8. Conditional Use Permit - 1st Avenue West Casino
Agenda -March 2, 1998 AGENDA ITEM 8 -CONDITIONAL USE PERMIT - 1n AVENUE WEST CASINO (FORMERLY 1 sT AVENUE WEST RESTAURANT) BACKGROUND/CONSIDERATION: I have enclosed the reports from FRDO and the Planning Board for this request for a Conditional Use Permit. The FRDO staff and the Planning Board of both recommended approval of the change of use. They have recommended four conditions be included with the permit. Those are outlined in Attachment A. RECOMMENDATION: The Findings of Fact, the staff recommendation, the Planning Board's recommendation to approve, the general compliance of this use within this vicinity, and the lack of opposition, all support a recommendation for approval. I concur with the recommendations. ACTION REQUIRED: A MOTION to approve the conditional use permit with four conditions will complete the process for this request. City of Kalispell P. 0. The property proposed for this use is the former First Avenue West restaurant located at 139 First Avenue West, Kalispell. Narda Wilson with the Flathead Regional Development Office reviewed the proposed plans for the conversion of the building to a casino. She recommended approval of the proposal subject to four conditions. The applicant, the casino manager and the architect for the applicants explained the project and asked the board to grant the permit. No one spoke in opposition. The planning board discussed the project. There was a motion to adopt staff report KCU- 98-1 as findings of fact which passed on a vote of seven in favor and none opposed subject to conditions listed in Attachment A. This recommendation for approval is being forwarded to the City Council. Please schedule this matter for the March 2, 1998 regular City Council meeting. Armstrong for a conditional use permit to allow a casino in an B-4, Central Business District zoning district. A public hearing on this matter has been scheduled before the planning board for February 10, 1998, beginning at 7:00 PM in the Kalispell City Council Chambers. The planning board will forward a recommendation to the City Council for final action. BACKGROUND INFORMATION The applicant is submitting a request to allow the operation of a casino in an existing building where a restaurant and bar have traditionally located. A casino requires a conditional use permit in this zone, the B-4, Central Business District, and all districts. A. Petitioner: David D. Armstrong P.O. Box 310 Whitefish, MT 59937 (406)862-0398 B. Size and Location: The property proposed for the casino is located on the east side of First Avenue West and north of Second Street west approximately 50 feet. The property is located on two half city lots which comprise approximately 7,500 square feet. The property can be described as Lots 15 and 16, Block 46, Kalispell Original in Section 18 Township 28 North, Range 21 West, P.M.M., Flathead County, Montana. C. Nature of Request: The applicant is requesting a conditional use permit to allow the conversion of an existing bar and restaurant, First Avenue West, to a casino which will also have a bar and restaurant, Swift Creek Cafe. Basically the building will not be substantially modified on the inside and no significant exterior modifications will be made. Food will be served from 7:00 AM to 10:00 PM and the bar will be open from 8:00 AM to 2:00 AM. The casino will be open from 7:00 AM to 2:00 AM. Some interior modifications will be made to partition off the various areas within the building. D. Existing Land Use and Zoning: In the past, First Avenue West Restaurant and Bar have operated in the building proposed for the casino. The existing building contains approximately 3,610 square feet which will not be substantially altered. The zoning for this property is B-4, the Central Business District. This zoning district lists bars and taverns as a permitted use, but lists casino as a conditionally permitted use. E. Surrounding Zoning and Land Uses Zoning: There are a variety of commercial, retail and office uses in this immediate area. This area is the commercial core of Kalispell and is characterized by a full spectrum of downtown area uses. The Kalispell Center Mall lies to the north approximately two blocks and Main Street Kalispell is one block to the east. North: City parking lot and Eagles Lodge, B-4 zoning South: Bank and offices, B-4 zoning East: Restaurant, bar, retail stores, hotel; B-4 zoning West: Offices, retail and parking lot, B-4 zoning F. Master Plan Designation: The Kalispell City County Master Plan Map designates this area as commercial. This is the core of the central business district for Kalispell which should provide a full spectrum of commercial, office, retail, restaurant and banking facilities. The central business district seems to be a reasonable place to anticipate casinos within the community. Evaluation of the Request: Site Suitability: a. Adequate Useable Space: Two half city lots will be used for the restaurant, bar and casino. Both of the lots together total approximately 7,500 square feet. Within the site, there are three parking spaces along the alley to the east, an outdoor seating area to the north and an entryway with landscaping. The central business district does not have setbacks, lot coverage or minimum lot size requirements. This particular property is also located in the Special Parking Maintenance District No. 2 which does not require additional parking for an existing building unless it is enlarged in height or ground coverage. Since there will be not increase in the square footage of this building, no additional parking is required under the zoning. b. Adequate Access: Although this property does not have a driveway, per se, onto First Avenue West, that is where primary access would be considered to exist. On street parking is located on the street in front of the building on First Avenue West and in the City parking lot to the north. C. Environmental Constraints: There are no significant environmental constraints apparent on the property. It is generally level and has been fully developed in the past. 2. Appropriate Design: a. Parking Scheme: Under the Kalispell zoning regulations no additional parking `is required for buildings undergoing reuse which are located in the Special Marking Maintenance District No. 