AGENDA ITEM 3 - REQUEST FROM MICHAEL SEAMAN FOR SEWER
CONNECTION - 405 EAST COTTONWOOD
BACKGROUND/CONSIDERATION: Enclosed is a memo from Jim Hansz concerning
the request from Mike Seaman for sewer connection at 405 E. Cottonwood. You may recall
that we denied this request at a meeting last month. We currently do not have the withdrawal
from the Fire District, nor the waiver forms for future annexation.
RECOMMENDATION: With this new information available, I concur with the Public
Works Director's recommendation to approve the request.
ACTION REQUIRED: A motion to approve the application, subject to the receipt of
the waiver/withdrawal forms from Mr. Seaman, will authorize the Staff and Mr. Seaman to
proceed.

Subject: 405 E. Cottonwood Sewer connection, Mike Seaman
The Evergreen district and the applicant have provided additional information to support
this request. The information indicates that previously expressed concerns have been
adequately addressed. Further, the applicant has submitted information that indicates the
existing septic system is at or approaching failure which is an unacceptable condition that
could adversely affect the groundwater and adjacent river. The total additional load on the
existing plant is estimated to be 188 GPD which is considered to be nominal and not a
problem. The applicant has been advised of the City's "out -of -City, treatment -only"
connection fee of $1,592.00 for this connection. No waiver or withdrawal forms were
submitted as required.
After reviewing the additional supporting data provided by the applicant and Evergreen
the staff recommends favorable consideration by the City Council of the applicant's
request to connect to the Evergreen sewer system subject to the applicant submitting the
required waiver/withdrawal forms and any other requirements levied by the Council.
Correspondence from Evergreen is attached along with a map and an aerial photo of the
area.

The purpose of this letter is to provide some clarification regarding a proposed sewer service
connection to a single family dwelling at 405 E. Cottonwood Dr. This property has been
purchased by Mike Seaman.
In accordance with the interlocal agreement between Flatbead County Water & Sewer District #1-
Evergreen (the District), and the City of Kalispell, the District is not authorized to connect users
outside the exterior boundaries of RSID #132 without written consent from the City.
A portion of the parcel that includes the home at 405 E. Cottonwood Dr. is within RSID #132.
The home was excluded from the RSII? and is now on a septic system. Mr. Seaman proposes
abandoning the septic system and connecting into the conventional sewer main to the west of the
home-

authorization for the connection, they would require verification that the District Board of
Directors would approve the connection. At a regular monthly board meeting held February 11,
1998, the Board Directors approved the connection pending written consent from the City -
The main item of consideration for the City is the allocation of capacity above the $682,000 gpd
allocated to Evergreen. The proposed connection will be a service line for the one residence.
Standard wastewater flows for a single family dwelling are considered to be 188 gpd.
The service will be installed to District specifications and the owner will become a customer of
the District's sewer system.
Please contact me if you have any questions or concerns regarding the proposed connection that
have not been addressed.

Dear Mike:
Attached is an original copy of the information regarding the existing septic tank system
located at the residence at 405 E. Cottonwood Drive, Kalispell, MT. As this verifies, the
system is in excess of 35 years old. My folks did not have a washer or dish washer
hooked up to the system early on after they bought the residence in 1964, and later did
not consider it prudent to add a washer or dishwasher to the system because of its
advanced age. My folks did have trouble several times with tree roots growing through
the pipes leading from the house to the tank.
