4. Ordinance 1287 - Zoning Text Amendment - Daily Inter Lake - 2nd ReadingAgenda - May 4, 1998 AGENDA ITEM 4 - ORDINANCE 1287 - ZONING TEXT AMENDMENT - DAILY INTER LAKE - 2ND READING BACKGROUND/CONSIDERATION: As per our discussion and 1' reading approval, we are submitting this item for the 2nd and final reading. This will reduce the minimum rear yard setbacks in B-2 (General Business) and B-3 (Community Business) zoning districts from twenty (20) feet to ten (10) feet. RECOMMENDATION: The Staff, Planning Board, and I concur that this reduction should be approved. ACTION REQUIRED: The 2nd reading of this ordinance will complete the Council process for this zoning change. ORDINANCE NO. 1287 AN ORDINANCE AMENDING SECTIONS 27.14.040 AND 27.15.040, OF THE KALISPELL ZONING ORDINANCE, (ORDINANCE NO. 1175), BY ESTABLISHING A MINIMUM REAR YARD OF TEN (10) FEET IN GENERAL BUSINESS (B-2) AND COMMUNITY BUSINESS (B-3) ZONING DISTRICTS, AND DECLARING AN EFFECTIVE DATE. WHEREAS, the Daily Interlake of Kalispell has submitted a written request to amend Section 27.15.040 of the Kalispell Zoning Ordinance, by requesting that a "minimum rear yard setback" of ten (10) feet be established for Community Business (B-3) zoning districts, and WHEREAS, the request was forwarded to the Kalispell City - County Planning Board and Zoning Commission by the Flathead Regional Development Office after having been evaluated under 27.30.020, Kalispell Zoning Ordinance, and WHEREAS, FRDO evaluated the requested text amendment and recommended, per Report #KZTA-98-2, that the minimum rear yard requirement be reduced from twenty (20) to ten (10) feet in Community Business (B-3) zoning districts, and WHEREAS, the Kalispell City -County Planning Board and Zoning Commission recommended that the text of the Kalispell Zoning Ordinance be amended to establish a minimum rear yard of ten (10) feet in General Business (B-2) and Community Business (B-3) zoning, and Whereas, the City Council has reviewed the FRDO Report and the transmittal from the Kalispell City -County Planning Board and Zoning Commission and hereby adopts the findings made in Report #KZTA-98-2 as the Findings of Fact applicable to this Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION I. The City of Kalispell Zoning Ordinance, Ordinance No. 1175, is hereby amended as follows: J:\wp\ord\texamend.wpd Section 27.14.040: Property Development Standards. All parts and portions of Ordinance No. 1175 not amended hereby remain unchanged. SECTION III. This Ordinance shall take effect thirty (30) days after its final passage.