2. There are three parking spaces located on site on the east end of the property. A City parking lot which contains approximately 100 parking spaces is located directly to the north. Most patrons of this restaurant in the past either parked on the street near the building or in the City parking lot to the north. Parking can be considered to be in substantial compliance with the Kalispell Zoning Ordinance requirements. b. Traffic Circulation: Persons visiting this casino, restaurant and bar would not enter the site because there is basically no traffic circulation within the site itself. Traffic could enter the parking lot to the north which provides a one way circulation pattern. The street to the north, First Street West, is also one way and provides some diagonal parking. Traffic circulation in the area is generally good. C. Open Space: No specific open space requirements are required under the zoning, including setbacks. However, there is a small courtyard area and landscaping near the entryway that provide some green area and open space on the site. d. Fencing/Screening/Landscaping: As mentioned above, some landscaping currently exists on the site within the courtyard and around the entryway. No additional landscaping, screening or fencing is proposed nor appears to be necessary. e. Signage: Some modifications to the existing signs will be made and some minimal neon lighting around the top of the building. One of the signs proposed for the building has been included in the application packet. A sign permit will be required to be obtained from the City. 3. Availability of Public Services/Facilities: a. Schools: This site is within the boundaries of School District #5, however, this proposal should have minimal impact on the school district. b. Parks and Recreation: Depot Park is probably the closest park to this property which is approximately two blocks from this site and within easy walking distance. No significant impacts to the park system can be anticipated as a result of this use. 3 C. Police: There may be some minor impacts to the police department which can be anticipated as a result of the use primarily because of its nature. d. Fire Protection: Fire protection will be provided by the Kalispell Fire Department. Modifications to the building will be required to comply with the Uniform Fire Code. Additionally, there are fire hydrants in the area as well as good access to the site in the case of a fire. e. Water: City water will be used to serve the facility. No significant impact on water services can be anticipated as a result of this facility. f. Sewer: Sewer service will be provided by the City of Kalispell. No significant impacts on City sewer services can be anticipated as a result of the proposed use. g. Solid Waste: Solid waste pick-up will be provided by the City, and no significant increased impacts can be anticipated as a result of the proposed use. h. Roads: Some significant traffic can be anticipated to be generated as a result of this use. Access will generally be onto First Avenue West or the general area. All of these streets are City paved streets in generally good condition and well maintained. Roads in the area are adequate to accommodate the proposed use. i. Immediate Neighborhood Impact: The general character of this area is commercial which provides a full range of consumer, retail, office and downtown uses. Although the staff has some concerns regarding the expansion of the casino uses in the downtown area, it does not seem our of character with other uses in the immediate vicinity. The overall impact on the area does not appear to be significant. REACTION OF NEARBY PROPERTY OWNERS A notice of public hearing was mailed to property owners within 150 feet of the subject property approximately 15 days prior to the hearing. At the writing of the staff report, no inquiries have been received by the Flathead Regional Development Office. SUMMARY OF FINDINGS 1. The size and location of the site is adequate to accommodate to the proposed use. 2. The site design with regard to access, parking, location of the building and setbacks is in general compliance with the zoning and design standards of the City. 3. Existing public services and facilities are available and adequate to serve the proposed use. 4 4. There will no significant negative impacts to the neighborhood as a result of the proposed use. RECOMMENDATION It is recommended that the Kalispell City -County Planning Board adopt staff report #KCU-98-1 as findings of fact and recommend to the Kalispell City Council that the Conditional Use Permit be granted subject to the following conditions: 1. That the proposal will be developed in substantial conformance with the approved site plan and the Kalispell Zoning Ordinance. 2. That any additional neon lighting proposed for the building be limited to one additional strip along the top of the building. 3. That the proposed use comply with all local, state and federal regulations which may apply to the construction and operation of a gaming facility. 4. LOHFERS, LLC, is purchasing the First Avenue West real property. Dave Armstrong and Clint Lohman are the members of LOHFERS, LLC. Exterior walls at the First Avenue West location will receive minor signage changes. The interior of the building will need some minor cosmetic changes. Looks and appearance overall will not change. It is our most sincere intention to preserve the First Avenue West building in its present condition. Food service at the restaurant will be provided by Megan McFadden and Jeanie Schultz who currently own and operate Swift Creek Cafe in Whitefish. Hours of food operation will be 7 AM to 10 PM serving breakfast, lunch and dinner. Power K, Inc. will own and operate the First Avenue West liquor license. Dave Armstrong and Evelyn Lohman are the shareholders, officers and directors of Power K, Inc. Bar operations will be maintained the same as before. There will be no physical changes to the bar area at all. Hours will be 8 AM to 2 AM. Power K, Inc. will operate the licensed gaming. Gaming machines will be located towards the rear of the building. This area at the present time is known as the main dining area. Minor cosmetic changes such as a dividing partition will be made in this area and the area will be considered the casino area.
