Course property, accordingly I would suggest you contact Interim City
Manager Glen Neier for direction and approval of the real estate acquisition.
Finally Steve, as we discussed, when the fence is moved (pending approval from the City
of Kalispell) we would appreciate your cooperation in moving the entrance gate just to
the north on Whitefish Stage. Pat Meeker, Buffalo Hill Golf Course Superintendent can
be contacted to identify the exact location desired.

Dear Mr. Neier:
This is to inform you that the County of Flathead is interested in
acquiring ten feet of your property fronting Whitefish Stage Road at TR
1BA in 6-28-21 to be used for the Edgerton Bike/Pedestrian Trail.
A brochure describing your rights and the County procedures for
acquiring property is enclosed for your information. If you have any
questions, please contact our acquisition/relocation specialist Steven
Lorch at (406) 758-5980.
The County has hired an independent appraiser and appraised your
property. This notice is not a notice to vacate and it does not establish
eligibility for relocation payments or other relocation assistance.

WAIVER OF PROCEDURES AND RIGHTS UNDER THE
UNIFORM RELOCATION ASSISTANCE AND
REAL PROPERTY ACQUISITION POLICIES ACT OF 1970
(used in the case of donation of property)
I/WE, as property owner(s), waive, or give up, my/our right to have the County
of Flathead, State of Montana, follow completely the procedures required under
the Uniform Relocation Assistance and Real Property Acquisition Policies Act of
1970 (the "Uniform Act"). I/We further waive, or give up, the right to any and
all claims for compensation by the County with respect to my/our donation of
the 10' fronting Whitefish Stage Road of TR IBA in 6-28-21 described on
Exhibit "A" attached to this agreement.
The County of Flathead has explained my/ our rights and benefits as property
owner(s) under the Act; has notified me/us that the County waives its right of
condemnation by eminent domain for acquisition of this property; and I/we
have received a copy of the Montana Department of Transportation (MDT)
pamphlet, Questions and Answers On Buying Property for Montana Highways.
I/We have read this pamphlet and understand it.
I/We have offered to donate the 10' fronting Whitefish Stage Road of TR 113A in
6-28-21 to the County on 19 . I/We have discussed with a
representative of the County the compensation and other assistance required
under the Act. I / We understand the I / we cannot be required to donate or sell
the TR 1 BA in 6-28-21 to the County, for less than the appraised Fair Market
Value and without other assistance to which I/We may be entitled to under the
Act.
