SUBJECT Bloomstone Phases 1-A and 1-B — Request for a preliminary plat extension
MEETING DATE: March 18, 2013
BACKGROUND: This is a request by the Bloomstone developers for a two-year extension of the
preliminary plat for phases 1-A and 1-B of the Bloomstone subdivision. Phase 1-A includes 74 single
family lots, 10 townhouse lots and one multi -family lot anticipated to accommodate 64 apartment units.
Phase 1-B includes 15 single family lots and 22 townhouse lots. Phases 1-A and 1-B were approved on
April 21, 2008 by the Kalispell City Council subject to 26 conditions.
Phases i-A and 1-B include the northern 21 acres of an 85.2 acre project site. The project site is located
on the north side of Four Mile Drive approximately 1/z mile west of the intersection of Four Mile Drive
and Highway 93. The Kidsports fields are located on the eastern boundary of the project site. The 85.2
acre site can be legally described as parcel 3 of Certificate of Survey 17217 located in the SW 1/ of
Section 36, Township 29 North, Range 22 West, Flathead County, Montana.
The Kalispell City Council granted preliminary plat approval in April of 2008 giving the developer three
years to file the final plat. A one-year extension was granted by the city council in February of 2011 for
the preliminary plat. The city council approved a second one-year extension request in March of 2012
giving the developer until April 21, 2013 to file the final plat for phase 1-A. With the impending
expiration of the preliminary plat, the developer is requesting the city council grant one final extension of
the preliminary plat not to exceed two years in accordance with section 2.06.E.7.b of the Kalispell
Subdivision Regulations.
Pursuant to section.2.06.E.7.b of the Kalispell Subdivision Regulations, the owner may appeal to the city
council in writing for one final extension not to exceed two years provided the letter documents the
following:
i. The existence of an unusual hardship.
ii. That a significant public good would be accomplished through the extension as opposed to
a specific economic hardship related to the owner.
That there are no changes to the immediately abutting properties that would be adversely
affected by the approval process; and
iv. Because of the lapsed time since original approval, that the preliminary plat is not in
conflict with recently changed policies or regulatory schemes adopted by the city that
would be undermined by the further time extension.
The letter from Mr. Davis has addressed each of the four criteria above. Should the city council agree
with his written response to the four criteria the council may grant the extension for up to two years. This
would be the final extension permitted under the subdivision regulations. If the developer fails to
complete the necessary conditions to receive final plat approval from the city council in the next two
years there is the option of resubmitting a preliminary plat application for review and approval.
RECOMMENDATION: A motion to adopt the resolution and grant a final two-year extension to the
preliminary plat approval for phases 1-A and 1-B of the Bloomstone Subdivision would be in order.
FISCAL EFFECTS: Minor positive impacts once fully developed.
ALTERNATIVES: As suggested by the city council.

A RESOLUTION APPROVING A TWO-YEAR EXTENSION TO THE PRELIMINARY
PLAT OF BLOOMSTONE PHASES 1-A AND 1-B.
WHEREAS, the city council of the City of Kalispell granted preliminary plat approval for
Bloomstone Phases 1-A and 1-B on April 21, 2008; and
WHEREAS, the city council of the City of Kalispell granted two (2) one-year extensions of the
preliminary plat for Bloomstone Phases 1-A and 1-B on February 22, 2011 and
March 19, 2012; and
WHEREAS, Jim Davis, on behalf of Kalispell National Investment Company, has requested a
two-year extension to the preliminary plat for Bloomstone Phases 1-A and 1-B; and
WHEREAS, Section 28.2.06.E.7.b of the Kalispell Subdivision Regulations states that if a final
plat has not been filed at the end of the additional two-year extension period, the
owner may appeal to the city council in writing for one final extension not to exceed
two years provided certain conditions are met; and
WHEREAS, Kalispell National Investment Company has met the certain conditions and it is in the
best interests of the city that the two-year extension be given.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, MONTANA AS FOLLOWS:
SECTION I. That the application of Kalispell National Investment Company for an
extension of the preliminary plat of Bloomstone Phases 1-A and 1-B,
Kalispell, Flathead County, Montana is hereby approved for a period of two
years ending the 21 st day of April, 2015.

Dear Sean:
Thank you for your letter regarding Bloomstone's Phase 1-A and 1-13 preliminary plat
expiration.
Pursuant to your letter, KNIC LLC would like to request a two-year extension to the
preliminary plat approval filed in April, 2008 and currently extended to April 21, 2013.
This would extend the preliminary plat approval through April 21, 2015.
➢ The existence of an unusual hardship.
Due to the current economic situation and housing markets, KNIC is unable to
proceed with the Bloomstone development at this time. However, as you know we
have several current opportunities for this project in the works. We have the intent
to proceed with this project as soon as we can justify a substantial turn around.in
above mentioned situations.
➢ That a significant public good would be accomplished through the extension as
opposed to a specific economic hardship related to the owner.
Phase lA and 1B include a mix of housing types that will accommodate a wide
range of home buyers. Completing this phase of Bloomstone will also get us
closer to achieving our overall plan of a desirable, master planned community
with many amenities for its residents. Bloomstone's close proximity to Kalispell's
major growth area will provide a public good for future residents, current
employees and future students to our ever growing college.
➢ That there are no changes to the immediately abutting properties that would be
adversely affected by the approval process.
We believe that abutting properties will not be affected by this approval process.
Bloomstone is bordered by four -mile drive on the south, the proposed By -Pass on
the west and Kid's Sports on the east, as well as a small parcel owned by the state
on the north. This community will not adversely affect any abutting properties. It
can and will only improve them.
➢ Because of the lapsed time since original approval, that the preliminary plat is not
in conflict with recently changed policies or regulatory schemes adopted by the
city that would be undermined by the further time extension.
KNIC is not aware of any changes in policy or regulatory schemes that would be
undermined by an additional two year extension. As you know, we have worked
extensively with the city to achieve a community that fits well with the city and
the areas surrounding developments.

with you on making Bloomstone a successful project for our development team, the City
of Kalispell, and our future residents.
