AGENDA ITEM 3 - AWARD BID - 1ST ALLEY EAST UTILITY PROJECT
BACKGROUND/CONSIDERATION: I have enclosed memos from the Public Works
Director, outlining the current status of the project, the bid analysis and the bid tabulations.
As you will see, the bids are below our estimates.
RECOMMENDATION: I concur with Jim Hansz's analysis. We can work with the
developer who purchases the property. However, as pointed out by the Public Works
Director, the utility vaults are in a fixed location and can only be moved four to five feet from
the design. This is due to the utility company's specific requirements for cable runs, etc. We
had already attempted to change the location without any success. I recommend acceptance
of the bid with the condition that the final construction easements are settled prior to
authorization to proceed.
ACTION REQUIRED: Authorization to the City Manager to proceed with the
construction contract with Pack & Company upon settlement of the construction easement
question (only one (1) easement is outstanding at this time.)

Attached is a tally of bids received for this project. A total of five bids were submitted with a low bid of
$133,196.20 submitted by Pack and Company. This is 12% under the engineer's estimate for the project.
This project was designed to support the development proposed by Irwin Davis, which will not be built.
It has been suggested that the project be delayed to allow for the new developer of the FVCC property to
prepare a site plan. I believe this is unnecessary because the existing design has the flexibility to serve
virtually any site development that may be proposed. Also:
1. There is a possibility that a significant delay could cause the utility companies to change their
financial participation in this project leaving the City responsible for the entire project cost. At this
time the utility companies are prepared to pay 50% of the cost to relocate their facilities.
2. Locations of utility vaults are fixed, no significant movement is possible. We attempted to place
vaults in other locations to recover parking area but were rebuffed by the power company because
they have specific requirements for cable runs to ensure optimum service for their customers. It is
possible to slightly shift the vaults, roughly four to five feet longitudinally, but no more. This can be
done by work directed change during construction. Other significant changes are simply not possible
due to the technical requirements of the high voltage power systems being relocated.
3. City sewer is roughly 12 feet down and two wyes are designed into the plan to serve the FVCC
parcel. Regardless of final site plan these wyes can be used to serve the site without problem. If
budget permits, a third wye could be located mid -point to the property. In addition, a work directed
change may be used to reposition the service wyes.
I cannot recommend an indefinite delay of this project. Time is short and a great deal of work must be
done. However, there are a few unresolved questions concerning construction easements in the alley
which in my opinion should be settled prior to issuing a Notice to Proceed. Therefore, I recommend a
conditional award of the bid to Pack and Company subject to final acquisition of necessary construction
easements. Following receipt of all construction easements a Notice to Proceed would be issued.
Overall project costs are summarized as follows:
This project: $133,196.20
Pacific Power, City share: $ 41,357.00
PTI Communications, City share: $ 36,330.00
electric service reconnections: $ 30.000.00

Bids were opened and read aloud at 2:30 P.M. on Tuesday, May 12, 1998 in the City Hall Council
Chambers. Five bids were received. All bidders submitted the required Bid Bond. Please refer to the
attached Bid Tabulation form for specific information. There is a mathematical error in the amount
of $1,170.00 in the bid received from Doug Crockett Excavating and Trucking. Correcting the
multiplication error Crockett's bid amount is reduced to $167,822.50. This does not change
Crockett's position with respect to the Bid Tabulation. The Engineers estimate for the project
amounted to $151,677.00. The low bid was submitted by Pack and Company in the amount of
$133,196.20. I recommend the contract be awarded to Pack and Company in the amount of
$133,196.20.

Attached are the 50% /50% Cost Sharing Agreements for undergrounding electrical power and
telephone service. The agreements specify the following costs:

The Pacific Power estimate is substantially less than the original $70,000 because of upgrades
,made in 2' Alley East that reduced other costs. The PTI estimate remains the same as their
original.
Both utilities have been actively involved in design and have indicated their willingness to
participate in the project because of benefit to them by upgrading service.
Also attached is a newspaper article about changes to Public Service Commission rules that
require utilities to pay half the relocation costs. Pacific Power is requesting to eliminate that
requirement.
Recommendation:
It is possible that the PSC may change its rules prior to the City awarding the bid and signing the
Cost Sharing Agreements with the Pacific Power and PTI. A letter from the City to the PSC
would be appropriate to protect the commitment made.
